Huh: DOJ investigating the strange case of Lois Lerner’s missing e-mails

You tell me what the angle here is. Obviously they’re not really interested in finding out what Lerner and the IRS were up to in targeting tea-party groups. If they were, they would have interviewed the targets, which they haven’t.

Are they suddenly worried about the politics of this? Was Holder quietly replaced when we weren’t looking by someone who’s not a political hack? What’s the frequency, Kenneth?

As part of its criminal probe into the IRS’s treatment of politically active conservative groups, the Justice Department is “investigating the circumstances of the lost emails from [former IRS official Lois Lerner's] computer,” according to prepared testimony by James Cole, the deputy attorney general. Mr. Cole is set to appear at a hearing scheduled for Thursday before a panel of the House Oversight and Government Reform Committee. The Wall Street Journal reviewed his prepared testimony on Wednesday.

Mr. Cole’s comments underscore the potential seriousness of the email loss, which has roiled congressional probes of the matter and angered some top GOP lawmakers. The IRS has blamed the loss on a crash of Ms. Lerner’s hard drive—a common occurrence at the agency, officials say. They add a backup tape also was routinely recycled after six months.

Maybe Holder realized that House Republicans really might impeach him and that that impeachment effort would be harder for Democrats to spin than if the GOP went after Obama. Ted Cruz has been saying for weeks that if Holder refuses to appoint a special prosecutor for the IRS scandal, he should be impeached. There’s a bill floating around in the House that would declare “no confidence” in Holder’s DOJ and give him the opportunity to step down during the August recess before beginning impeachment proceedings against him in September if he refuses. Senate Democrats wouldn’t vote to remove him, of course, but they don’t want to spend the fall playing defense on this guy. Bad enough that they’d have to explain why the attorney general has no interest in something as shady as evidence going missing from a computer used by an already shady-seeming IRS official. If the GOP comes after Holder, though, it’d force them to revisit other stuff too — not just conservative interests like Fast & Furious but bipartisan outrages like Holder authorizing the DOJ to snoop on reporter James Rosen in the name of sniffing out a leak. If Obama were being impeached, Democrats could ride the backlash to safety. How much of a backlash would there really be, though, to impeaching Holder? You know what he’d say — he’s already previewed his defense — but that wouldn’t explain his indifference towards Lerner’s hard drive.

So, they’re going to throw the GOP a bone and investigate. Hooray. Exit question: Do you think they’ll find anything incriminating? I can’t shake the funny feeling that they won’t.

Cover before the election, that’s all this is. A snazzy show that the DOJ is investigating the IRS email situation will take it off the front burner before November. and once the elections get rolling, the Dems can say; the DOJ is investigating that and we cant comment while there is an open investigation going on.

Hmmm. I seem to recall the administration repeatedly taking the position that they can’t disclose any information if there’s an ongoing investigation. Could be this is laying the groundwork for going back to the D.C. District Court in the two civil cases and claiming privilege.

Good, it will backfire on them because they won’t do anything and witnesses, under oath, will testify that they haven’t been contacted by the DOJ (see Koskinen’s testimony).

PS. If they were serious they would assign the FBI to begin a full blown investigation.

BTW, a hard drive crash and losing emails are mutually exclusive events. Typically emails are stored on a server which should automatically download to the new hard drive/computer when she logs into her account.

I think this is a reaction to the two federal judges rulings last week. Holder knows he can control the justice department and Congress is impotent.
However, a federal judge can put people in jail if they don’t cooperate, and perjury is a felony.

IMHO, the DOJ hasn’t done any real investigation and they’re now panicked as to what really might be out there that might come to light from a judge’s order. When the rank and file in the IRS are faced with cooperating and telling the truth under oath or jail time, most will opt for the former.

It just might be panic time. And folks usually make mistakes when they panic.

Even Holder and the DOJ have to do a little investigation to find out some of the facts in order to defend against the truth better. I have no doubt whatsoever that nobody in the administration tells anybody the truth about anything at anytime. Makes it a little difficult to defend someone when even the people on the insode have little or no idea what is going on next door.

An open investigation means no more talky about it. Anything like a congressional subpeeny would be an obstruction to the investigation.

The other purpose is to find all the loose ends and have them meet with a catastrophic end.

UNDER INVESTIGATION = CAN’T ANSWER ANY QUESTIONS

C’mon, this is the Holder DOJ where investigations of the Executive Branch go to die.

Any questions or subpoenas from Congress to the IRS will now be referred to the FBI and DOJ, who are unable to comment because the matter is under investigation. We expect the investigation to be completed sometime in early 2017.

If there is anything the NSA does not have yet in its massive databases, it is probably data from other federal agencies. DOJ may still have to go to the source to protect the data from falling in the wrong hands. Yep

They don’t want to have to issue blanket pardons, so the investigation (which also has the side benefit of effectively shutting down the Congressional one) will be figuring out exactly what crimes need to be pardoned.

I’m not sure if my read on this is correct but I’d guess the heat is being turned up, by outside forces the Justice Department has no control over, and they feel the necessity to put on some sort of show, rather than just do nothing.

I’m sure they’ll still be in full cover-up mode but at least they’ll try and look like they’re not.

This can only mean Holder never began his IRS investigation.

The first thing a DOJ investigator would do is seize Lerner’s records and e-mails.

Why is he only investigating the missing e-mails now?

He should have known they never existed.

Holder has Lerner’s e-mails. He’s been sitting on them for a long time.

Holder can’t have it both ways. Either cough up those e-mails or start impeachment because he never started his IRS investigation.
