Oh, by the way, Lois Lerner apparently targeted a Republican senator for “examination” too

Not just any Republican senator either. It’s Chuck Grassley, who’s been a bigwig on the Senate Finance Committee — which oversees taxation matters — for ages.

It’s unclear what an “examination” would have entailed, but an audit seems to be on the menu.

“We have seen a lot of unbelievable things in this investigation, but the fact that Lois Lerner attempted to initiate an apparently baseless IRS examination against a sitting Republican United States Senator is shocking,” said Camp. “At every turn, Lerner was using the IRS as a tool for political purposes in defiance of taxpayer rights. We may never know the full extent of the abuse since the IRS conveniently lost two years of Lerner emails, not to mention those of other key figures in this scandal. The fact that DOJ refuses to investigate the IRS’s abuses or appoint a special counsel demonstrates, yet again, this Administration’s unwillingness to uphold the rule of law.”

Background:
While the Ways and Means Committee investigation into Lerner’s involvement in the potential Grassley examination is ongoing, documents show that Lerner received an invitation to a speaking event that was intended for Senator Grassley. Instead of forwarding the invitation to Grassley’s office, Lerner immediately suggested to others in her office that the issue should be referred for examination. The Committee was able to investigate this information through its authority under Section 6103 of the tax code. A waiver was signed by Senator Grassley and his wife in order to make this information public.

In other words, both Grassley and Lerner were invited to the same tax event, but somehow Grassley’s invite ended up in Lerner’s envelope. That’s how she knew he’d been invited. And because Grassley’s wife was included on the invite, Lerner jumped to the conclusion that the event organizers were offering to “inappropriately” pay for his wife. What’s wrong with her raising the alarm about that? Well, (a) there was no reason yet to think Grassley had accepted the invitation. She wanted to “examine” the guy on the mere possibility that he would. And (b) per her e-mail exchange with her deputy on this, she seems … not to understand the law at all. It falls to the deputy to explain to her that it’s not illegal for event organizers to pay for his wife so long as he reports the income on his 1040. In other words, not only did she assume without knowing that Grassley and his wife would attend, she assumed without knowing that they’d end up lying about it on their next tax return.

DrewM makes an interesting point, though: Are we sure from the e-mails that it was Grassley whom Lerner was targeting rather than the organization that sent the invitation? It’s ambiguous; read the e-mails yourself and see. It may be that she wanted the group examined, not Grassley, for offering to pay for his wife irrespective of whether Grassley acted on that offer. Although even there, the deputy’s point is that … it’s not illegal! It would all depend on whether the group properly recorded and disclosed the payment made to Mrs. Grassley. The Grassleys might have ended up getting sucked into the investigation later, to see whether they had disclosed the income from the group on their own return, but it could be that it was the group that was chiefly in her crosshairs, not him.

So that’s the best-case scenario. The head of the IRS’s exempt organizations divisions wasn’t targeting a Republican, she just didn’t know the rules about exempt organizations well enough to handle a rudimentary question involving an invitation. Sleep tight, America.

Here’s something to think about. It’s clear from the exchange that Lois was invited to the same event. I suspect that her husband was invited too, much as Grassley’s wife was. So using her own logic, shouldn’t she be referred for an examination? Or if she was only referring to the organization, would she refer them to “Exam” for inviting her husband? Hmmm…

I disagree. First, the response e-mail makes reference to Grassley having to report the money as income, which suggests the focus is on him. Second, Lerner puts the emphasis back on Grassley when she says she “doesn’t want to be onstage with Grassley on this issue.” (I’d also note that there is a redaction, which could cut either way. Let the IRS explain what was happening here.)

WASHINGTON D.C. – U.S. Representatives Bill Flores (R-Texas) and Louie Gohmert (R-Texas) have introduced legislation that provides incentives to find former IRS director Lois Lerner’s missing emails.

“I find it very hard to believe that the emails from Lois Lerner are lost and unrecoverable. It is very convenient that the IRS is unable to turn over any of the communications from the central figure responsible for the inappropriate targeting of conservative groups. We will not sit idly by as the IRS continues to work to cover up its blatant abuse of government power,” Congressman Flores said.

“It seems that each time the IRS has evidence that will either prove with certainty its guilt or innocence, the evidence disappears which both common sense and the law indicate the evidence such as emails must have proved the IRS’s impropriety if not outright crimes. It is time the IRS either comes clean, or has a special prosecutor to clean it up. This bill should help in the interim,” Congressman Gohmert said.

The Identify and Recover Sent E-mails (IRS) Act (H.R. 4958) would award any individual or group who can recover Lois Lerner’s lost emails $1,000,000 and award $500,000 for information regarding the destruction of the emails that can be used for prosecution of the individuals involved. These rewards would come from the unobligated balances from the IRS fiscal year 2014 budget. Additionally, this legislation would cut salaries at the IRS by 20 percent, until the emails are recovered.

“Lois Lerner’s involvement in the planning and execution of beliefs-based IRS targeting can only stay hidden for so long. By providing these incentives we can get people to reveal the hidden truths behind this egregious cover up,” Flores stated. “It is time to hold the IRS’ feet to the fire and for them to come clean about Lois Lerner’s involvement. I remain committed to uncovering the truth and ensuring that all federal agencies are working to serve the American public with integrity and fairness.”

I don’t see where she did that. At 11:09 AM on Dec. 4, Lerner writes, “Perhaps we should refer to Exam?” And at 12:27 PM that day, Matthew Giuliano writes, “Not sure we should refer to exam … the offer to pay for Grassley’s wife is … not prohibited on its face …” In other words, Lerner wanted to lay the fist on the organization before the other employee explained to her that there was no apparent wrongdoing, not after that.

I don’t want anyone defunding in any way the IRS without having a replacement in effect. Otherwise, we just increase the deficit even more. And I want the replacement simple enough so that government and individual processing and compliance costs are minimal. To me, a flat rate VAT (maybe with a flat income tax without exemptions/exclusions) would make the most sense.

No VAT. I want taxes to be as visible to people as possible. I think part of the reason people let the government waste 50-60% of their incomes is that a ton of taxes are obscured from view. For example, the diesel tax in my state is ridiculously high. Most people don’t drive diesel cars, so they don’t really think about it or notice it.

But everything they purchase in the state was driven in by a diesel truck. The drivers of those trucks factor the price of diesel (with tax) in to their delivery costs, which increases the cost of everything.

That’s a hidden tax most people don’t think about. The VAT operates in a very similar way, and would just be increased behind the scenes until it was as oppressive as our current tax system.

I disagree. First, the response e-mail makes reference to Grassley having to report the money as income, which suggests the focus is on him. Second, Lerner puts the emphasis back on Grassley when she says she “doesn’t want to be onstage with Grassley on this issue.” (I’d also note that there is a redaction, which could cut either way. Let the IRS explain what was happening here.)

the response email reads “not sure on exam: the offer to invite grassley’s wife is not prohibited”. that is, the offer is not prohibited — the offer is not subject to punishment, therefore an exam would be superfluous.

furthermore, lerner’s initial email already makes clear that she’s talking about the group with the wording that i already pointed out before: “looks like they were inappropriately offering to pay for his wife…should we exam?”

in other words, you’d have to be reading “looks like this group did something wrong offering to pay for grassley’s wife…should we exam” as “this group did something wrong…so let’s exam GRASSLEY”…andthe group’s behaviour is not prohibited because grassley is not an insider” “this group’s behaviour is not prohibited, so grassley is in the clear”.
