DHS releasing illegal immigrant families from Central America into U.S. — but won’t say how many

Seven times the AP asked them for a number, seven times the feds said they either didn’t know or that they’d get back to them. You trust Obama to faithfully report the effects of new border security laws after comprehensive reform passes, don’t you?

An ominous possibility here: Maybe they really, sincerely don’t know. Maybe the crush of illegals over the past six months has been so huge and the system so overwhelmed by trying to process and house minors that they’re turning people loose now without even pausing to record their presence. Usually “catch and release” at least involves a tally. Who knows anymore?

Despite promises to the contrary, this is how it looks when the image-conscious Obama administration doesn’t want to reveal politically sensitive information that could influence an important policy debate. The mystery figure is significant because the number of families caught crossing from Central America represents a large share of new immigration cases that will further strain the overwhelmed U.S. immigration courts system. It also affects federal enforcement strategy, such as where to deploy the border patrol, and political calculations about whether Congress or the White House will relax American immigration laws or regulations before upcoming congressional elections in November.

Most of the immigrant families are from Honduras, El Salvador or Guatemala and cannot be immediately repatriated, so the government has been releasing them into the U.S. interior and telling them to report within 15 days to the nearest U.S. Immigrations and Customs Enforcement offices. Despite promises for better transparency on immigration issues, the administration has been unwilling to say how many immigrant families it’s released — hundreds or thousands — or how many of those subsequently reported back to the government after 15 days as directed.

The best spin you can put on this for the White House is that they’re willing to deport the new illegals but that their enforcement resources aren’t remotely equal to the task. DHS estimates that more than 50,000 children from Central America have been caught trying to cross the border since October; another 150,000 — no typo — are expected next year. (That’s just children. Adult illegals aren’t included in the estimate.) They can’t house them so out the door they go, with nothing more than an empty promise that they’ll show up for their first immigration hearing. Seems like a fine time for the head of the executive branch to demand that Congress provide him with new resources to cope with this security crisis, but Obama naturally hasn’t said a word. Democrats don’t support border security except as a concession grudgingly made as part of a comprehensive deal that gets them what they really want, i.e. amnesty. Not unless and until this issue starts to bite them in the ass in midterm polling will they entertain the thought of more security on its own terms. The most you can expect here is that Obama will quietly shelve his plans for a new executive order relaxing deportations while this is going on. Which won’t do a thing about the flow of illegals the BP is struggling with.

And for the record: No, most of these kids won’t be going home. This story is now big enough that it landed on the radar of a nonpolitical friend of mine this weekend, who asked me if the White House’s promises to deport them are true. Of course they aren’t. Even low-information voters should know that by now.

“It will not be open arms,” Biden said. “We’re going to hold hearings with our judges, consistent with international law and American law, and we’re going to send the vast majority of you back.”…

A leaked May 30 internal memo written by a top Border Patrol official, Deputy Chief Ronald Vitello, said, “Currently only three percent of apprehensions from countries other than Mexico are being repatriated to their countries of citizenship, which are predominantly located in Central America.” That three percent is nowhere near the “vast majority” Biden promised…

“It’s taking a year or more in some places for these people to come up on a hearing,” says Gary Mead, a former head of Enforcement and Removal Operations for Immigration and Customs Enforcement. “And many times, they don’t have an attorney, or they’ve lost an attorney, and they get an extension, and maybe it’s two years before they have a hearing. And in the interim period, they enroll in school, or they get a job, or they are reunited with family members, and then they are no longer an enforcement priority.”

Ninety thousand young illegals will be here by the end of the year and, as noted, another 150,000 are expected next year. Even if you assume a five percent rate of repatriation, that’s over 225,000 kids being granted de facto amnesty via “catch and release,” with de jure amnesty possibly to follow once Democrats decide they need Obama to expand DACA as part of another election-year gimmick for Latino voters. That’s the backdrop for Democratic — and Republican — promises that this time when they enact comprehensive reform, they’ll really, totally, absolutely make sure that America never has to pass another amnesty. As usual, it’s not the lies that are egregious, it’s how transparent the lies are.

By the way, has the border surge become an issue in any Senate races yet? I might be missing something but I haven’t noticed it blowing up anywhere. That may be a product of equilibrium, or perceived equilibrium, between pro- and anti-amnesty forces. A Republican who pounds the table about lax border security risks antagonizing Latinos; a Democrat who demands amnesty for the kids who’ve arrived from Central America risks energizing conservatives. There may be a rough truce in effect just because the politics of this are so difficult to predict.

You have to start from the assumption that any GOP candidate can count on some % of “Latino” votes (I put “Latino” in quotes, because these are people of white European descent and not some separate race like the media/left portrays) that will be lost if they don’t appease on amnesty. This is nonsense.

Any Latinos currently voting for the GOP are not going to be turned off by talk of border security and any Latinos currently for amnesty are not going to vote GOP in the near future regardless of what the GOP does on amnesty.

And, even more telling, there are very few states where the Latino vote is going to make a difference.

This idea that there is a rough “truce” is nonsense.

The reality is, the GOP is prepared to sell out its base on amnesty so doesn’t want to address this issue at all if possible until it passes an amnesty.

Democrats are running from the issue because amnesty polls so poorly among all non-Hispanics.

there would be no actual downside and quite a bit of upside for the GOP to run on this issue – particularly now with current events.

That the GOP refuses to is more telling than almost anything else.

A few days ago, I got a call from a church that does charity work for poor kids in our city,
asking me for gently used clothing , toys, canned food , strollers, CASH , anything I could donate for poor
” orphans” who needed refuge from violence in their native lands.
I asked the lady if it was for diseased illegals invading our country , which silenced her for a moment and before she could start her muttering again, I said
” I DO NOT HELP TRAITORS ” and hung up on her.
Today, I found out they are dipping in to local government funds to raise this new generation of parasites, right under our very noses .

The U.S. Border Patrol detained 378 children aged two or less who were traveling without a parent or guardian from Oct 1 through June 11, according to data obtained by Fusion from the office of a high-ranking Democratic senator who wasn’t identified. Of those, 95 were under a year old.

Parents may be sending their wee ones across the border in hopes they will be allowed to stay, fueled in part by misconceptions among migrants that people with children can enter the U.S. legally.

Hundreds of Toddlers Said to Be Taken Into Custody at the Border

Hundreds of infants and toddlers ages 2 years or younger have allegedly been apprehended by U.S. Border Patrol while crossing the border illegally without a parent or guardian in the past year.

From October 1, 2013 to June 11, Border Patrol detained 378 unaccompanied children ages two or younger, according to data obtained by Fusion from the office of a high-ranking Democratic senator. Of those children, 95 were infants under 1 year old.

Fusion tried multiple times by phone and in writing to confirm the reports with U.S. Customs and Border Protection and the Department of Homeland Security, but no official would comment specifically, and instead referred to a

previous statement.

The Department of Health and Human Services, charged with the care of unaccompanied minors caught at the border, did not respond to a request for comment.

Omar Zamora, a spokesperson for the Border Patrol’s Rio Grande Valley sector, limited his comment to: “We are receiving children of all ages.”

Official data from last year shows that U.S. Immigration and Customs Enforcement logged 27 deportations of children under the age of two, suggesting the federal government has processed infants in the past.

Emily Butera, a senior program officer at the Women’s Refugee Commission, said she has seen unaccompanied babies in the shelter system in past years, but that the problem is getting worse. She said the youngest kids are sometimes sent across the border with older siblings, or with paid smugglers.

Butera said the average age of an unaccompanied child migrant is now 14 years old, younger than in previous years. “And we’re seeing more babies and toddlers than we had in the past,” she said.

The phenomenon puts an exclamation point on the greater immigration crisis along the U.S.-Mexico border. Roughly 52,000 unaccompanied minors have been apprehended at the border since October 2013, an increase fueled largely by people fleeing Honduras, Guatemala and El Salvador.

In response to what the White House has called an “urgent humanitarian situation,” the Obama administration on Friday announced major policy changes to step up enforcement of existing immigration laws.

Deputy Secretary of Homeland Security Alejandro Mayorkas told reporters that his department is searching for locations to open new detention centers that are suited to house adults with children. He said the government will expand the use of alternatives to detention, such as electronic monitoring devices, to track migrants who are released from custody.

Many recently arrived migrants have reportedly been released from custody to stay with relatives. They are instructed to report to the nearest immigration detention center for processing. Mayorkas on Friday could not provide an exact number of immigrants who have been released to family members and asked to return to custody.

He did, however, say that more immigration judges and asylum officers will be sent to the border region to help speed up processing.

The government’s enforcement beef-up comes as the White House tries to combat the misperception south of the border that Central American migrants can enter the U.S. legally if they are traveling with children. Between last October and the end of May, 39,000 adults with children have been apprehended at the border, Mayorkas said.

The flood tide has forced the Obama administration to pursue coordinated strategies on both sides of the border. Vice President Joe Biden traveled to Guatemala on Friday to enlist Central American leaders for help. He phoned Honduran President Juan Orlando Hernández to say that child migrants are not eligible for deportation relief under the Deferred Action for Childhood Arrivals program. The White House did, however, offer an additional $10 million to Central American governments to re-integrate young migrants who are sent back to their home countries

White House Domestic Policy Director Cecilia Muñoz said Biden’s trip is to combat the “misinformation that is being deliberately planted by the criminal organizations… about what people can expect if they come to the United States.”

Republicans blame Obama’s immigration policies for triggering the influx of Central American children.

“The policies of your administration have directly resulted in the belief by these immigrants that once they reach U.S. soil, they will be able to stay here indefinitely,” House Speaker John Boehner (R-Ohio) wrote in a letter to President Obama on Friday.

The letter called on the president to deploy National Guard troops to “deal with the needs of these children and relieve border patrol.” Mayorkas said the administration was reviewing the letter, but that the National Guard is not normally deployed in situations like this.

The White House hopes increased law enforcement will slow the migrant rush. But Democrats and immigrant-rights groups hope the increased effort won’t result in mass detentions.

“We don’t want to be warehousing young children,” said Karen Tumlin, the managing attorney for the National Immigration Law Center.

“There are alternatives to detention like ankle bracelets and supervision to manage the backlog in processing that are much more humane and cost-effective than taxpayer-funded public or for-profit detention centers,” said Douglas Rivlin, a spokesman for Rep. Luis Gutiérrez (D-Ill.)

Infants and toddlers represent a small fraction of the unaccompanied children detained at the border, but they present a unique challenge, authorities say.

“Apprehending infants and children can be difficult for Border Patrol agents; our facilities are not designed with people that young in mind,” said Shawn Moran, a spokesperson for the National Border Patrol Council. “We often have minimal amounts of diapers, formula, and other items for the care of infants and toddlers.”

What a lot of these Central Americans would do is claim fear of returning to their country. They get what’s called a “Credible Fear” interview, which usually resulted in a positive decision. While waiting for a court date for their deportation, they’d be given the opportunity to post a $5K bond to get released. Nearly all got bailed out somehow. Nearly all never showed up to court.

This is what I know from 2012. I’m wondering how things are now.

Boehner Planning House Lawsuit Against Obama Executive Actions

Speaker John A. Boehner told Republicans Tuesday he could have an announcement within days on whether the House will file a lawsuit against President Barack Obama, challenging the executive actions that have become the keystone of the administration.

The lawsuit could set up a significant test of constitutional checks and balances, with the legislative branch suing the executive branch for ignoring its mandates, and the judiciary branch deciding the outcome.

Boehner told the House Republican Conference during a closed-door meeting Tuesday morning that he has been consulting with legal scholars and plans to unveil his next steps this week or next, according to sources in the room.

Boehner spokesman Michael Steel said further action is necessary because the Senate has not taken up bills passed by the House targeting executive actions. The House has passed a bill expediting court consideration of House resolutions starting lawsuits targeting executive overreach and another mandating that the attorney general notify Congress when the administration decides to take executive action outside of what has been authorized by Congress.

“The president has a clear record of ignoring the American people’s elected representatives and exceeding his constitutional authority, which has dangerous implications for both our system of government and our economy,” Steel said. “The House has passed legislation to address this, but it has gone nowhere in the Democratic-controlled Senate, so we are examining other options.”

It remains unclear which executive action or actions the House would challenge, but Obama has given Congress ample targets. In the last several years, he has issued executive actions halting deportations of hundreds of thousands of immigrants who came to the country as children, extending the family and medical leave benefits to gay couples and raising the minimum wage for federal contractors. He has also worked around legislative deadlines for enacting provisions of the Affordable Care Act and issued other executive actions relating to the environment and the gender and race pay gap.

Obama has said he takes executive action because of a divided Congress’ inability to pass laws targeting important issues of the day. Congressional Republicans contend such actions are unconstitutional and thwart Congress’ power.

But individual members of Congress do not have standing to sue because they are not legally recognized as injured parties. Congress as an institution, on the other hand, may sue on the grounds that there has been institutional injury done because their legislative powers have been nullified.

One path Boehner could take would be to convene the Bipartisan Legal Advisory Group, a panel of leaders created in 1993 that votes on whether or not to sue on behalf of the House. The group consists of the speaker, the majority leader, the majority whip, the minority leader and the minority whip, and it would act on a majority vote.

Boehner last convened the group when the Obama administration dropped its defense of the Defense of Marriage Act in 2011. The House has since dropped its challenge of the law. At the time, however, Minority Leader Nancy Pelosi of California objected to the challenge holding that it was an unwarranted way to spend taxpayer money. Her spokesman said she will likely object similarly if Boehner moves forward with a lawsuit against the president.

“While the urgent needs of the American people are ignored by House Republicans, it is reprehensible that Speaker Boehner plans another doomed, legal boondoggle after he spent $2.3 million in taxpayer dollars unsuccessfully defending discrimination in federal courts,” said Pelosi spokesman Drew Hammill.

Boehner’s legal theory is based on work by Washington, D.C., attorney David Rivkin of Baker Hostetler LLP and Elizabeth Price Foley, a professor of law at Florida International University College of Law.

Rivkin said in an interview that in addition to proving institutional injury, the House would have to prove that as an institution, it has authorized the lawsuit. A vote by the Bipartisan Legal Advisory Group would do so.

The suit would also have to prove that no other private plaintiff has standing to challenge the particular suspension of executive action and that there are no other opportunities for meaningful political remedies by Congress, for instance by repeal of the underlying law.

“Prof. Foley and I feel that if those four conditions are met, the lawsuit would have an excellent chance to succeed. This is particularly the case because President Obama’s numerous suspensions of the law are inflicting damage on the horizontal separations of powers and undermine individual liberty,” he said.

Rivkin and Foley have argued in op-eds that most of Obama’s executive orders have been benevolent — that is, they have exempted classes of citizens from the law, for instance through deferred action for childhood arrivals. Therefore, no individual has standing to sue because the actions have helped people. Congress as an institution, however, can sue because the actions flout the laws they have passed.

They have argued that short of impeachment, there is no other check to the president’s issuance of executive actions.
