Lindsey Graham: We might have to impeach Obama if he releases more Gitmo prisoners without Congress’s approval

posted at 11:21 am on June 5, 2014 by Allahpundit

Surprising coming from Grahamnesty, who’s normally in sync with his pal McCain on matters of presidential power over war. Three days ago Maverick sided with Obama on the dispute over 30 days’ notice, saying, “I don’t think that Congress should be legislating that kind of constraint on the commander in chief.” If it’s unconstitutional to require notice from the executive, presumably it’s also unconstitutional for Congress to try to exercise veto power over which battlefield captives do and don’t get released.

Not to Graham, though. Do you suppose the fact that he’s facing a Senate primary five days from now in a deeply red state might have influenced his impeachment chatter?

“It’s going to be impossible for them to flow prisoners out of Gitmo now without a huge backlash,” Graham said. “There will be people on our side calling for his impeachment if he did that.”

Graham served as a House prosecutor during former President Clinton’s 1998 impeachment trial…

Graham, a member of the Armed Services Committee who face a contested primary next week, said he has added language to the pending defense authorization bill that would require an up-or-down vote in Congress to approve the closure of Guantanamo.

The bill also includes a provision barring the administration from transferring detainees to Yemen, he noted.

Marco Rubio, who stands to lose much more than Graham in two years if Republicans make a play for impeachment and the public turns on them for it, is downplaying the idea. I’ll bet the White House is excited to hear Graham jabbering about it, though: Their new strategy on spinning GOP criticism of the prisoner swap is to treat it, as they treat all criticism, as a “proxy for the hatred toward the president.” That’s fantastically cynical (and characteristic) but it makes sense strategically, as it’ll force lefties to circle the wagons around O for partisan reasons even if they too have misgivings about the deal. The more Republicans rattle their sabers about impeachment, the more liberals can start coughing about “hatred” and “overreach” and “politicization,” yadda yadda. But as I say, Graham’s first order of business is winning his primary. For the next week, at least, his political interests are more important than the party’s.

I’ll say one thing for his impeachment warning, though: At least it focuses people’s attention on the magnitude of awfulness in the Bergdahl prisoner swap. Because it was, in fact, truly awful:

SHEYKHAN, Afghanistan—Taliban forces led by Mohammed Fazl swept through this village on the Shomali plain north of Kabul in 1999 in a scorched-earth offensive that prompted some 300,000 people to flee for their lives…

When the Taliban seized control of this area from their Northern Alliance rivals in 1999, they systematically demolished entire villages, blowing up houses, burning fields and seeding the land with mines, according to two comprehensive studies of war crimes and atrocities during wars in Afghanistan and human rights reports. Mr. Fazl played a major role in the destruction.

“There was not a single undamaged house or garden,” said Masjidi Fatehzada, a shopkeeper in Mir Bacha Kot, the district center. “My entire shop was burned to the ground. There was nothing left.”

He’s wanted by the UN for possible war crimes, as is another member of the Taliban Five, in case you’re wondering just how dangerous Obama’s willing to get in his quest to close Gitmo.

As I write this, news is breaking that Ted Cruz will introduce a bill that’ll halt new releases from Gitmo until after Congress has investigated the Bergdahl swap. That seems like an easy compromise position for a GOP caucus polarized between potential impeachment proceedings and giving Obama carte blanche under Article II a la McCain.

If impeachment is called for, how does Graham defend waiting for the “next time”? He and the rest of congress should resign for not keeping their oath of office.

If Obama deserves a smackdown next time, he deserves one this time.

I call BS.

Impeachment is a waste of time unless you can count on getting 2/3 of the Senate to convict.

So every prosecutor should just quit unless they can guarantee conviction? You do realize the system is designed for the very possibility of someone being impeached but not convicted and expelled?

changer1701 on June 5, 2014 at 12:22 PM

Should have been on the table years ago. The trouble is, especially if all the high crimes and misdemeanors he’s committed, and all the laws he’s ignored or broken are listed, the process would take longer than the time he has left in office to get anywhere. Then he rides out (deflect, deflect) any future scandals, declares himself king sometime before November, 2016. No chance of a winnable revolution after that.

He will never become a king although no doubt he thinks of himself as such. If tried to do that there would be blood in the streets.

IF he releases MORE“…?!

Senator Graham, from one of your constituents, you are the epitome of the spineless, gutless, politicians who lack both the courage and conviction to TO DO YOUR D@MN JOB!
- Not only Obama but YOU, sir, swore an oath to God, to the Founding Fathers who entrusted you with protecting the Constitution and Rule of Law, and the American people. You have betrayed all of them with your cowardice, your lack of both courage and conviction, and your selfish, self-serving greed – the desire to protect your own position, power, and job!

“Wait until NEXT time”?! SERIOUSLY?

President Obama has violated both Constitution from the moment he entered the White House! Sworn to protect the Constitution and enforce EVERY law, his 1st betrayal/violation was declaring IMMEDIATELY after entering office that he disagreed with and would not defend / enforce the ‘Defense of Marriage Act’. This was the start of his ‘Imperial Presidency. 6 years later, when asked why he violated the law that required him to give a 30-day notice before making a swap the way he did, Obama answered, “I never liked that law.” Today, in another press conference, Obama declared about having released the 5 Top Taliban Leaders, BREAKING THE LAW TO DO SO, “I have nothing to apologize FOR.”

Obama tried to get Gitmo closed…Congress prevented him from doing so. Obama tried to make this same swap 3 years ago, proving he knew of and fully understood the law he just broke…congress vetoed / prevented it. Generalissimo Obama, however, decided to once again ignore the Constitution and Laws to get what he wanted. If Congress will not close GITMO, he will simply release all the prisoners. They will not let him release the worst trrorists as Gitmo, he will simply by-pass them again and do so on his own. “I never liked that law…I have nothing to apologize for.”

easyt65 on June 5, 2014 at 12:57 PM

How can you say you might have to impeach the president if he continues to break the law? It seems to me you are obligated to impeach him now.

paulsur on June 5, 2014 at 12:58 PM

Oh for goodness sake …..

Impeachment would be a sideshow. The Democrats in the Senate will not vote to convict. Impeaching will simply give them something to whip their voters up with.

If you want to nail this idiot, you’re going to have to make the incompetence case. You could start with “How is it this guy never knows what the hell is going on in his Administration until it’s in the press?”

The object between now & November is to demoralize his voters at every turn, not incite them.

BD57 on June 5, 2014 at 12:59 PM

If he releases MORE…”

Obama did not just release the average Taliban soldier…he released:
- THE Top 5 Taliban / Terrorists in Gitmo….
- THE Taliban leaders responsible for the complete oppression of women in Afghanistan…
- The 5 men responsible for the near genocide of an entire Afghan tribe…These 5 personally slit the throats of dozens of men/boys in front of their mothers/wives/sisters…
- 5 men on the U.N.’s ‘WANTED’ list for WAR CRIMES.

When he was asked if he realized that these 5 men would be back leading the Taliban in a year, would return as ‘rock stara, and would be killing more Afghan people and American troops, Obama said that YES, HE KNEW that was a great possibility, as it is documented that 1 out of every 3 released from Gitmo go back to waging war / attocities on the battle field.
– The President of the United States just ADMITTED to KNOWINGLY AIDING AND ABETTING OUR ENEMIES / TERRORISTS…that, Senator Graham, is called ‘TREASON‘! He did not just violate the Contitution and the Rule of law AGAIN, sir, he just admitted to TREASON…and he is gloating and mocking YOU and your fellow GOP members about having done it.

I’d love to agree with you, but I feel we’re way outnumbered and our side would back down before their side did.

IF he releases MORE“…?!

This TREASON is not Obama’s 1st! He has a PATTER of doing it:
1) Obama provides thousands of weapons to Mexican Drug Cartels
2) Obama violates the WAR POWERS ACT by refusing to ask Congress for more time to wage war in Libya when his legally allotted time ran out…
3) After 9/11 Bush swore the U.S. would not allow terrorists to have a SAFE HAVEN ANYWHERE in the world…Obama just helped them take over not 1 country for their own but TWO:
- Obama ordered the U.S. military to AID AL QAEDA, perpetrators of 9/11/01, take over Libya. Afterwards they hired an Al Qaeda-associated militia in Libya to protect our Ambassador
- Obama aided the terrorists The Muslim Brotherhood take over the government of our Ally, Egypt
4) Obama ‘protected’ Major Hassan, self-proclaimed ‘Soldier of Allah’ (who threatened to behead a fellow officer if he refused to convert to Islam)and Ft Hood terrorist, by preventing him from appropriately being labeled a ‘terrorist’ by instead labeling his attack as a case of ‘workplace violence’.

And NOW, Senator Graham, he has released the WORST of the Taliban prisoners in our possession, the ‘Taliban Dream Team’ who even Obama admitted will eventually return to the Taliban, will begin oppressing Afghan women again, continuing to murder thousands of Afghans who stand against them, and who WILL kill more Americans!

These act, the blood of American troops in the future, Senator Graham, is already on Obama’s hands. His actions, all listed above, PROVE he is what is described in his/YOUR/military oaths as those of a ‘DOMESTIC threat to the United States’!

His doing all these things…his breaking the law to release these butchers, terrorists, and threats not only to our national security but threats to the ENTIRE WORLD - you are okay with him doing all THIS ONCE?! Senator Graham, Obama has been violating the Constitution and the Rule of Law, endangering our nation / national security (umm…thousands of violent Illegals released in to the U.S. citizen population?) for 6 (SIX) YEARS!

WHEN will Washington politicians – the GOP – ‘grow a pair’ …. ‘grow a spine’? WHEN will you keep your oaths of office? WHEN will you BE the ‘system of Checks and Balances’ you are supposed to be, the system our Founding Fathers created to prevent things like this from happening?!

I don’t remember the oath of office any of them took saying they swear to protect and defend the Constitution and Rule of law…”unless doing so would be really hard due to partisanship….unless you might take a hit in the polls and risk losing your over-paid cushy jobs/position’…

It is not like with Clinton where he attempted to engage in deceit in a coyrtroom to hide the fact that he harrassed a woman & Democrats played the whole thing off as being Impeached for ‘having an affair’. Obama VIOLATED the Constitution….He BROKE the law and then said, in his own defense, ‘I never liked that law’. He perpetrated TREASON aiding and abetting terrorists – enemies of this country…and admitted knowing as much when he released them to the media.

I don’t give a d@mn if he is the nation’s 1st back President. I don’t care if he was black, white, yellow…if he was a Democrat, Republican, Dixiecrat, or political agnostic! This socialist, Isamic-Extremist aiding-and-abetting ‘Dmestic Threat to the U.S. needs to be taken down – IMPEACHED….PERIOD!

Senator Graham, you have allowed Obama to violate the Constitution and the Rule of law from Day 1, for 6 (SIX) Years. Your feigning anger and toughness in front of the cameras by warning Obama that you will do something about his CRIMES the very NEXT time he does it does NOT impress me, make me think you are strong, or give me reason to vote for you. The fact that you have allowed him to do this for 6 years and now, after his crimes/treason in this case, you engage in false bravado by WARNING Obama you will do something…NEXT TIME only shows me you have no courage, have no conviction, that your sworn oath of office means NOTHING, and that you do not love the Constitution/Rule of Law/this nation enough to ‘man up’ and fight for it.

In short, you little tax-sucking, self-serving, cowardly, @$$-ki$$ing, political vampire, There is no way in H#LL I will vote for you, and you need to be violently ejected from Washington, stripped of the priviledge / honor of representing South Carolina!

One thing that has been reported (but is being ignored by the Obama rear-kissing media) is that the Taliban asked FOR MONEY for Bergdahl! Yeah, that’s right – they wanted CASH! Obama rejected that request.

Obama had a better offer that fit in with his F*ed-Up, traiterous agenda. Obama wants Gitmo closed…and was denied. This was the perfect opportunity to startkicking prisoners out of Gitmo. Obama had already tried to make this same deal 3 years ago…and was denied! So, on his own, he broke the law, negated Congress, and gave the Taliban what EVEN THEY THOUGHT THEY WOULD NEVER GET — their top 5 Leaders back!

Yeah, Conservatives wanted Bergdahl back…but not at this cost. 1st of all the U.S. position was that WE DON’T NEGOTIATE WITH TERRORISTS. Obama is the 1st to ever do so, and the drastic amount he gave up set a dangerous precedent. (We have negotiated with recognized countries but never terrorist organiztions.) Conservative would rather have sent SpecOps guys in to TAKE back Bergdahl than give up the 5 worst, U.N. ‘wanted’ War Crimes perpetrator, Taliban Leaders.

It looks like the people of SC support Graham. I honestly don’t know why. Except maybe its stuff coming from his re-election war chest, estimated at more than $12 million.

Here are the sorry polls:

Lindsey Graham 49%
Lee Bright 9%
Richard Cash 3%
Nancy Mace 2%
Det Bowers 1%
Bill Connor 1%
Benjamin Dunn 0%
Undecided/Don’t know 35%

How could there be so many undecideds this late in the race?!? Hey, I’ll take 49% & a runoff. But the estimate also includes that many of the undecided will break for Graham.
