Jonathan Turley: Let’s face it, this Bergdahl prisoner swap is illegal

Via RCP, you already know why it’s illegal but stay tuned anyway for two excellent points that have been overlooked. One: There’s no reason why the White House couldn’t have complied with the statute and notified Congress months or even years ago of its intent to do a deal for Bergdahl involving the Taliban Five if/when the opportunity ever presented itself. The reason they kept mum and did this on the sly, without notifying anyone first, isn’t because they had to “move quickly” or whatever, it’s because they knew that advance notice to Congress would give hawks on both sides of the aisle time to build political pressure against the swap. Obama wants to empty Gitmo and make nice with the Taliban before we abandon Afghanistan to its fate, and complying with the law was an impediment to that. So he broke it. Par for the course, as Turley knows only too well. Two: It’s true that when O signed the “30-day notification” rule into law, he issued a signing statement saying that he regarded that requirement as a violation of separation of powers. When he first ran for president in 2008, though, he and his team used Bush’s habit of issuing signing statements as a paradigm example of executive power run amok. Watch the second clip below, where this guy actually has the balls to say he would never do something like that because he’s taught constitutional law and knows how the Constitution works. That’s the second campaign promise in as many weeks that he’s utterly betrayed.

And, by the way, if you take the Taliban at their word, this little Hopenchange gambit to build goodwill as a preface to broader peace talks is doomed to fail.

Within hours, Taliban spokesman Zabihullah Mujahid shot down Hagel’s optimism for reconciliation.

“It won’t help the peace process in any way, because we don’t believe in the peace process,” Mujahid said.

Instead of portraying the exchange as the beginning of reconciliation, Taliban emir Mullah Mohammed Omar called the release of the five commanders a “great victory” and a “huge and vivid triumph.” The Taliban also published photos of the five released commanders as they arrived in Qatar.

“This huge accomplishment brings the glad tidings of liberation of the whole country and reassures us that our aspirations are on the verge of fulfillment,” Omar said, according to a statement released yesterday at the Taliban website, Voice of Jihad.

Old theory: Obama did this to bring the Taliban to the bargaining table. New theory: Obama did this to get the VA scandal off the front page. Think it’ll work? And even if it does, which scandal hurts him more?

Hekmati has been held by Iran for 1,007 days, initially sentenced to death on a trumped-up charge of “conspiracy to commit espionage” and now serving a 10-year sentence after a quickie closed-door trial for “collaboration” with the U.S. government. Though some on Capitol Hill have championed his case, the family needs the traction of public outrage to put adequate pressure on the powers that be.

Why doesn’t congress pass a bill stating that the issuance of “signing statements” by any president in the future will be considered a “high crime” and will immediately trigger articles of impeachment in the House?

Signing statements should be illegal. If a president feels that a bill presented for his signature is unconstitutional, then he can veto the damn thing. If his veto is overridden, the president can challenge the law in the courts. But simply signing a bill into law, and simultaneously saying “I won’t enforce the parts of this law that I don’t agree with” is bull$hit, and congress should put a stop to it now.

The fact that Obama is a lying conniver who breaks campaign promises doesn’t make it illegal.

Signing statements have not been tested in court, at least not at SCOTUS, to once and for all define their validity and/or limits. And neither will this – neither branch wants a strict definition of limits, for fear it is their branch which will be more constrained in the future.

The alternative is impeachment. Not gonna happen either because we all know Democrats will never convict their first half-black President, and all it would do is rile up Obama’s base.

No. The reason barky and his junta did this on the sly was because Sukarno never had to notify anyone of what he was going to do. Barky grew up dreaming of being the next Sukarno … and so he is. Big friggin surprise. Anyone with a brain knew this was what he was going to do way back in 2008. Of course, anyone with a brain knew that Barky was an inept, incompetent, America-hating retard back in 2008, also, who didn’t have any skills or talents, at all. None. Zero. Zilch. And then there were those of us who were calling for his necessary impeachment from the first day he slimed into office (since he had done so many illegal and un-Constitutional acts on the campaign trail – which extended to foreign nations for foreign persons paid in part by foreing governments – that he made Watergate look like child’s play even before Jan 2009 and his laughable inauguration with the “hope that white will embrace what is right” insanity, and that doesn’t even include the fact that he isn’t eligible for the job, to begin with). But, we scared people … lest they be called “raaaacists!!!” for holding the first black Precedent to near normal standards and laws …

Oh well. America is long dead and buried, now, so this is all academic.

What we know and what we seem to be able to do about it are two different things. I just don’t understand how we have strayed so far and allowed so much. The laws he has broken and the lies he has told and been allowed to get away is mind boggling! Where is the will of the American people to stop our continued march towards authoritarianism? Without the rule of law, we are nothing – that is one of the critical things that makes us different an unique as a nation, that we are a nation of laws. If that is no longer true, then what are we? Makes me want to weep. Sorry for the rant, I’m just so sad that we have gotten to this point.
