Can State Department spring Marine jailed in Mexico?

The only hope for a US Marine who carried loaded weapons across the border on his way to Tijuana may be diplomatic intervention, according to his supporters who want the State Department to take up the case of Sgt. Andrew Tahmooressi. John Kerry is in Mexico City to discuss the crisis in Venezuela with Mexico in hopes of a coordinated response in the Americas to the abuses of the Maduro regime, which gives him an opportunity to raise the Tahmooressi case with his counterparts in Mexico. Given the facts of the case, that may be Tahmooressi’s only chance of avoiding a long prison sentence:

Whether U.S. Marine Sgt. Andrew Tahmooressi spends the next two decades in a Mexican prison or is freed tomorrow for mistakenly crossing the border with loaded guns all rests with an unpredictable legal process that bears little resemblance to the American court system.

Tahmooressi, 25, of Weston, Fla., has been held in two Mexican prisons since being arrested while accidentally crossing into Mexico on March 31 with three weapons in his truck. According to Tahmooressi’s defense attorney Alejandro Osuna, of Tijuana, Mexico, his client is facing federal charges for carrying a weapon intended for exclusive use by the military, carrying a weapon not registered in Mexico and possession of ammunition.

“These are very serious charges in Mexico,” Osuna said.

Tahmooressi alleges that he made a wrong turn while leaving a San Ysidro, Calif., parking lot late on March 31 and was unable to avoid entering Mexico. Once across the border, he tried to turn around immediately. Osuna said his client fully disclosed to the customs agents he had weapons in his truck and that he did not intend to enter Mexico.

Kerry did raise the issue in Mexico, but so far there has been no change in Tahmooressi’s status:

The Obama administration broke its silence Thursday on the case of a U.S. Marine imprisoned in Mexico on gun charges, with a State Department spokeswoman confirming that Secretary of State John Kerry “raised the issue” during meetings this week in Mexico City.

Spokeswoman Jen Psaki also said Sgt. Andrew Tahmooressi has been visited 11 times by U.S. consular officials.

“Obviously this is a case we’ve been concerned about, hence we’ve raised it,” she said, when asked about Tahmooressi by Fox News.

A spokesman for Rep. Duncan Hunter, R-Calif., who has tried to bring national attention to the case, said this is a “good” development but “still not enough.”

“The big question is what are you going to do from here?” spokesman Joe Kasper said. “Kerry bringing it up evidently hasn’t gotten Andrew out of jail.”

The local Fox affiliate in San Diego covered the story earlier in the week. Tahmooressi’s supporters say he ended up at the border by mistake and say that a 911 call vindicates that version of the story:

The problem with this 911 as an argument for Tahmooressi’s total innocence is exactly what the 911 operator points out. The border check through which Tahmooressi passed is hardly a small outpost that one might easily miss on the highway; it’s a huge international border station, with lots of signage describing it and what one cannot take across the border, especially loaded guns. One does not just accidentally pass through its gates on the way to Tijuana. That doesn’t mean that Tahmooressi meant to cause trouble with the guns in question, but that doesn’t relieve him of responsibility for his own actions, either — especially in Mexico, where as the Fox News reporter points out, the criminal standards are a lot different than in the US.

The State Department should keep pressing to get Tahmooressi out of Mexico, of course, and hopefully Kerry will exert enough pressure and/or offer enough concessions to do so. However, that’s going to be a tough sell in Mexico. Texas executed a Mexican national a couple of years ago despite their full-court press to get him back, and of course the Obama administration infamously ran thousands of illegal weapons into Mexico without alerting the government or having any way to track where they went. Don’t expect the Mexican national government to have much sympathy over American pleas on behalf of Tahmooressi after that.

He is an active service member of the USMC. Mexico is now holding an acting US soldier in custody. I’m aware a country has the right to enforce its laws, but a Mexican soldier caught in the U.S. armed would probably fall under the laws of Geneva – and the U.S. would likely turn over the solder to Mexico to face a military court in Mexico.

Does Mexico wish to hold a U.S. soldier as a P.O.W.? Or would it be better to turn him over to the U.S.M.C. and let the military courts deal with it?

I can’t imagine why the Mexican government would be touchy about Americans transporting guns across the border, or unwilling to bow to pressure aimed at circumventing their normal legal process in such cases.

If Obama really wanted to help this Marine, I’m guessing the Mexican government would be a lot more flexible if he offered the truth about Fast and Furious in exchange.

Before you post, you should at least be somewhat familiar with what you are posting about.

For 5 years, I drove to TJ from the U.S. twice a week to visit customers.

The barricades, especially in the past couple of years, are designed to lead you through, unless you are very familiar, it would be easy to find yourself in Mexico, or at least at the checkpoint which there is no return.

You basically have one chance to weave between barriers to get out of line. If they are set up correctly…sometimes they are moved haphazardly.

Ed, that is a total injustice to make those kind of statements.

I had been caught several times in the wrong lane and was pulled over by the police for being in the wrong lane, but it is confusing…it’s Mexico by the way, not L.A…

As others have noted, Greta van Susteren has shown just how easy it is to make a mistake and wind up in Mexico. Basically, make one wrong turn and then there is no way to turn back. I don’t know what signage Ed is talking about, unless it is after the point where that wrong turn can be made, or not obviously related to it. As Greta clearly showed, the signage up to that point is confusing, to say the least.

I’ve been saying forever now that we need to take over Central America. The Mexico border is not geographically/strategically defensible. (Much like the Israel – Egypt border. Israel must take back the Sinai Peninsula.) We need to take everything down to Panama. There’s plenty of space in Latin America for Central America’s current inhabitants. This is the only workable plan.

I don’t know. Perhaps. I suspect Fox has taken this up as a pet project. I know O’Reilly did his usual chest pounding a few months ago about another military guy who got thrown in the slammer down there. It was just a few days after BOR started recomending to his viewers that they spend their tourist dollars elsewhere and the guy was released. John Bolton made the same point on Greta last night. I think the guy will be released. The pain/reward ratio isn’t favorable to the Mexicans on this one.

Greta Van Susteren did a long piece on this the other night. You ought to see if that has been posted online. She points out how easy it is to make an honest mistake, realize it too late, and not be able to cross 4 lanes of Mexico-bound traffic to get into the single lane exit. And BTW, what do you imagine he was attempting? If this is not accidental, as you claim, what do you think he was doing? Gun-running? If so, why confess? I believe this this is more innocent than you claim, and the path to justice is glaringly obvious.

One phone call from the President to the State Department suggesting interdiction of funds being sent by wire to Mexico, another call to Western Union telling them that they will not be able to transfer any US funds to Mexico, and our soldier will be back on US soil so fast Hillary’s head would spin.

Mexico’s biggest single source of revenue, larger than oil dollars or tourism dollars is the money sent home via the humble giro postal.

Factually incorrect. He completed his active duty requirement and go out of the service. He is a member by contract of the inactive Reserve.

If Obama picked up the phone and told Mexico that either he is released immediately or the Unites Staes will begin rigorously enforcing its own border laws, including incarcerating every single illegal found, he’d be home tonight.

No Mexico tourism.

No WU wire fund transfers.

No money “sent home” by illegals here. (Simpler to stop than you might think, either by web or snail mail.)

And call their president up and say,

“If that young man and his personal property are not back across our border, with all charges dropped, within 24 hours, you can forget about U.S. government aid, financial, law enforcement, or otherwise, indefinitely.”

Most people don’t realize what a large proportion of the Mexican government budget U.S. aid makes up. Or how many high officials are skimming that aid to feather their own nests.

I’m in favor of cutting off their tap on that latter count alone, but using the threat of same to make holding him more of an expense than a PR victory should make them think twice.

As a great-uncle of mine who was a Texas Ranger once said,

The problem with this 911 as an argument for Tahmooressi’s total innocence is exactly what the 911 operator points out. The border check through which Tahmooressi passed is hardly a small outpost that one might easily miss on the highway; it’s a huge international border station, with lots of signage describing it and what one cannot take across the border, especially loaded guns. One does not just accidentally pass through its gates on the way to Tijuana.

This is just BS. Anyone who makes this statement, including those blogging & posting on this site, do not know what they are talking about. I live in El Paso, Texas and have almost gone to Mexico several times by accident, and prior to 9/11 (thank God it was not after), I actually did go the wrong way and end up at the border where some nice Mexican Border officials let me U turn. My daughter has done the same thing. Our Border crossings are also “huge, international stations”, and that completely misses the point. Once you get there, it is a one way highway into Mexico, signage is all over the place, so it’s hard to comprehend. You can simply get off at the wrong spur, because there are 2 or 3 in the same area, and like any freeway, you cannot get off until you are at the destination, which in this case is the international bridge, that goes ONE WAY, FORWARD.

I know MANY people who have done what I did, and believe me it is not that uncommon. The difference between us and Tahmooressi; we are not military men with guns in our cars. The Mexican government and military hate our military, and do not hide it. I would not be surprised if they are just holding him because they know that they can. This is not Tahmooressi’s fault, the whole situation is just confusing. So those of you bloviating about how he should have known better, again, just have no idea what you are talking about.

He is under treatment for PTSD according to his mother. It also could have looked like he was living in his car. You don’t know what he said and how he said it when he was at the border.

Once again Obama is gonna abandon an American in trouble. He seems to do that a lot.

And Ed, Greta did a special about this and the signs on the border are far from clear. They have one lane there to do a u turn back to america. One lane out of many lanes. If you don’t go in that lane well then you are screwed and have to go to Mexico. Also the sign showing that lane was a small white sign. I believe he was driving at night. Yeah don’t blame hi for going into Mexican terroritory. Blame Mexico!

One does not accidentally hire a coyote to take you to Phoenix nor does one accidentally commit identity theft so that one can work in this country illegally either, yet we’re supposed to allow Mexico to write our immigration laws and not only forgive but also reward 20 million illegals while Mexico threatens to jail one illegal American for 20 years.
