Harry Reid on the Bundy ranch standoff: This ain’t over

For once he’s right. John Hinderaker, who’s sympathetic to Bundy, nonetheless acknowledges that he doesn’t have a leg to stand on legally. Bundy’s theory, that land universally recognized for the past 150 years as belonging to the federal government really belongs to Nevada because it was never properly conveyed to the U.S., is DOA in court. He’ll lose his appeals and then, presumably, he’ll go on refusing to pay grazing fees to use the land. What should the feds do then? Given the publicity the case has drawn and the fact that the judiciary’s on his side, Obama can’t look the other way at Bundy’s continued defiance of the law. He’s happy to do that abroad with bad actors like Putin and Assad because Ukraine and Syria aren’t part of his jurisdiction. (Although fans of the world-policeman theory of foreign policy might disagree.) He can duck those messes, sort of. He can’t duck the one in Nevada, if only because letting Bundy off the hook there is bound to inspire copycat defiance elsewhere. So Reid’s right. This isn’t over.

My question is, how should the feds proceed once Bundy’s appeals are exhausted? What could they do to enforce the court’s order that won’t be treated as some sort of provocation by Bundy supporters? Seize his cattle that are on federal land? Let the cattle graze there but seize some of his assets to make him pay the grazing fee? (If they went the latter route, ranchers would then have a liability right to use federal land for their own purposes, which would interfere with the government’s plans for land use.) Watch the second clip below and you’ll find Glenn Beck taken aback by the violent rhetoric among some Bundy supporters, a portion of whom he thinks are clearly spoiling for a fight. Then watch the first clip, where one supporter is interviewed, and you’ll see why. (Another supporter, a former sheriff, spitballed on Fox News yesterday about placing women at the front of the protest crowd to maximize the PR damage to the feds in case shooting breaks out.) Remember, Bundy doesn’t recognize federal jurisdiction over the land at all; any interference with his cattle by the BLM, no matter how light a touch is used, will presumably be regarded by him and his fans as illegal and therefore worthy of resistance.

Maybe, since Bundy recognizes Nevada’s authority over the land, the feds could ask Nevada authorities to remove the cattle? Not sure the local cops would be up for that, though, partly because of the politics involved in siding with the feds against a native rancher and partly because it sets a precedent of doing the feds’ dirty work for them anytime someone raises an objection to federal authority. Besides, would that really appease Bundy? If the county commissioner shows up and tells him that it really is federal land, according to the government of Nevada, would that do it or would Bundy go on believing his own theory?

I’d also point out that efforts to educate those voters who repeatedly elect those careerists who seek only to service their own ravening ambitions, and have amply demonstrated that they are more than willing to diminish the rule of law, have failed miserably.

Partisanship and grievance mongering combined with a hefty does of self interest suffice to get much of the electorate to the polls, rather than a candidate’s demonstration of dedication to the rule of law, desire to genuinely serve the interests of the nation, clarity in their understanding and formulation of substantive policy on issues, both foreign and domestic, and previous record and qualifications to hold office.

Until people are willing to step away from the pizza, the television, bowling, and beer, etc., and pay attention, they’ll continue to vote based on grievance, self interest, cult of personality and sound bite. It’s easier.

Those of you who think this is a legal done deal – and that Bundy doesn’t have a legal leg to stand on – are pointing to the agreement that was made when Nevada became a state in 1864. The problem is, the southern tip of Nevada, where Clark County is and where Bundy’s ranch is, was not part of Nevada when that agreement was made. It was part of the Arizona Territory.

The land in question was absorbed by Nevada in 1866.

I think it’s far from legally settled. From the Nevada wiki:

Nevada achieved its current southern boundaries on May 5, 1866, when it absorbed the portion of Pah-Ute County in the Arizona Territory west of the Colorado River, essentially all of present day Nevada south of the 37th parallel.

The transfer was prompted by the discovery of gold in the area, and it was thought by officials that Nevada would be better able to oversee the expected population boom. This area includes most of what is now Clark County.

Additionally, if the feds think they historically own this land, why would they use the desert tortoise as an excuse to assert jurisdiction over it?

The Bundy ranch was the last area to be taken now that 52 ranchers were driven out with the fees and regulations of the BLM. The area is loaded with oil.

Hinderaker’s reporting is devastating.

30 miles away the concern over the desert tortoise is mostly ignored to build solar power plants. Because they’ll be moving the toitoises to areas like where the Bundy’s live and work.

This isn’t rule of law – this is political imperial favoratism and capricious application of the law.

This is the Kelo decision all over again — confiscate private property traditional use for cattle grazing so they can move the tortoises from another section of desert for use by a different private entity (solar power company).

Note that in Kelo, the supposed new landlord abandoned ship and never built the new project!! The evicted citizens had their property stolen and the new owners backed out on the deal — result, vacant land, earning little or no public tax revenue — the stated intention to begin with!!!!!

At what point should a law be disregarded? When do people get to say “No, I don’t think so.” According to the Five guys, the law must be changed. Win at the ballot box. I would point out that we as citizens are supposed to play a game in which the federal government participates, is a referee and makes the rules. How do you beat that?

When the law says we must buy a federal product or face fees and fines, can we say no? When the law says people who are deemed undesirable for whatever reason, must be “quarantined” and re-educated for the good of society, can we say no? I would love to know what gives the federal government the right to control and own whatever land it pleases? They only have as much power as we are willing to give them.

I hate the federal government more and more everyday.

We cannot be a nation of laws unless we have a government of laws. We cannot have respect for the law if the legitimacy of the law is questioned by even a significant minority of the people. Barack Obama and a bureaucracy dominated by Democrat partisans and eco-leftist authoritarians are rapidly destroying respect for the government’s authority by making it appear to be an illegitimate tool of the powerful and their personal and political agendas. I’m no lawyer (thank God!!!!!!!!!!!!!!) but a few salient points.

1 I believe that federal land on state property is MANAGED by the Feds but actually OWNED by the state-in this case Nevada.
2 Anything is ultimately legal that five SC Justices affirm is so. Therefore if 5 SC Justices say an ‘orange’ is as ‘avocado’, legally it’s an ‘avocado’.
3 I understand that Harry Reid’s attorney son is due to profit from the sale of nearby (To Bundy’s grazing area) federal land by Clarke County to Chinese investors–therefore there is a direct economic issue (conflict of interest?) attached to Reid and his son.
4 The Feds reason for managing the land is based on the false premise that it was to protect a “rare” tortoise–an animal so numerous that the Feds have to kill 1000 of the creatures each year to maintain a balance.

Reasons l , 3 and 4 would seem to favor Bundy but because four (or possibly five) SC Justices are already labeling ‘oranges’”avocados”, Reid will probably win one for sonny boy.

I don’t recall if the first guy gives his name but he’s intimately involved, and the second guy is Brand Bundy.

It’s about a half hour report from the ranch describing how the twenty or so BLM on the scene were sacrificial lambs awaiting the bullets of over 500 militia. Sheriff Gillespie told the Bundy’s they could get their cows back then reneged in an apparent effort to provoke violence.

There was SWAT and an MRAP waiting at the next exit down the highway for something to happen, which of course didn’t, thanks be to God.

Gillespie is tied to the SPLC and the DHS.

It’s 30 minutes long and worth watching if only for the historical value. If this has been posted on HA before on this or another thread, so much the better.

I saw this video earlier today, and was struck by how genuine the two men seemed to be. My gut says that believing them (over the BLM or Reid, for example) is not even a close call.

Much of the 30 minute video is repetitious, but if you can just watch the first ten, or even 5 minutes, I think you will sense that these men are not liars or terrorists (which they will surely soon be portrayed as).

What happened to the victims? You can find out if you’re really interested. All you need to do is to associate their names with their causes of death, ages, and sexes which should be easily copied from the final report, and pasted in here somewhere. Not the FBI report, that’s top secret. So get a copy of the final report and make the associations I mentioned. Even a dolt like you ought to be able to accomplish that.

If you want a another project, tell me, why was Lily Gaubert’s photo used as that of one of the victims? Which victim was her photo substituted for? Do you know? Of course not. Now scurry out and find out what I’m talking about. Go. Shoo.

Where is the footage of any bodies being removed from the school?

Where is the footage of the 500+ students who had left the school?

Where did the school nurse got the info that Mrs. Lanza was a teacher at the school, as reported by Andrea McCarren?

Who donated the 26 Christmas trees that were decorated in front of the firehouse the next day – after being stored behind the firehouse before the event, clearly visible in aerial footage?

Who were the officials that Pete Williams reported told him Lanza got into an altercation with school employees Dec. 13? Was a police report filed? What did Lt. Vance say about this charge?

Why did both Lanza and his mother’s death date appear on the Social Security Death Index as occurring on Dec. 13?

Why did CNN report that footage of police running into St. Rose of Lima school was filmed at Sandy Hook?

A woman supposedly wounded at the school, in the only footage of a victim, was shown on a stretcher being placed into an ambo wearing different jackets. Others milling about the area are shown having changed clothes, including earrings. Why?

Many people have white ID badges on lanyards, including a nun. What do these white badges signify? Do they have anything to do with DHS drill protocols?

Was there a DHS drill in the area that morning?

How many homes were gifted to locals on 12/25/09?

How much money was sent to Newtown residents and local govt by federal and private sources after the event?

How many FB pages were set up as memorials to victims before the event? How many fundraising sites went up prior to the event?

How much alimony was Mr. Lanza slated to pay Mrs. Lanza the next five years?

Was Adam found to be in possession of his brother Ryan’s drivers license? How long had it been, according to Ryan, since he’d seen Adam?

Answer those questions, or go walk east till your hat floats.

My thoughts on any of that, including Levin’s ‘conference of the states’ is something along the lines of, “that’s wonderful, legal, and constitutional – and what on earth makes anyone think the Congress, President, SC, bureaucracy, etc will observe *that* given their wanton disregard for everything else that is also constitutional?”

1 I believe that federal land on state property is MANAGED by the Feds but actually OWNED by the state-in this case Nevada.
2 Anything is ultimately legal that five SC Justices affirm is so. Therefore if 5 SC Justices say an ‘orange’ is as ‘avocado’, legally it’s an ‘avocado’.
3 I understand that Harry Reid’s attorney son is due to profit from the sale of nearby (To Bundy’s grazing area) federal land by Clarke County to Chinese investors–therefore there is a direct economic issue (conflict of interest?) attached to Reid and his son.
4 The Feds reason for managing the land is based on the false premise that it was to protect a “rare” tortoise–an animal so numerous that the Feds have to kill 1000 of the creatures each year to maintain a balance.

What happened to the victims? You can find out if you’re really interested. All you need to do is to associate their names with their causes of death, ages, and sexes which should be easily copied from the final report, and pasted in here somewhere. Not the FBI report, that’s top secret. So get a copy of the final report and make the associations I mentioned. Even a dolt like you ought to be able to accomplish that.

If you want a another project, tell me, why was Lily Gaubert’s photo used as that of one of the victims? Which victim was her photo substituted for? Do you know? Of course not. Now scurry out and find out what I’m talking about. Go. Shoo.

Where is the footage of any bodies being removed from the school?

Where is the footage of the 500+ students who had left the school?

Where did the school nurse got the info that Mrs. Lanza was a teacher at the school, as reported by Andrea McCarren?

Who donated the 26 Christmas trees that were decorated in front of the firehouse the next day – after being stored behind the firehouse before the event, clearly visible in aerial footage?

Who were the officials that Pete Williams reported told him Lanza got into an altercation with school employees Dec. 13? Was a police report filed? What did Lt. Vance say about this charge?

Why did both Lanza and his mother’s death date appear on the Social Security Death Index as occurring on Dec. 13?

Why did CNN report that footage of police running into St. Rose of Lima school was filmed at Sandy Hook?

A woman supposedly wounded at the school, in the only footage of a victim, was shown on a stretcher being placed into an ambo wearing different jackets. Others milling about the area are shown having changed clothes, including earrings. Why?

Many people have white ID badges on lanyards, including a nun. What do these white badges signify? Do they have anything to do with DHS drill protocols?

Was there a DHS drill in the area that morning?

How many homes were gifted to locals on 12/25/09?

How much money was sent to Newtown residents and local govt by federal and private sources after the event?

How many FB pages were set up as memorials to victims before the event? How many fundraising sites went up prior to the event?

How much alimony was Mr. Lanza slated to pay Mrs. Lanza the next five years?

Was Adam found to be in possession of his brother Ryan’s drivers license? How long had it been, according to Ryan, since he’d seen Adam?

An important fact is that Bundy stopped paying his grazing fees to the Feds when they put restrictions on his cattle grazing due to the protection of the desert tortoise. Why all of a sudden is the desert tortoise in danger from grazing cattle? This is the part that makes me suspicious, but if they want to resolve this, then remove that restriction and penalties, and Bundy has to start paying grazing fees again. We know it won’t happen. It is too much of a coincidence that Harry Reid, his son and his son-in-law are involved in business dealings regarding this land.
