Trey Gowdy on Obama’s power grabs: “How does going from being a senator to a president re-write the Constitution?”

posted at 11:21 am on March 13, 2014 by Allahpundit

Via the Blaze, a postscript to the White House’s threat to veto Gowdy’s bill demanding faithful enforcement of laws like ObamaCare, warts and all. Simple question from Gowdy, who came armed with quotes from the golden days of Hopenchange: Would Senator Obama have supported the bill? The answer is even simpler: It depends on whether doing so would have helped him electorally or not. That’s the only real consideration, and remains the only real consideration to this day. As a fledgling presidential candidate up against the Clinton machine, O knew he had an opening on the left among liberals who were suspicious of the Clintons’ centrist credentials. He figured he could build a base there by telling them what they wanted to hear, so he did — George Bush was an executive run amok whose signing statements were an affront to the Constitution. They liked the sound of that, just as they liked what he had to say about the perils of drone warfare and the surveillance state. Ahem. Six years later, Democrats don’t care much about executive power grabs in defense of their party’s agenda, so neither does O. That’s my one criticism of Gowdy, Jonathan Turley, and nearly everyone else who’s been hammering him lately for endangering separation of powers. It should be noted more often that he’s responding to the political incentives set for him by others.

Gowdy’s bill passed the House yesterday, by the way, as did another Republican bill demanding stricter enforcement. Five Democrats voted for the former and just two for the latter. The only one in both groups was Nick Rahall, whose home state of West Virginia is increasingly red, whose last two House elections have been much closer than they used to be, and who’s even taken lately to describing himself as more of a Bush supporter than an Obama fan. Good luck in November, buddy.

The purely political agenda of the Democrats is sickening. Everything is dependent on which way the wind is blowing at any given moment in time.

At some point, MASSIVE civil disobedience is going to be necessary. In many ways this has already started. People in Connecticut are refusing to register their rifles. People nationwide are refusing to comply with the Obamacare mandate.

ConstantineXI on March 13, 2014 at 11:31 AM

I’m anxious to see how Reid plays this in the Senate. If he rigs it so there is no vote, the Republicans can go after the Democrats for supporting Reid and Obama so blindly they no longer care about the Constitution. If Reid brings it up, with the design to defeat it, the Democrats will be on record supporting Obama’s unconstitutional acts. Either way, they’re supporting Obama and his unconstitutional acts, unless of course they vote for it, in which case Obama will veto it and then we’ll see if they can over-ride it. It would probably be another case of I voted for it before I voted against it, but then again, they’re Democrats.

hillsoftx on March 13, 2014 at 11:26 AM

Gowdy did address that in the clip. He said that the House has the power of the purse strings and impeachment, but that both are just punishments and he’s right. Impeachment wouldn’t actually lead to anything since it’s D.O.A. in the Senate(that’ll be true even a year from under GOP control). So honestly I don’t know what will stop Obama’s p-ssing all over the Constitution until there are serious electoral repurcussions for his actions. Unless we see this becoming the kind of issue that actually costs Democrats their seats in the House and Senate(and possibly the White House in 2016), why would Obama ever reverse course?

Hell, the Dems getting slaughtered this November may actually embolden Obama to be even more dismissive of Congress and the rule of law since he’s a lameduck and a man who’s never shown any willingness to negotiate with the opposition.

The problem is that all the GOP can do is bring attention to PBHO’s lawlessness. They are in no position to pursue the only Constitutional remedy and it would only damage their chances in a few months to try.

I appreciate that Gowdy emphasizes this in any way he can, regardless of the politics of it. Obama’s taking upon himself the power to rewrite legislation, and establishing largely unopposed precedent for that, is the single worst thing that Obama has done during his misbegotten tenure in office. In the long term, much worse than getting the monstrosity enacted in the first place.

ConstantineXI on March 13, 2014 at 11:31 AM

What’s even more interesting is that many people who were four-square in favor of ACA/O-Care can’t comply with it, because neither they or the people in charge of same can figure out how in the Hell it works. If, indeed, it can be made to work at all, other than as a “symbolic” thing or just a means of terrorizing the American people into handing the government more of their money as payments taxes fines fees just what are they calling them today, anyway?

The refuseniks are people who probably weren’t on The One’s side to begin with. The frustrated would-be compliers are people who supported him and are now finding out that their Messiah is really a cross between Yosemite Sam and Captain Peter Peachfuzz. Granted, with the mentality and impulse control of the Tasmanian Devil.

The Dems may look back on this in the future as the moment when they “lost” an entire generation of voters.

Well, nobody else made them do it. It was their idea.

They own it.

That might be a successful strategery for the midterms, but it’ll do nothing to stop Obama’s lawlessness. And remember, the Congressional Dems love his Constitutional violations. Hmm, obviously because in her case, incompetence is a virtue, and she keeps her district solidly for her party. Redistributed free stuff to LIVs and no doubt taxpayer money flowing to less than reputable cronies in her district aid in keeping her in office. Also, incompetence is no disqualifier in running for and keeping public office, otherwise more than half of politicians would be seeking employment elsewhere.

Yes. It took a decade for Dems to recover from “the San Francisco Democrats.” Ambassador Jeane Kirkpatrick, in her 1984 GOP Convention speech, must have belled those cats with that one at least a half dozen times:

When the San Francisco Democrats treat foreign affairs as an afterthought, as they did, they behaved less like a dove or a hawk than like an ostrich – convinced it would shut out the world by hiding its head in the sand.

(Remarkable how relevant that speech is today.) Yes, “The Party of Obama.” “The Obama Democrats.”

The President doesn’t take the position that he’s above the law.
Gowdy opines that Obama has broken the law. I’ll assume you share that opinion. Obama takes this position that he has broken no law and has acted with the constitutional authority granted to him by virtue of winning the presidential election.
That victory is most annoying to Gowdy – because it means that Obama is in a position to do some of the things he said he wanted to do.
Gowdy has accepted the role (assignment, I would assume) of trying to give credence to the idea that all of Obama’s ideas, policies, appointees, executive orders, White House renovations, and basketball games are ‘UNCONSTITUTIONAL!’
He’d have an ounce of cred here if he had any focus.
But as it’s clear as to what he really objects to, this all just noise.

MJBrutus on March 13, 2014 at 1:26 PM

The President doesn’t take the position that he’s above the law.

verbaluce on March 13, 2014 at 1:23 PM

He says he isn’t, but his actions say otherwise. Over and over and over again.

has acted with the constitutional authority granted to him by virtue of winning the presidential election

There would be the problem. Obama thinks he has the authority because he won the election. Not because he is in a constitutional office with limited duties and responsibilities.

GWB on March 13, 2014 at 1:28 PM

Obama takes this position that he has broken no law

Obama? YES

(I would explain but I’m afraid that I would only confuse you with all those words)

Awww.. Getting right into the childish invective I see – typical

Why should anyone have to follow the rule of law if the Preezy doesn’t have to?

PBHO should, but as he has shown, he does not have to. We all should.

MJBrutus on March 13, 2014 at 1:11 PM

So, bottom line: The rule of law is no more.

So we the people could just have a voice vote to remove him to the nearest federal pen, right?

DinaRehn on March 13, 2014 at 1:28 PM

With Whom would it be more important to abide the law – the President or US lowly citizens?

Either that or win enough elections to have him impeached and convicted. That is the only remedy that the law provides.

This how those on the national socialist left typically rationalize tyranny.

It’s all good as long as their side holds the reins of power.

It’s Okay if the ObamaStasi runs roughshod over the 4th amendment.

It’s Okay if Obama’s IRS oppresses Barack Hussein’s political enemies.

Once again history is repeating itself.

Now there you go contradicting yourself – in one instance you say that some are above the law and thus there is no rule of law.

And then you go an invoke the rule of law…..

Which ways is it?

In my very first answer to you I let you know that that reply was a purely practical conclusion. You cried about it. I won’t bother to try again.

What do you think Obama will do in response to a SCOTUS ruling on the NLRB case?
Do you think he will or will not abide by their decision?

Hmm.
As is often shouted here, we are a Republic…not a Democracy.

Please resolve yoru abject contradiction for everyone.

BTW, you can dispense with wasting your time hurling petty insults my way – they have no effect on me.

I see them as a great way of indicating that you are losing the argument, so by all means keep it up.

Bit don’t expect it to do you any good – many of your comrades have discovered this for themselves to their chagrin.

It’s a Two-way street.
