Video: Lois Lerner takes the Fifth again as Issa cuts off Cummings’s mic

Via the Daily Caller, the exciting — I mean it! — conclusion to this weekend’s mystery about whether Lerner was thinking of testifying after all. Answer: Nope. She refused again, which I guess settles the question of whether she inadvertently waived her Fifth Amendment privilege last year by delivering an opening statement before Issa’s committee before suddenly clamming up. At the time, Issa thought that statement constituted a waiver; so did Alan Dershowitz. Maybe the committee decided it wasn’t worth their time litigating the issue. Riddle me this, though: Why don’t they just agree to grant her immunity for her testimony? Her lawyer’s asked for it before, and her testimony’s certainly more valuable than seeing her go to prison, especially given the ignominy she’s already suffered for her role in the IRS scandal. Maybe Issa and the GOP are worried that conservatives will be angry with them if they let Lerner walk. That’s a small price to pay, though, if she has incriminating info on others up the chain.

Instead, he chose to punish Cummings by ending the hearing in frustration before the guy had a chance to ask his question. Cue the excitement.

Update: Issa on why he cut Cummings’s mic: “He was actually slandering me at the moment that the mics did go off by claiming that this had not been a real investigation.”

Since there is a good likely hood this will end up in court, what would she have to gain by speaking? I am thinking Barry Bonds or Scooter Libby. I know it is frustrating as we all want the truth, but there is a process. Had a personal incident and I refused to give a statement to law enforcement. Yep, I was 100% innocent and proven so, but the system is not your friend and you must watch what you say to multiple sources. Just life in our legal system. Sad note……it ain’t about the truth some of the time.

I completely agree with you on point, NEVER talk to a cop. EVER. Never volunteer anything. They aren’t there to serve justice, they are there to make an arrest.

In the case of Lerner though, she did something you and I could NOT do, give a statement in one’s own defense in sworn testimony, and THEN assert the 5th Amendment. You can’t do that. Once you give testimony you have to submit to cross examination. By giving that statement she forfeited any 5th Amendment claim.

It is a privileged motion– which means it becomes first order of business for the chamber– and if it passes, Boehner could then order the Sergeant-at-Arms to drag Lerner onto the floor to answer the contempt charges, and then– and only then– the House could order her thrown in the House pokey and held until the end of the Congressional session. Which might start her talking or turn her into a cause célèbre and make the GOP look like a bunch of meanies.

Which way do think Boehner thinks the media would play it?

Issa gave Lerner a chance to show some cooperation. She chose not to, Cummings went nuts, so he closed shop.

I have a feeling Issa was going to kill the meeting after Cummings made whatever statement he wanted. I don’t think he expected the melodrama, but that serves Issa better because it guarantees airtime.

If Cummings didn’t erupt, Lerner’s coverage would be a minute clip on Special Report, Greta and some CNN. Now, it hits BOR, MSNBC and whatnot and keeps people aware this was never resolved.

If you paid attention to others on that committee this week, I think there is more going on. As much as I think Issa has been too slow, and to accommodating, and too weak, I think they have more than they are letting on.

I can’t imagine a single reason why Lerner would make up a death threat. And I can’t imagine a single reason but one as to why her life would be threatened.

Issa’s committee can’t throw her in jail. Only the House can. The sole purpose of today’s hearing may have been to establish that Lerner, having been advised that it is the opinion of the committee that she cannot plead the Fifth, is now in contempt of the committee.

The committee must report a resolution of contempt to the House. The House has to take it up, because it is a privileged motion, and if the resolution passes, the House has two options:

1) hand the contempt charge over to the judiciary (which is what they did in Holder’s case, c.f. “swift justice”); or

2) Boehner can order the Sergeant-at-Arms to drag Lerner into the chamber to face the contempt charges. If she’s found guilty by the House, they can throw her in their own little pokey until the end of the Congressional Session.

Obviously, there are a lot of political and fact-finding considerations (do we really want to know who the IRS and Administration higher-ups who were involved in this are?) before taking any of these actions.

Boehner’s considerations will be strictly political.

I see suspicions’ about both parties perhaps in collusion in degrading the TEA Party and their philosophy’s. This is very troubling if there is any truth in this.
As for Lerner she is a government employee and taking the 5th in answering any questions regarding her behavior as an employee of said government should be grounds to suspend her immediately without pay, benefits and pension until she truthfully answers questions about her job performance.
She should be given the option of answering to the committee or to a Special Prosecutor (similar to a Grand Jury) and if there is any hesitation on her part she gets 30 days in the hole.

Here is what Lerner did, in effect, and this is why she can’t refuse to give testimony:

What Lerner did, by giving her statement to Congress, then refusing to answer questions, asserting the 5th Amendment was like a DEFENDANT in a criminal case taking the stand, making a statement as to his innocence, THEN REFUSING TO BE CROSS EXAMINED BY THE PROSECUTION.

Another scenario: What if a State’s Witness against you took the stand, made a statement as to your GUILT, and then asserted the 5th Amendment, denying your counsel (and by extension, YOU) the right to cross examine? Again, this is what Lerner did here.

He’s more than just a loose cannon. You can easily add blowhard, thug, racist, and far-left ideologue to the list as well.

In December 2010, with the Democrats losing control of the House in January 2011, then Speaker Pelosi worked within the Democrat caucus to advance Cummings over more senior Democrats to be the ranking member of the Oversight Committee. The reason? Simply, Pelosi wanted someone who would be very aggressive and loyal to counter and impede Issa as much as possible.

With the exposure of the IRS scandal, Cummings has been working extremely hard to undermine and disrupt the investigation the House has been trying to run. That’s included releasing confidential information and transcripts and announcing ‘the case is solved’ in an effort to prematurely end the investigation.

If Lerner gets immunity, she will then be able to take all responsibility for everything and say that nobody up the chain had anything to do with the illegal activities at the IRS. Basically, everybody gets immunity if Lerner gets immunity.

I think he is saying that unlike Issa, Dewhurst (TX Lt. Gov) allowed the Wendy Davis filibuster to go on until the end of the session (with a screaming pro-abortion mob in attendance), which meant a special session had to be called to vote on the abortion bill, and more screaming mobs, national attention etc. If Dewhurst had clamped down on Davis like Issa did with Cunningham, Dewhurst might have won his primary yesterday (it’s gone to a runoff which Dan Patrick is probably going to win).

I don’t necessarily endorse this view – I think cutting Davis off would have given too much ammo to the pro-aborts – just interpreting the comment.

No, Lerner is not going to get immunity from the Oversight Committee.

Rep. Trey Gowdy explains it clearly in comments he made last Friday…

Gowdy was also adamant Lerner would not be exempted from prosecution for her role in the scandal.

“We’re never giving her immunity,” he said, emphatically. “We’re not giving her immunity. Period. Why would you give someone immunity when you have no idea what criminal conduct they’ve engaged in?”

According to Gowdy, Lerner’s lawyer needs to “do what he should have done months ago” and provide House investigators with a document indicating what she would say if she were compelled to testify. That document couldn’t be used against her legally – or in the court of opinion – but would enable investigators to determine what concessions they would be willing to offer in exchange for her testimony.

Gowdy said Lerner’s desire for immunity strongly suggested “she’s guilty” – and added that he prefers to approach her as a “defendant” rather than a witness.

Daily Caller reporting that Issa said the Committee will consider holding Lerner in Contempt of Congress for her taking the 5th earlier today.

Rep. Cummings expected to throw another tantrum.

Exactly as it’s supposed to proceed. If Issa’s committee reports a resolution of contempt to the House, Boehner has no choice but to bring it to the floor (as a privileged motion) and the House will vote to find Lerner in contempt or not. The next step is the interesting one: do they the refer the contempt charge to a judge for eventual trial (as in Holder’s case, wake me up when that happens), or does Boehner bring Lerner to the floor of the House to answer the charges and be tried by the House? That would make for an interesting spectacle.

I agree completely, but the GOPe hatred for Conservatives and the Tea Party will trump that.

The GOP in its entirety could have been reaching out and making strides to connect with the Tea Party since 2010. They could have forged a great relationship that would have not only won the 2012 Presidential election, but would be a great foundation to build on for the future.

They instead chose to call them names, ridicule them, stab them in the back and declare war on them. Really? Seriously what kind of people are “leading” the GOP right now, and why aren’t they being driven out of power by everyone that actually wants to win?

The second article of impeachment against Nixon and passed by the House Judiciary Committee was all about the abuses of power by Nixon and his Administration around the IRS, FBI, DoJ, Secret Service, and the CIA.

Lois Lerner will never testify that Obama directed her to go after the Tea Party.

That would be like Alexander Butterfield telling the Watergate Committee that Nixon had a taping system.

Lerner and the other senior staff members are all committed Valerie Jarrett clients. Not only won’t they talk, they don’t want to talk.

But someone lower down on the food chain will talk, in secret, and let out a paper trail. I think this is what Issa has and isn’t letting out because he’s trying to protect sources.

Issa also assumes that he’s being monitored by the WH, so he has to be careful.

But I do think he revealed him.
For those who say Cumming just wanted to ‘rant’ – even if true, why doesn’t he get a few minutes to do so after Issa had 20?
A rhetorical question – we all know the answer to that.
I agree that this was theater – but it was good theater.
And as silly a spat as it was, Cumming looks better and more principled than Issa. That’s how the majority of folks will see it. (I understand, not here.)
Issa’s pettiness cost him any political advantage he might have come out of this latest show with.

Plenty of proof has been presented, including by those did testify before Congress but I understand it wasn’t printed on the back of a serial box so you missed it.

Correct. If she is given immunity, which she can be given against her will, she can still refuse to testify. At that point you again hold her in contempt, and we have to depend on the piece-of-dogcrap Eric Holder to do anything.

Any scheme suggested in these threads to deal with Lerner, ultimately ends up on Eric Holder’s desk, which means nothing happens.
