Video: Lois Lerner takes the Fifth again as Issa cuts off Cummings’s mic

Via the Daily Caller, the exciting — I mean it! — conclusion to this weekend’s mystery about whether Lerner was thinking of testifying after all. Answer: Nope. She refused again, which I guess settles the question of whether she inadvertently waived her Fifth Amendment privilege last year by delivering an opening statement before Issa’s committee before suddenly clamming up. At the time, Issa thought that statement constituted a waiver; so did Alan Dershowitz. Maybe the committee decided it wasn’t worth their time litigating the issue. Riddle me this, though: Why don’t they just agree to grant her immunity for her testimony? Her lawyer’s asked for it before, and her testimony’s certainly more valuable than seeing her go to prison, especially given the ignominy she’s already suffered for her role in the IRS scandal. Maybe Issa and the GOP are worried that conservatives will be angry with them if they let Lerner walk. That’s a small price to pay, though, if she has incriminating info on others up the chain.

Instead, he chose to punish Cummings by ending the hearing in frustration before the guy had a chance to ask his question. Cue the excitement.

Update: Issa on why he cut Cummings’s mic: “He was actually slandering me at the moment that the mics did go off by claiming that this had not been a real investigation.”

Issa is inept! Proper Prior Planning Prevents Piss Poor Performance! It’s what we’ve come to expect from Republicans. You can’t tell me the dems didn’t set a trap and Issa walked right in. Why didn’t he get a judge to rule on whether Lerner waived her 5th amendment right before calling her back in. And who was the Al Franken look-alike standing next to Issa?

Have they ruled out immunity? I thought Trey Gowdy said it was on the table. If they don’t make a deal with her, she’s likely never to talk. Obviously she has no qualms about taking the 5th as she’s now done so twice. And we know damn well no Democrat will ever demand answers from her.

At this point, there are two choices. Prosecute her lying ass and make an example out of her, or make a deal with her in exchange for her naming names.

I was watching it live. Cummings almost immediately went into a rant about the hearings being a political ploy by the Republicans. Issa turned the mic back on, told Cummings to ask his question, again Cummings continued with his rant. It was all political theater made for media sound bites.

Don’t think for a second if the Bush did something similar, and they had someone they despised like a Karl Rove sitting there refusing to answer the committee’s questions, Cummings and the dems would be fighting each other to the podium to cite him for contempt and file charges.

What she is really afraid of is ending up dead by a “suicide” in Fort Marcy Park (from multiple gunshots to the head). Congress can’t grant her immunity from that.

The reason why she’s afraid of that is that her testimony will implicate virtually everyone up the ladder to Obama.

This is why she can’t be granted immunity. For one thing SHE DESERVES TO GO TO PRISON FOR HER CRIMES! Secondly, if she is granted immunity, she will immediately claim that SHE and SHE ALONE did all of it.

Since we know Holder will never do it, we need a State Attorney General to file charges against her, for violating the rights of citizens of that State under their State Constitution.

In fact, we need a LOT OF THIS against the criminals in this Regime. They will ignore these charges, and have federal judges back them up, but what the States need to do is IGNORE the federal judges (who have NO CONSTITUTIONAL AUTHORITY over state criminal cases) and keep the charges pending.

Make whole swaths of the United States “no go zones” for Holder, Lerner, and other corrupt Regime officials.

Cummings was going for that Joseph Welch ‘Have you no decency’ effect, when Welch called out Joseph McCarthy and contributed to McCarthy’s loss of credibility. Issa, a supremely intelligent and perceptive man, saw what Cummings was doing and cut him off.

The Democrats are trying desperately to portray this as a McCarthy-like witch hunt even though Lerner is clearly guilty, guilty, guilty of using the IRS as a political enforcement and intimidation arm of the Obama Administration. Cummings did what he did cynically, purposefully, because Democrats are sleazy operators. That’s who they are, what they do.

A comparative moderate, Issa gets a lot of heat from conservatives for his squishiness on several core issues. It should be pointed out that he’s a California Republican, which is kinda sorta the equivalent of an Indiana Democrat. I cut him slack on that score. Representing California, Issa can be hardly be a Ted Cruz or Rick Perry Republican and expect to keep his seat.

The House could appoint a select committee that has subpoena power. But they won’t. Boner’s goal here is to APPEAR to be investigating Regime Corruption but not to actually DO anything constructive. Because the TEA Party is just as much enemy to the GOPe as it is to Obama.

My problem with Issa is Cummings was allowed to rant on without someone shouting back at him. I know, Issa behaved like you should and Cummings did not, but we live in a world where the squeaky wheel gets the attention and when someone is slandering you to your face you should fire back at once.

This is the GOPs, “Paul Ryan problem,” which is if you simply act sensible and talk logic that Americans will get it. Well as we have seen in the last presidential election that is not the case. Ryan allowed Biden to take over the VP debate, and today Cummings took over the hearing by making a scene of himself. LIVs only pay attention to you if you make a scene, sad but true.

Was Lerner’s second appearance enough to establish contempt of the committee? If so, Issa has the option of reporting Lerner to the floor of the House (along with, I suppose, the committee’s “finding” on her pleading the Fifth), introduce a resolution of contempt, which if passed by the House would mean either:

1) refer the case to a judge, while ultimately leads to trial in court; or
2) have the Sergeant-at-Arms bring her to the floor of the House, answer contempt charges, and through her in the House jail until the expiration of this session of Congress.

Now, given GOP skittishness about doing anything, do you think Boehner will bring a resolution to hold Lerner in contempt before the House?

This woman was a government employee, abusing government authority AGAINST THE PEOPLE WHO PAID HER SALARY. We have a RIGHT to answers from her.

I understand your frustration.

Since there is a good likely hood this will end up in court, what would she have to gain by speaking? I am thinking Barry Bonds or Scooter Libby. I know it is frustrating as we all want the truth, but there is a process. Had a personal incident and I refused to give a statement to law enforcement. Yep, I was 100% innocent and proven so, but the system is not your friend and you must watch what you say to multiple sources. Just life in our legal system. Sad note……it ain’t about the truth some of the time.

Exactly. There was no question, just another attempt to bash Issa and the Republicans. Rather than get into a screaming match with Cummings, Issa shut it down. Cummings will rant either way, but Issa played this correctly.

Here’s a question — does Issa have the power to offer immunity? Or does this have to come from DoJ?

I was watching it live. Cummings almost immediately went into a rant about the hearings being a political ploy by the Republicans. Issa turned the mic back on, told Cummings to ask his question, again Cummings continued with his rant. It was all political theater made for media sound bites.

Keep in mind that Issa had just adjourned the meeting- which is his right to do as Chairman. Issa acknowledged that listening to some cupid stunt repeatedly invoke her Fifth Amendment rights was worthless.

So…… Cummings started personally attacking Issa and demanding that everybody in that hearing room sit down and listen him to launch a purely partisan attacked filled with lies and smears.
