Video: Lois Lerner takes the Fifth again as Issa cuts off Cummings’s mic

Via the Daily Caller, the exciting — I mean it! — conclusion to this weekend’s mystery about whether Lerner was thinking of testifying after all. Answer: Nope. She refused again, which I guess settles the question of whether she inadvertently waived her Fifth Amendment privilege last year by delivering an opening statement before Issa’s committee before suddenly clamming up. At the time, Issa thought that statement constituted a waiver; so did Alan Dershowitz. Maybe the committee decided it wasn’t worth their time litigating the issue. Riddle me this, though: Why don’t they just agree to grant her immunity for her testimony? Her lawyer’s asked for it before, and her testimony’s certainly more valuable than seeing her go to prison, especially given the ignominy she’s already suffered for her role in the IRS scandal. Maybe Issa and the GOP are worried that conservatives will be angry with them if they let Lerner walk. That’s a small price to pay, though, if she has incriminating info on others up the chain.

Instead, he chose to punish Cummings by ending the hearing in frustration before the guy had a chance to ask his question. Cue the excitement.

Update: Issa on why he cut Cummings’s mic: “He was actually slandering me at the moment that the mics did go off by claiming that this had not been a real investigation.”

I can’t get over the blatant denial that takes place on this issue, to say that nothing was done wrong even though it was the IRS who first announced this to the media to get ahead of the story; to say that it was a universal rule that treated all groups equally, as evidenced by this piece of paper that clearly delineates two different levels of action based on presumed political leanings; to say that it was just idiots in a Cincinnati office and Lerner was not in any way involved, even though there are emails FROM LERNER that are directing these applications NOT to be handled in the Cincinnati office. And then in the face of all this, to say there is no evidence of wrongdoing when she just plead against self-incrimination.

I’m not sure which question is more ridiculous- the one claiming that Issa’s committee isn’t investigating a criminal proceeding and then want to charge Lerner with a crime (contempt of Congress), or the one claiming that it’s up to Lerner to prove that she didn’t commit a crime.

Issa did not follow committee rules. He took far more than his share of the allotted time, and then refused to grant Cummings any of his or the Democrats’ allotted time. That’s why he was reduced to shrieking for Cummings’ mike to be cut off- because Cummings humiliated him by making it clear that Issa was overstepping his authority.

If you were to be arrested, your only words would be the same as Lerner’s: 5th Amendment and “I want my lawyer.” And they should be, if you accept that the Constitution is the same for everyone.

This hearing yesterday was about 1 thing and 1 thing only – getting Lois Lerner to answer 7 questions, questions regarding documents/e-mails this committee has that directly contradicts what Lerner has said in the past. Some of these e-mails were written by Lerner herself and shows she LIED in the past.

This was NOT a platform for Cummings to attack the investigation into the PROVEN targeting of American citizens by the IRS.
“Proven? Show me the evidence!” (I know this will be coming so…)
OK, here ya go — The 1st bit of evidence came from LOIS LERNER herself: From the Huffington Post, one of MANY news sources that reported this story:

WASHINGTON — The head of the Internal Revenue Service’s exempt organizations division apologized on Friday for the inappropriate targeting of conservative groups during the 2012 election. The apology by Lois Lerner, first reported by the Associated Press, revealed that groups with the words “tea party” or “patriot” in their applications for tax-exempt status had received greater scrutiny.

There is more evidence, to include some of the e-mails written by Lerner that Issa asked her about during the hearing yesterday. Issa asked her his 7 questions – Lerner refused to answer each one by claiming her 5th Amendment Right not to answer. Once Issa asked all 7 questions and saw he was not going to get Lerner to talk he saw no further need to proceed…so headjourned the meeting.

At this point Cummings told Issa that he had a question, not to Lerner but a question regarding the hearing’s procedual process. Issa stopped and asked Cummings what his question was. Cummings had no question – instead he launched into a tirade, criticizing the entire investigation… Again, this hearing was not a platform for partisan political speeches but was instead about trying to get Lerner to answer 7 questions. Issa turned his back on Cumming’s CALCULATED (IMO) tirade in front of the cameras to justifiably adjourn the hearing.

If Cummings was / IS SO SURE there is nothing to this IRS ‘scandal’, that it is as Obama says ‘a made up scandal’ then he should have encourageged Lerner to talk to the committee and answer the questions. The truth is Cummings does NOT want Lerner to answer. Cummings pulled an ‘emotional Hillary’ in front of the cameras, declaring he just wanted the truth. When Lerner refused to answer questions about her own e-mails that contradicted what she said in the past, however, Cummings attacked Issa and the investigation instead of demanding answers from Lerner.

Cummings tried to turn the hearing into a circus, attempting to undermine the investigation of the abuse of power, the use of the IRS to target and punish Americans. Good for Issa for shutting it down and walking off!

You don’t admit to and/or apologize for something NOT done. At the very least Lerner admitted to ‘inappropriate behavior’ within the IRS, the perpetrators of which have never been punished.

Issa read an e-mail written by Lerner to the IRS employees in her division who were perpetrating this ‘inappropriate targeting of Conservative groups’, and in this e-mail Lerner called the TEA Party groups a ‘Dangerous Threat’ (evident by the TEA Party’s impact on the 2010 election). This e-mail at the very least 1) establishes proof of Lerner’s ‘inappropriate bias’ towards the TEA Party and Conservative groups, which is in itself dangerous when put over such a poweful government agency division. This e-mail also 2) proved to be directly contradictory to both her earlier statements and to the admission and apology she offered above.

Cummings railed on yesterday like a maniac declaring he only wanted the truth. if that is true, instead of attavk Issa & the investigation he would have been encouraging Lerner to answer the questions and talk to the committee…which he did not do.

This might have been mentioned above, but Lerner’s taking the 5th during a Congressional Hearing has no basis in Constitutional Law. The 5th Amendment states: “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”

She is not being compelled in a criminal case to be a witness against herself. This is not a criminal case. It is a Congressional Hearing. She has no Constitutional right to plead the 5th. Issa should have told her: “The 5th Amendment has no bearing in a Congressional Hearing. Please answer the question or I will hold you in Contempt of Congress. If you refuse to answer the question, I will direct the Sergeant of Arms to place you under arrest and confine you until you are ready to answer the questions.” Then let her plead the 5th and haul her off to a cozy 6 x 6 cell.

Issa should be in front of the MSM stating that Lerner pleading the 5th, while having no Constitutional right to protection during a Congressional Hearing, is ample reason to believe that she has something to hide. Who is she protecting? If no one has done anything wrong, as she and the President claims, why not answer the questions? You only take the 5th (even erroneously) you are admitting that what you did was illegal and possibly criminal.
