Krauthammer: These ObamaCare changes are getting so endemic, “nobody even complains” anymore

They have a whole heap of regulations still left to write (at least $1.4 billion in annual compliance costs’ worth, by one estimate), but the employer mandate was part of the actual text of the law. Where is it written that they can just make at-will changes ad infinitum? Watch it at RCP:

Generally speaking, you get past the next election by changing your policies, by announcing new initiatives, but not by wantonly changing the law, lawlessly. I mean, this is stuff that you do in a banana republic. It’s as if the law is simply a blackboard on which Obama writes any number he wants, any delay he wants and any provision. It’s now reached a point where it is so endemic that nobody even notices or complains. I think if the complaints had started with the first arbitrary changes, and these are are not adjustments or transitions. These are political decisions to minimize the impact leading up to an election, and it’s changing the law in a way that you are not allowed to do. … It’s not incompetence. Willful breaking of the constitutional order — where in the Constitution is the president allowed to alter a law 27 times after it’s been passed?

And besides the utter lawlessness of the whole thing, there’s still the question of the tangible price of the White House’s non-legislative mood swings: After the Obama administration’s initial employer-mandate suspension through 2015 that they made back in July, the CBO estimated that it would add an additional $12 billion onto the total cost of ObamaCare because employers wouldn’t be paying penalties (i.e., taxes) on not insuring people, while more people would likely need to seek subsidized insurance through the exchanges because their employers wouldn’t be required to offer it yet. Won’t delaying the employer mandate again add at least ten billion or so more onto the total ObamaCare price tag? Especially if the Obama administration does decide to go through with the rumored (and, incidentally, also lawless) three-year extension of the “if you like your plan, you can keep it” fix for the cancelled plans in the individual market, doesn’t that all increase the likelihood of major “risk corridor” bailouts and/or the law’s fiscal implosion? What is going on?!

Amazing. They don’t even believe in strict construction of their own legislation.

During the “shutdown” it was solemnly declared that ObamaCare is and will remain the “law of the land,” forever and ever, and no negotiation with terrorists (read: Republicans) could ever change that.

Until King Hussein deemed it politically expedient to change it with his Mighty Pen, a couple times since then.

The “mandate” was passed as a penalty, but conveniently morphed into a tax, when Justice Roberts must have found that horse’s head in his bed sheets and consequently discovered his inner Ruth Bader Ginsburg.

Speaking of which: All laws concerning taxation must originate in the House (it’s called the origination clause, for any of you who remember what the Constitution is). Notwithstanding ObamaCare originated in the Senate — the idea that the Executive can willy-nilly modify provisions of tax enforcement, as it were, “on the fly,” should strike even the most hard-boiled liberal as an anathema to our system. Imagine a President deciding not to enforce the Estate Tax or the Capital Gains Tax.

They won’t have to imagine it much longer, if they don’t take measures to yank the leash on this usurper, and right soon.

All Obamacare has to do is exist, in the background for a while, and it will eventually consume the health care industry.

As an example, who’s still complaining about the TSA and their invasions of the 4th Amendment every time you and your family go to the airport? Who’s complaining anymore about their sons and daughters getting patted down and x-rayed by TSA perverts? No one. Because the TSA has gotten their toe hold.

The next items? Gay marriage, pot legalization, gun control and amnesty. All they need is a toe hold and all 4 of those topics have them (gay marriage legalized in several states; pot legalization in Colorado and Washington; gun control all over the place; and amnesty with both Reagan’s amnesty and the DREAMERs stuff executive ordered by Obama). They’ve gotten their toe hold.

One further point. Fournier tonight is me sense symbolic of the issue I have with the political center these days. He objects to the word “lawless” because it sounds mean, or overly judgmental or something, but he has no idea of the factual basis for the claim. It just sounds bad to him, so he objects. People who don’t understand our history or the history of western civilization are often vocal, sometimes glib, but don’t add much. Fournier is that sort, but so are so many people I know nowadays.

5) We will owe ourselves so much money that we will refuse to pay up, and it will all start over again

^ Exactly. I got active in the backlash known as the Tea Party back in 2008 and all we got was hassled. Dragged my kids to rallies, they made signs, we worked on campaigns for conservative candidates, made phone calls, went door to door, attended meeting after meeting after meeting trying to get our “representatives” to listen to us. We were in DC in March 2010 and watched Pelosi walk to the Capitol building with that botox sneer on her plastic face. We stood right by the reps from the Congressional Black Caucus who tried to demonize the crowd by accusing a man of spitting on them (it never happened). Shook hands with Paul Ryan in the hallway and he thanked us for coming down. Worst night ever when the final vote came in and it was announced that Obamacare passed. For almost six years we have been fighting the good fight. What haven’t we tried? Krauthammer’s supposed to be a smart guy; does he have a plan? I’d sure like to hear it.

One way to get answers or maybe action from our elected officials is to have right leaning blogs interview a different politician every week. The bloggers could choose from questions posed by their commenters and some of their own questions.

Maybe the politicians, by being less insulated, will become aware of our concerns and do something, especially if they are in an election year.

“Because I say so” is Obama’s new mantra. If he could acquire more power than he’s got now, do you think he’d hesitate to use it as he’d like? He already used the IRS to shut down various Tea Party groups for the 2012 election cycle. Why wouldn’t he act to reward his favored groups, and punish those he dislikes?

It is simply a blank check for the executive to set national health care policy by telling insurers and those being insured what they should do with health care.

If the clear text of legislation such as the ACA can be rewritten and/or ignored on the fly for the progs supposed political ‘benefit,’ it can be rewritten and/or ignored by the legislation’s opponents when they eventually have the power to do so.

So, good luck with all the digging you’re doing underneath your grand once-in-a-generation legislation’s foundation, progs. It’s going to collapse entirely because of you, and nobody else.

He should have been stopped long ago. It’s not much different than the gang problem. If decades ago the first push for power by embryonic gangs in neighborhoods would have been squashed, there would not be a problem now. Now they are too entrenched and intimidating, with too many lawyers and “civil rights” groups.
Same thing with this administration in obvious and growing ways. A racist activist was just chosen to head the civil rights branch of the DOJ.

It’s not folly. It’s the only ENFORCEABLE means left to impose new laws on a lawless Federal Government. The federal government has proven, obviously, that they are not willing to adhere to the law or even their own rules.

But Constitutional Amendments are different. They either adhere to Constitutional Amendments, or they are sued, they lose, and then the Judicial branch forces them to adhere.

For example, an Amendment passed in a States Convention that imposes term limits on Congress, or says that Congress SHALL pass a balanced budget every year, or if an Amendment is passed taking away Congress’ ability to give themselves pay raises, all of these things they either DO or they are sued and the Judicial forces them to do.

Constitutional Amendments give the States and the people Constitutional standing to sue and force the federal government to adhere to it.

How about a challenge to the created/renamed unconstitutional tax that SCOTUS bestowed upon us back in June? With luck (and a boatload of honesty), SCOTUS will strike down that which it unconstitutionally imposed upon the American people AND (with a fleetload of honesty) strike down that which the Misguided Ones strove to mightily to save.
