Here we go: White House delays ObamaCare employer mandate for some small businesses until 2016

The perfect complement to this morning’s post on immigration. The employer mandate was already delayed last year, of course, in order to spare Democrats some extra pain during O-Care’s extremely painful rollout. That wasn’t related to an imminent election, though; this new delay is. Obama unilaterally amnestized DREAMers two years ago for no better reason than that it helped his side in the 2012 election. Now he’s going to amnestize small businesses from his signature boondoggle for the same reason, to cover his team’s asses this fall.

According to the statute passed by Congress and signed by the president, businesses with 50 or more full-time employees are required by law to provide them with health insurance as of January 1, 2014. But the law doesn’t matter:

Employers with fewer than 100 workers won’t have to provide health insurance until 2016 under Obamacare, as the administration said it would again delay a key requirement of the health law.

Larger firms have to cover at least 70 percent of the workforce starting next year, the Internal Revenue Service said in a rule issued today.

The Patient Protection and Affordable Care Act envisioned as a cornerstone of its expansion of U.S. insurance coverage that employers with 50 or more workers would be required to provide health benefits to their employees. Under pressure from business groups, the Obama administration has weakened that requirement since July, first by delaying enforcement of the mandate until 2015. Many firms will have even more time under the regulation issued today…

The rule provides employers far more flexibility than allowed by the language of the health law, which levies fines of as much as $3,000 per worker against firms that don’t comply with the requirement.

Three points. One: It’ll be a stump-speech staple for every Republican running in 2016 that he intends to delay ObamaCare indefinitely, root and branch, if elected. Obama’s now set the precedent that he can suspend parts of the law simply because he finds them politically inconvenient. That precedent will be built upon. Two: The GOP might sue to force him to enforce the mandate, although the politics of that are tricky. No one likes the mandate, especially Republicans’ benefactors in the business lobby. Successfully suing O over this, even if it’s for the noble constitutional purpose of compelling the president to faithfully execute the law, would mean making ObamaCare even more onerous than it is. Good for rolling back executive overreach, not so good for the economy.

Three: This should be it for immigration reform. If Obama’s answer to Boehner’s “we don’t trust you” charge is to double down on one of his most egregious executive power grabs, there’s no way Republicans will trust him on border security now. And of course O knows it, which makes me think he’s already decided to compound this illegal action with some sort of unilateral mass amnesty by executive order later this year or next. There’s no going back.

Obama couldn’t get a job at McDonalds with telling them to look at a forged PDF at a URL.

Yet that is exactly what he’s done to hold the highest elected office in this country!

Where is Obama’s Form I-9 and acceptable hardcopy documentation presented to his employer (We the People) for inspection?

Over the weekend, the NAACP held a big rally in North Carolina called the Moral March. One of the things they were protesting was the “racist” NC Voter ID Law.

All of the participants were required to have photo IDs.

Obama leaves the White House at the end of his term and immediately starts campaigning for U.N. Sec General. Upon being pressed about being ineligible he confesses he is actually a Kenyan citizen that had to lie to the US because of ***Racism***.

What would happen to the U.S.? 8 years of signed laws all down the tubes.

So we have all these books of regulations that the IRS can bring to your knees if you don’t comply with the 465,328 requirements. But one press conference tosses 100,000 in the trash, but we can’t tell you which ones until we break you.

What happened to the businesses under 50 and all the wonderful small business cartel exchanges.

If you will recall, Congress wrote the law in such a way as to give carte blanche access to HHS and IRS to esentially make up the rules on implementation and enforcement as they chose. I read the entire 2700 pages of the law; (it took me 3 weeks to get through it all, it’s so convoluted..) and in no less than 213 sections, (if I’m remembering correctly), says “the Secretary shall direct…” fill in the blank. Everything from creating whole new useless departments, to outrageous budgets for funding said departments, each of which can be shifted from one dept to the other. Not to mention the dozens of new taxes. The Dems did this purposely because for years and years both parties have been shirking their Constitutional responsibility in this realm, and passing laws with the same type of allowances. Why do you think we have runaway EPA, DOE, DOJ, and, well pretty much ALL the alphabet soups? Because each time they passed it and their proverbial sky didn’t fall, it was much easier to do it next time. Someone’s version of O-care was always in the wings; waiting patiently until voter apathy and/or indoctrination had tipped the scales in their favor. It would appear that time is upon us.

So if you have a facility with 1000 employees… you create 10 or so sub corporations that each are owned by the parent corporation and are really only separate on paper. Boom… exempted.

I don’t believe the wording of the law is actually that flexible. This article from CNS states as follows:

President Barack Obama’s Treasury Department issued a new regulation today that for the second time directly violates the plain and unambiguous text of the Patient Protection and Affordable Care Act by allowing some businesses to avoid the law’s Dec. 31, 2013 deadline to provide health insurance coverage to their employees.

Initially, on July 2, 2013, the administration unilaterally delayed the deadline for the employer mandate until 2015. Now, the administration is unilaterally delaying it for some businesses until 2016.

In its official summary of PPACA, the Congressional Research Service said: “(Sec. 1513, as modified by section 10106) Imposes fines on large employers (employers with more than 50 full-time employees) who fail to offer their full-time employees the opportunity to enroll in minimum essential coverage or who have a waiting period for enrollment of more than 60 days.”

The text of the law itself describes an “applicable large employer” as follows: “The term ‘applicable large employer’ means, with respect to a calendar year, an employer who employed an average of at least 50 full-time employees on business days during the preceding calendar year.”

The final words in the section of PPACA mandating that employers with more than 50 full-time employees provide their employees with “minimum essential coverage” imposes a specific statutory deadline for doing so. It says: “EFFECTIVE DATE.—The amendments made by this section shall apply to months beginning after December 31, 2013.”

Last summer, the administration unilaterally moved this hard statutory deadline back one year to 2014 for all employers with more than 50 full-time employees. Now, without any action by Congress, the administration is moving it back again for some employers—despite the plain language of the law.

The Treasury Department has issued a fact sheet explaining how the Obama administration’s new declaration changes the meaning of the Patient Protection and Affordable Care Act.

The fact sheet says:

“To ensure a gradual phase-in and assist the employers to whom the policy does apply, the final rules provide, for 2015, that: The employer responsibility provision will generally apply to larger firms with 100 or more full-time employees starting in 2015 and employers with 50 or more full-time employees starting in 2016.”

The fact sheet goes on to say:

“To avoid a payment for failing to offer health coverage, employers need to offer coverage to 70 percent of their full-time employees in 2015 and 95 percent in 2016 and beyond, helping employers that, for example, may offer coverage to employees with 35 or more hours, but not yet to that fraction of their employees who work 30 to 34 hours.”

It further says:

“While the employer responsibility provisions will generally apply starting in 2015, they will not apply until 2016 to employers with at least 50 but fewer than 100 full-time employees if the employer provides an appropriate certification described in the rules.”

And also:

“Employers that are subject to the employer responsibility provisions in 2015 must offer coverage to at least 70 percent of full-time employees as one of the conditions for avoiding an assessable payment, rather than 95 percent which will begin in 2016.”

In sum, the law says that employers with “at least 50 full-time employees” must provide “minimum essential coverage” in the “months beginning after December 31, 2013” or pay a fine. The new declaration from the Obama administration’s Treasury Department says this part of the law no longer applies. It says employers with between 50 and 99 employees need not provide coverage until 2016 and larger employers need only provide coverage to 70 percent of their employees next year.

This points out the bigger danger of the ACA. As written, the law grants the executive branch great leeway to interpret and execute the law, or even to change it as they see fit with no congressional oversight. The financial protection legislation was drafted much the same way, to create executive oversight and remove congressional authority. Can congress legally pass legislation that grant their constitutional authority to the executive branch?

Companies have tried that and get sacked by the IRS…..

My father worked for a large silicon valley company as a “contractor”…..

The difference was – he was very diligent about record keeping and paying taxes…..

One day he got an IRS letter that said they were going to re-classify him as an “employee”….

So he went to the audit with all of his records and after he was done – the IRS owed him $14,500….

They wrote him a check and he was on his way back to being a contractor.

As long as he is far away from any form of power that he can damage the country further, I don’t mind if he wastes more trees making blank EOs. If anything, it might get the environmental lobbies tailing him, and that might be a popcorn-worthy moment

So heres a question that I think needs to be answered by a lawyer or constitutional expert.

Couldnt any individual who would have been insured by the employer mandate sue the federal government over this delay? Since there is no legal basis for this delay couldnt they argue that they are being harmed? And if so, wouldnt that then force the federal government to immediately begin enforcing the employer mandate?

I was wondering because the GOP have no real incentive to sue Obama, but any individual that does wouldnt have to fear the electoral blowback that a ruling like that could have.

Even if standing was eventually to be found valid (seems unlikely) it would be well past Little Boots term before it ever got sorted out in the court system. At that point HHS would be held liable and Little Boots would still get a pass.

To be honest, what else can they say? Their feet are just as tied to the sinking ship that is the USS Obamacare as much as Agent Zero is. In either case, how the midterms go will depend on how the GOP handle the road ahead. It is well within their power…they just have to find a path and not find a way to screw up…which is a tall order indeed.

So let’s get this straight:

Option 1: “I’d like to hire you Bob, but you’d be my 100th employee, and I can’t afford to cover 70+ workers under Obamacare.”

Option 2: “I’d like to hire you Bob, but actually I’m closing down the business because someone won a court case stating that the Obamacare delays are illegal, and so my business is bankrupt.”

Unfortunately they may be correct… to a degree. Between LIV’s and Obamabots it will probably have a small positive impact, especially when the MSM starts spinning it. :-(

It would be different if there was effective opposition. Just my opinion…
