Here we go: White House delays ObamaCare employer mandate for some small businesses until 2016

The perfect complement to this morning’s post on immigration. The employer mandate was already delayed last year, of course, in order to spare Democrats some extra pain during O-Care’s extremely painful rollout. That wasn’t related to an imminent election, though; this new delay is. Obama unilaterally amnestized DREAMers two years ago for no better reason than that it helped his side in the 2012 election. Now he’s going to amnestize small businesses from his signature boondoggle for the same reason, to cover his team’s asses this fall.

According to the statute passed by Congress and signed by the president, businesses with 50 or more full-time employees are required by law to provide them with health insurance as of January 1, 2014. But the law doesn’t matter:

Employers with fewer than 100 workers won’t have to provide health insurance until 2016 under Obamacare, as the administration said it would again delay a key requirement of the health law.

Larger firms have to cover at least 70 percent of the workforce starting next year, the Internal Revenue Service said in a rule issued today.

The Patient Protection and Affordable Care Act envisioned as a cornerstone of its expansion of U.S. insurance coverage that employers with 50 or more workers would be required to provide health benefits to their employees. Under pressure from business groups, the Obama administration has weakened that requirement since July, first by delaying enforcement of the mandate until 2015. Many firms will have even more time under the regulation issued today…

The rule provides employers far more flexibility than allowed by the language of the health law, which levies fines of as much as $3,000 per worker against firms that don’t comply with the requirement.

Three points. One: It’ll be a stump-speech staple for every Republican running in 2016 that he intends to delay ObamaCare indefinitely, root and branch, if elected. Obama’s now set the precedent that he can suspend parts of the law simply because he finds them politically inconvenient. That precedent will be built upon. Two: The GOP might sue to force him to enforce the mandate, although the politics of that are tricky. No one likes the mandate, especially Republicans’ benefactors in the business lobby. Successfully suing O over this, even if it’s for the noble constitutional purpose of compelling the president to faithfully execute the law, would mean making ObamaCare even more onerous than it is. Good for rolling back executive overreach, not so good for the economy.

Three: This should be it for immigration reform. If Obama’s answer to Boehner’s “we don’t trust you” charge is to double down on one of his most egregious executive power grabs, there’s no way Republicans will trust him on border security now. And of course O knows it, which makes me think he’s already decided to compound this illegal action with some sort of unilateral mass amnesty by executive order later this year or next. There’s no going back.

Frame it in terms of the necessity to repeal a fundamentally flawed program; if Obama then goes for some shenanigans involving immigration, every R should be speaking of the need to restrain this unlawful president. But if the goal is merely to put a black mark(if you’ll excuse the “racist” term) on Obama’s legacy while bringing attention to his utter lack of respect for the rule of law, then just impeach the SOB and dare the Senate to defend what he’s doing.

SCOTUS heard oral arguments on 13 Jan 2014 for NLRB v Noel Canning, et al, pertaining to 0bama’s recess appointments to the NLRB. IF SCOTUS rules against 0bama (may I call him “zero” here and not get in trouble?), that could pave the way for impeachment on abuse of power grounds and pave the way for more counts for Articles of Impeachment.

The trick, though, will be to a) come up with an air-tight case that will persuade Dems in the Senate to vote for impeachment/removal or b) persuade Dems to confront 0bama with a Nixon’s Choice and allow him to bow out (somewhat) gracefully with a hasty resignation.

We already know what cards will be played to try to keep 0bama in office and persuade the Dems to stick with their sinking garbage scow, so it should prove interesting.

The best people to sue the admin over this are those employees employed by companies with between 50 and 99 FT employees. If the republicans had a sack they’d have the complaint all ready to file tomorrow morning. And then go before every podium and say “equality you say Barry, then why treat these poor employees UNEQUALLY?”. This is so good on so many levels…the law is so good and popular that they have to keep delaying all of the “benefits”. Brain trust indeed.

If I owned a business covered under this delay and had or planned to contribute to conservative efforts, I would proceed as if there were no delay.

Selective enforcement of the law by this administration seems to be the rule rather than the exception something specifically prohibited under the 5th amendment.

How awesome would it be for a Ted Cruz or a Rand Paul to say “Mr. President, we’ve the people decided to unilaterally delay compliance with the individual mandate, meaning, we’ll start to comply next year, or maybe in two years, or maybe never, ass-face”. And when Barry snorts an objection about “where do they get off doing so”, just rip off the old anti-drug commercial and say “you Barry, alright! We learned it by watching you!”.

Presidents who disregard laws have citizens that disregard laws. This shiat is begging for an Irish Rebellion, where the people, like, just don’t comply, man. The Feds don’t have the man power and prison space to arrest everyone.

Yep, the actual language of federal statutes, just like the actual language of the U.S. constitution, no longer matter. The law is now whatever Dear Leader says it is. And he can enforce it, or not, or change it, according to his own whims and whatever best suits his own political objectives.

This. However, the legal angle is a sideshow – the meat is the optics of Barry denying health insurance to the employees of the affected companies. Drag a crying mother (single preferably) with her kids in front a bank of cameras and have her ask the POTUS why he’s denying her “right” to affordable HC under his signature achievement. All of this depends on the R’s actually growing some stones but I wouldn’t bet against it.

Since the IRS is tasked with enforcing the ACA “law”, the employer mandate will still be enforced for small businesses whose CEO gave more than $1000 to Republican candidates in 2012.

He can try. The problem for him is this will immediately go to the courts where it will likely be struck down. Unilateral abuse of executive authority to grant 30+ million illegal aliens the vote will be a very hard pill even for the Roberts court to swallow. At least some states will also probably deny the illegals the right to vote as well, which will likely lead to a massive electoral crisis in 2016 if the issue is not resolved quickly.

I get honestly tired of hearing my fellow Conservatives bemoan the idea of impeachment because they believe the Senate will not convict. It doesn’t matter. Congressmen take the oath to “…protect and defend the Constitution…” When they abrogate their responsibility, they are no better than the President and are just as guilty as the President.

You’re probably right. He got away with the first illegal alien amnesty EO with barely a peep out of congress in response to his blatant usurpation of their clear constitutional authority.

Why not go all in? Who’s going to stop him? The rule of law has become nothing more than a bad joke under this corrupt administration, and the joke is on the American people. Congress and the courts refuse to help us. We’re going to have to act on our own.
