Sheila Jackson-Lee: My House caucus is drafting a number of executive orders for Obama to sign

Via CNS, I’m late with this but it’s worth preserving belatedly. In theory, separation of powers is supposed to prevent what you’re about to see. The president may belong to the same party as members of Congress but the quest for power forces each to guard their respective branch’s constitutional prerogatives. Pitting different arms of government against each other is one way to make sure — again, in theory — that no single arm grows too powerful. That’s checks and balances 101. I’m sure there’s a “Schoolhouse Rock” episode about it somewhere.

In reality, congressional Democrats’ despair that the GOP is set to hold the House for the foreseeable future leads to this pathetic spectacle, in which members of one branch are now working as secretaries for another to encourage it to bypass them in the legislative process. Some people used to care about this, and eventually they’ll care about it again. But not for the next three years, at least.

“What we have to do is keep on going, keep on pushing, and eventually we move in a better direction,” he said.

Obama also announced a variety of executive orders, including one to increase the minimum wage for some federal contract workers from $7.25 to $10.10 an hour.

“America does not stand still, and neither will I,” Obama said. “So wherever and whenever I can take steps without legislation to expand opportunity for more American families, that’s what I’m going to do.”

“We’ve got this Constitution, we’ve got this whole thing about separation of powers. So there is no short-cut to politics, and there’s no short-cut to democracy.”

There is in fact a process by which Jackson-Lee could draft something, then have the president sign it and it would carry the power of a law. It is called normal order. Her house colleagues and Senators just need to vote on it and pass it first.

I’m a bit rusty on my history, but if I recall correctly, ancient Rome was originally a republic. Instead of a President, they had consuls who were elected to serve for a year. The consuls were advised by the Senate. Julius Caesar was murdered by Brutus because he wanted to one-man rule. The civil war that ensued eventually led to the victory of the “pro-one-man rule” contingent and Augustus became emperor. Oh, the Senate still existed. It still met. But by this time they had more or less willingly ceded their power to the emperor. They would continue to lose not only their power but all of their influence. Many of them thought, early in Augustus’ reign, that they would be able to wrest power back from after his death. It was not to be.

What we’ve got in this country is a branch of the government that is bending over backward to cede every bit of constitutional authority it has to the President. I’m sure they think that when this President is gone and a Republican president is elected, they will be able to take back their powers. They are ignorant of history and are bound to repeat it. They are sowing the wind, but they will reap the whirlwind. I am ashamed of them, and I feel sorry for my country.
