A question I’m beginning to research, for later discussion: if penalties under ObamaCare are characterized as “taxes” and those taxes aren’t paid as the law requires, can an argument be made that they accrue and may be collected by future administrations?

In other words, if the federal government announces that it is not going to “enforce” the collection of a fee (tax) that attaches due to a statute that I have clearly violated (e.g., legal provisions for which BHO has issued “waivers” found later to have been of no legal effect), what happens to the fee (tax) itself?

If BHO tells me I don’t have to pay my taxes this year because he’s told the IRS not to enforce the law as it relates to me, it does not mean that I don’t owe the taxes. I could even argue that interest and penalties will continue to accrue until and unless the taxes are paid.

It seems that His Excellency might need to be issuing pardons rather than waivers. Just a curious thought wafting through on a brisk morning.
