Paul Ryan: Under our plan, illegals will have probationary legal status while the border is being secured

We’re still waiting for Boehner and the House leadership to release their new “principles” on immigration, but I think this tells us most of what we need to know.

Pay close attention at around 1:40 of the clip. Lefty Greg Sargent thinks it’s significant. I agree.

Ryan confirms GOP “principles” will include legal status for the 11 million, but he also says this will be a ”probationary status” to make sure the 11 million will not be “preferenced over people who did follow the laws.” It’s important to have confirmation that there will be a way out of the shadows. But the probationary period idea is problematic. Details will matter, but it would probably allow for people to get the right to work up front, but they could be kicked off of probationary status if certain security benchmarks aren’t met.

Advocates see this as bad policy: Why would undocumenteds step forward, if they know they can lose work status and get deported later because of nothing that they did, but only because Washington failed to decide certain metrics had been fulfilled?

However, Ryan also says the undocumented will be allowed to work as part of “probationary” status before security benchmarks are met. “You can be on probation,” Ryan says, “while the border is being secured.”

Solution: No one comes out of the shadows until the border’s secured. The status quo on legalization holds in the meantime. There’s no rational reason why a country needs to make concessions to illegals before, or concurrent with, strengthening its borders, just as there’s no rational reason to think the GOP would use the security trigger to delay legalization ad infinitum. Everyone understands the demographic realities of the last election. Everyone knows how eager the Republican establishment is to attract Latino voters. And everyone knows how gleefully Democrats will demagogue them for dragging their feet on legalization while the border saga is playing out. Left to their own devices, Republicans would legalize illegals sooner rather than later. There’s no similar reason to believe that Democrats, left to their own devices, would eventually get around to tackling the border once legalization happened.

But I digress. “Probationary” legalization while security improvements are being made is the same nonsense in the Gang of Eight proposal, and it’s unacceptable for the same reason. Namely, in reality, there’ll be nothing probationary about it. Once “probation” is granted and illegals gain a temporary right to stay in the U.S., Congress will never muster the will to rescind that right even if the new border security efforts fall apart (or, more likely, if Obama simply refuses to carry them out). It’ll be like any other entitlement — once it’s in effect, congressional cowardice at upsetting people’s expectations will ensure that it’s with us forever. If you think the left’s immigration demagoguery is bad now, imagine what it’d be like in the summer of 2016, with border enforcement going nowhere and some Republicans in Congress whispering about canceling the conditional “probation” that was granted to illegals as a result. It’ll never happen. “Probationary” legalization is permanent legalization, period, which is why it can’t be granted until after the border’s been measurably improved. And the left will never agree to that because they don’t want the border improved; how will there be another new influx of Democratic voters over the next 20 years if the border becomes too solid to breach? They want the people here now legalized without any hard conditions and they also want to make sure that there’s not so much pressure on DHS to upgrade security that the 2045 amnesty will have to be canceled. Sounds like Boehner and Paul Ryan are going to make their dream come true.

Sargent’s also right about the path to citizenship here. Ryan mentions that there won’t be a “special” path, but near the end he imagines legalized illegals being able to apply for green cards eventually through currently existing channels, the penultimate step to citizenship. You already knew the leadership was leaning this way, but now here’s the proof. Everyone excited?

I don’t think when we talk about a “secure border” we mean a 100%, locked down, no illegal crossings ever border.

I think we mean something significantly more secure than now – which is possible.

Also, I think it encompass enforcing the immigration laws (particularly against businesses), getting rid of sanctuary cities, having police check immigration status, having schools do it, having ER’s do it, making it very difficult to be here as an illegal, which would reduce the flow of people trying to cross illegally.

So, you have a much more secure border coupled with far less incentive to cross illegally. That would reduce the flow of illegals significantly. Both harder to get in and less reason to get in.

As it stands now, we do neither. We don’t really make it difficult to enter the U.S. illegally and we don’t make it difficult to stay in the U.S. illegally.

And while you’re at it, I’d prefer to hear a companion pathway to amnesty on a host of other crimes for people that aren’t ‘in the shadows’ – they’re in f*cking prison, where they belong, ok? If you’re going to forgive Group X of their crimes, and confer upon them more privileges in some respects than to our own citizens (ahem, New Jersey), then you need to simultaneously at least lobby for the release of perhaps EVERY non-violent criminal in the Unites States penal system – and maybe expunge the records of the ones that are no longer in prison.

Sound fair? Sound like a good idea? No, it doesn’t – so don’t do it for one f*cking group of criminals to begin with, a$$hats.

How about, as a starter, securing the border?

You know we have had incidents where the Cartels have beheaded people and run assassinations in the US, so how about shutting those suckers down? You know, the ones causing crimes? Killing people? If you can’t even bother to go after THEM then anything else is off the table: enforce the CRIMINAL laws and shut down the Cartel’s easy transport into the US.

Anything else is just welcoming in more criminals, more organized crime, and Cartels training with jihadis.

So how about some proofiness that you guys Upon The Hill actually MEAN something about securing the borders by SHUTTING DOWN THE CARTEL ACTIVITY IN THE US of A?

Fine… BUT they want them all to be automatic citizens (hmmm… Voters) which is NOT cool.

How about this any undocumented immigrant gets to stay and keep working – but no government services or voting rights unless they VOLUNTEER to become a citizen.

And IF they decide to become a citizen they must not leave the country for 5 years to become one.

If we want to save America we need to teach Americans that it is often a mistake to vote for the candidate with the most numerous, flashiest campaign commercials, the slickest hair and fanciest talk. Very often it is the candidates with the most money to blow who are the most bought and paid for, least principled and the worst sort to wield power over others. This is one of the reasons America is circling the toilet.

It would be nice if this theme held some space in popular culture.

I’ll bite, with a follow-up question or two:

– how do other questions handle immigration/border enforcement?

– your answer, presumably, is not to simply ‘do nothing’ re: border enforcement, is it?

I don’t think anyone’s looking for a ‘berlin wall’ scenario here – a very simple, great start would be to enforce our immigration laws when we stumble upon someone here illegally – deport them, not give them free stuff, free education, free healthcare, drivers licenses, etc. Another very simple, great start would be to make it very painful for them to be here in terms of making it very painful to any support points there might be – landlords who rent to them (fines/penalties/jail), employers who hire them (fines/penalties/jail), etc. From the illegal immigrant perspective, if you make it painful enough, the problem will in large ways begin to repair itself.

Now, border security re: terrorists and others that would want to sneak across the border, well… that brings us back to needing to do *someting* more in terms of actual monitoring/physical security.

We would draw for the side of the debate we have to make.

The next night we would debate our issue – afterwards my parents would judge our content, and ask each of us what we learned from the other.

I learned to debate, in order to learn. Pretty grateful for that life lesson.

Obama will just declare border secure and probation is over the first chance he gets and welcomes emancipated new Americans! Now vote Democrat…

It is trying to have it both ways with they “won’t be allowed to vote”, but, “they will be able to work as cheap labor for our big donors”. I am not of the opinion with AP that it is destined to necessarily mean full citizenship. With a crafty and wickedly designed probation plan you could in theory kick out a lot of illegals over time (and that is what it will take), but at the same time do it in a more understated way, one that will be harder to attract attention.

AP is right however, that our current crop of GOP leaders don’t have the brains or skill to pull that off. Frankly they should at this point just pass a bill that

(1) sticks to border security

(2) increases visas/citizenship for people with certain skill sets (like engineers, high tech, like Canada)

(3) make it possible to bring in more Asians (not a tidal wave, but some).

You ask why Asians? The GOP needs to play a little political football with the Dems. Force them to kill a bill that would increase legal immigration, and muddy the waters up by getting the Dems dirty with a certain wealthy minority group that also is not politically active yet. Why are dems against more legal Asian immigration? Is it because they are not on food stamps?

Read back through ALL of his statements he has made on this thread, Cindy.

He makes blanket statements – then when he gets called on them – says he didn’t say what you can prove he said.

(Where I learned debating, that was an automatic disqualification.)

This particular individual is parroting the “Illegal Amnesty” talking point that we can’t secure the border, so we have to DO WHAT NO OTHER COUNTRY IN THE WORLD IS DOING – there is NO logic behind that position, it’s pure Chuck Schumer Reasoning.

We’ve come to the time we conservatives are going to have to choose WHICH path forward to take.

Are you going to be led by the GOPe – who have sold their souls to the GOPe Donor Class?

Or are you going to say, “ENOUGH! Enforce the laws and the Constitution!”

Just as there are liberal operatives on Hot Air, there are also GOPe operatives on Hot Air who are looking to control the message and make sure it fits the GOPe Party Line.

Answer to the “Why doesn’t Hot Air raise these points?” question I posed – because the GOPe Donor Class has brought the GOPe Leaders to heel – which means if Hot Air makes too much noise the GOPe doesn’t like, they’ll be cut off from access to GOPe politicians.

It’s the same approach the Obama administration uses with the MSM.

So we should be looking out for “guest worker programs” as well. Real immigration reform must limit immigration.

Secure the border, now where have I heard this before? If there idea of securing the border is putting up a steel fence that will collapse and fall down from rust in 10+ years because they didn’t budget to maintain it; then they need to come up with another plan. Probation? Both parties are clueless when it come to immigration. Each party wants to pass legislation for different reasons. I see grid lock in the near future.
