Report: There’s a nasty bit of the budget deal that makes tax hikes easier to pass

posted at 10:11 pm on December 11, 2013 by Mary Katharine Ham

Like month-old tuna surprise at my public school, a Congressional budget deal is one that elicits doubt at first glance, a gag upon closer inspection, and full-on dry heaving for days after you get really into the meat of it.

Jonathan Strong at National Review has been talking to Senate sources who say there’s a surprise in here for sure. It’s a bit of procedural jujitsu that’s hard to follow, which is why it’s such a great way to go about a power grab. As Democrats have learned under President Obama, no one cares about egregious power grabs as long as they’re done via sort of arcane procedural maneuvers. The primary hope for preventing, say, the president declaring the Senate in recess when it’s not so he can make recess appointments or enforcing all the parts of the law he calls his legacy used to be the gentleman’s agreement known as lawfulness. Once that’s violated, the strategy is to a) hope someone has standing to sue and three years later wins that case long after the power has been grabbed, which is pretty ineffective or b) that the press will flood the zone so the American people are made to care about a process story. Option b) is how Valerie Plame became a story for the ages or how the filibuster question came to be polled and on the front page of the Washington Post in 2005. Option b) pretty much doesn’t exist under a Democratic president.

So, here we have what looks like another power grab, and one with a prominent conservative’s name on it:

Senate Republicans scrubbing the Ryan-Murray budget deal have come across a little-noticed provision that will limit the GOP’s ability to block tax increases in future years.

The bill includes language from the Senate Democrats’ budget to void a budget “point of order” against replacing the sequester cuts with tax increases.

The process is quite complicated, but in practice it grants Harry Reid the authority to send tax increases to the House with a bare majority, rather than the 60 vote threshold that would be required under the point of order.

The provision has angered key Republican Senators. Reeling from Harry Reid’s unprecedented use of the “nuclear option” to end the filibuster on presidential nominations, they are incredulous that Paul Ryan would have backed another limit to their power.

“This is an appalling power grab that should never have been allowed to be in a final agreement. It’s essentially the ‘nuclear option’ part two, eroding minority rights in the Senate even further. Harry Reid must be very happy,” a Senate GOP aide says.

Read the rest for Strong’s explanation of the procedural intricacies.

Update: A good discussion on Twitter about exactly what this would change and where pressure would come to bear (click through to read the exchange):

Maybe this “Paul Ryan is a genius” crap will stop now.

topdawg on December 12, 2013 at 9:59 AM

Shoddy, shoddy, shoddy.

He have morons on our team. Ryan has revealed himself to be 1) inept 2) a Washingtonian 3) both. There is NO hope for the GOP.

Time to splinter. Let the chips fall where they may. If the Dems run the show for another four years the economy will finally collapse and the ship of state will sink. Then we can rebuild. There appears to be no point in rebuilding as long as the current GOP exists.

Hillary/Ryan 2016!

rogerb on December 12, 2013 at 10:28 AM

Ryan is just another big government Establishment Republican. The only difference is that he sometimes masquerades as a conservative (when he isn’t hanging with his staunch Catholic (pro-abortion) buddy, Luiz Guiterrez.

You are cavalierly talking about the collapse of the USA. When did this become acceptable for conservatives? In my book you and those like you are no better than Harry Reid. Worse, actually, because he makes no pretense about giving a damn.

I was initially suspicious when Obama/Reid/Pelosi stopped referring to Ryan in terms of a wheelchair cliff pusher.

Ryan is one of THEM.

No Child Left Behind, Medicaid Part D, TARP, the auto bailout, one of the leading sponsors of amnesty, the man Slow Joe Biden used as a doormat – that’s Paul Ryan.

Hopefully, you’re a female who swoons over Ryan’s “six pack abs.” That’s about all he has these days.

As I stated in Jazz Shaw’s mewling attempt to explain why the GOP should cave:

LMAO.

Millions of people have had their taxes hiked.

Millions of people have lost their health insurance outright.

Millions of people have seen massive hikes in their premiums.

Millions of people have been tossed out of their jobs and fallen out of the workforce for good.

The annual deficit has exceeded and will continue to exceed a trillion dollars for the near future.

Business after business is closing and stripping trillions of dollars of growth, productivity, and wealth from our economy.

Millions of US citizens are being crushed under taxes and regulations while illegal immigrants get free everything, pay no taxes, and commit crime after crime with impunity.

We’re already splintering. We’re already collapsing. You can’t threaten us with hell because we’re already living in it.

But you and your fellow teat-suckers like Paul Ryan, Jazz Shaw, and John Boehner don’t care about anything but your own power. You don’t care about taxes, or businesses collapsing, or peoples’ lives being upended; you just want to suck on that Federal tit.

And that leads us to this:

Stop pretending to be adults if you are going to whine and cry all the time.

Leave the GOP if you like. Go NOW and never come back. You people add nothing positive at all. EVER. Good riddance. And good luck with your new Lunatic Fringe Crybaby Sissypants Party.

Adjoran on December 11, 2013 at 11:11 PM

Says the Teater with his face buried in the Federal pork trough.

Anyone think Adjoran works for a living? Anyone think Adjoran pays taxes? Anyone think Adjoran owns a business, goes to church, raises a family?

Obviously not, because his response is 180 degrees opposite to anyone who is actually living under the regulatory and legal regime he and his fellow Obama supporters are actually putting in place.

Adjoran is a Teater, a Federal welfare case. My bet is that he’s a mid-level staffer who is terrified that Paul Ryan and other RINOs being primaried will mean he has to work for a living instead of sucking off the Federal teat.

northdallasthirty on December 12, 2013 at 11:05 AM

Glass half full or empty? Seems if it going to take 51 votes to pass a tax increase, 51 votes should be the threshold for tax cuts.

Seems the Ocrats have started boiling the Fillibuster frog one degree at a time, and only on those things that they want. Stuff they don’t want, retains the fillibuster.

It’s sort of like having tire puncture devices on a parking lot for going the wrong way — the wrong way as far as the Ocrats think. And easy to go the Ocrats way for Tax increases.

It should not go unmentioned that the GOP LOSERship appears to be just fine with agreeing to the OCrats keeping a barrier to make it harder for the GOP to achieve anything that might be considered ‘conservative’… tax cuts, program cuts, etc.

drfredc on December 12, 2013 at 1:10 PM

Budget has always needed simple majority – this is tweaking around the edges.

This is why the senate only needs 51 votes to repeal obamacare – it was voted in through the budget process reconcilliation.

No, I’m an American with ancestors in this country to 1628 and the 4th unbroken generation officer in the USN. I’m also sick of self righteous idiots who simply can not comprehend… simply can’t wrap their heads around the fact that in order to have influence in a democratic republic you need to get people elected. I’m someone who as fought tooth and nail against Obama from the onset while the prevailing wisdom that was fed to you from the FOOLS who you still evidently believe was to purge everyone from your little treehouse and sit on the couch on election day if you don’t get your way about everything. YOU WERE WRONG THEN AND YOU ARE WRONG NOW.

What has been done to this country by the Obama administration is inexcusable and it needn’t have happened. The idea that we need more of it is treason. Anyone who believes that bringing about the collapse of the USA to build their own ideal conservative utopia is not only a moron but a POS as well.

Now, go primary Paul Ryan with the next Christine O’Donnell so you can come back here and pat yourself on helping bring about the day when ” the economy will finally collapse and the ship of state will sink. “

What, exactly, do you think we can do to stop the collapse of the USA at this point?

Vote? Paul Ryan was elected, he was even described in THIS article as a conservative republican. If this is the best we can expect from conservative republicans, we may as well be voting for democrats. The result is absolutely the same.

Do you see any hope whatsoever of slowing down, let alone reversing, the overspending? If so, please show me one shred of evidence that anyone up there has both the inclination and the power to do so. You do realize that a nation can only overspend so much, right? Collapse is inevitable for this reason alone.

Or perhaps you believe we can, I don’t know, take it to the streets? What good could that possibly do? The TEA party popularity has hit rock bottom, mostly because the media has been lying about them and trashing them daily for 3+ years. This is the fate of ANYONE who threatens the establishment in DC with any reduction in their control over the population of this country. Ask Sarah Palin about that one.

Is there something else you were thinking we could do to avoid the collapse you so cavalierly dismiss? By all means, enlighten us. And use facts, not just pretty sounding cheerleading ok?

Or perhaps you’re just a coward.

Re.runawayyyy

What, exactly, do you think we can do to stop the collapse of the USA at this point?

Stop being idiots who shoot ourselves in the foot and recognize that we have a gigantic mess to clean up that is just getting bigger and bigger.

Vote?

Get involved. Voting is not the end of the obligation, you have to keep at the people you vote in, mostly because anyone who would become a politician couldn’t make an honest living elsewhere.

If this is the best we can expect from conservative republicans, we may as well be voting for democrats.

He’s not holding a lot of cards. What’s he supposed to do? waive a magic wand and make the Senate and presidency amenable to a conservative budget? You do realize that any budget has to go through the other branches of government which are, at the mount, controlled by full on socialists, right? You did take civics 101 in Jr high school, the whole checks and balances thing? remember that?

Do you see any hope whatsoever of slowing down, let alone reversing, the overspending?

Not as long as we keep electing the likes of Obama. Not if we elect Clinton.

You do realize that a nation can only overspend so much, right? Collapse is inevitable for this reason alone.

Not if it is turned around.

The TEA party popularity has hit rock bottom, mostly because the media has been lying about them and trashing them daily for 3+ years.

Losing winnable elections has nothing to do with it…

This is the fate of ANYONE who threatens the establishment in DC with any reduction in their control over the population of this country.

Which “establishment” exactly?

Is there something else you were thinking we could do to avoid the collapse you so cavalierly dismiss? By all means, enlighten us.

Yes, Again, stop being idiots. Stop thinking that you can purge your way into power. Stop thinking that losing elections will somehow teach people a lesson. Stop whining about the media and that life isn’t “fair” because anyone past the age of 12 is already supposed to know that already.
We will be in a position to get better budgets when we get more representation in government and you get that by following the Buckley rule: Support the most conservative candidate who is electable. Provided we haven’t purged people like Paul Ryan because he had the audacity to tell people like you something that you don’t want to hear then yes, even this mess can be cleaned up.

If you don’t think so, you owe it to yourself and the rest of us to leave, go find someplace else to live.

It was a simple question I asked.

I have a life and obligations outside of Hot Air, sorry for the delay.

Re the genuine idiot.

Or so says the Teater

Look at you, someone taught you a new word and you are going to find a way to shoehorn it into every other sentence! Atta boy! Someone should buy you a word of the day calendar so folks don’t confuse you with a parrot.

who is screaming and crying that we shouldn’t fight

Great how you have taken away the exact opposite meaning from the clear words that I have written.

and that we should let the opposition have its way on everything.

Reading that hard for you, huh? Write “teater” again, that signifies that you are clever in your mind, doesn’t it?

It is precisely because I believe in what this country represents that I am fighting

Fighting? My guess is that your idea of “fighting” is sitting on the couch all day eating Cheetos and wondering why your d!ck is orange. I have contributed money, time, effort to keep Obama and his ilk out of office, often in the face of loud mouth idiots who preach capitulation because they haven’t gotten everything they wanted out of a candidate. You think you have “fought”? Rent a van, drive to a battleground state and try to lure senior citizens to the polls with frigging tapioca pudding as I have done and we’ll talk. That and a million other examples are a lot harder than b!tching ion the internet

You refuse to fight, roll over for Obama, and then stab in the back those who are fighting.

Idiot. Whining on Hot Air that everything isn’t perfect for you isn’t “work”. Nothing here, NOTHING you do here is “work”, you are just kidding yourself if you think otherwise..

Teater and government parasite. That’s all you are.

I don’t work for the government, idiot. I don’t take a nickel from them. Indeed, my taxes probably buy your Cheetos.

Fail. In every way.

You were asked how we could slow down or reverse this spending spree that is, in fact, unsustainable. Your answer? Elect the most electable conservative. You mean like Paul Ryan? We did that. Fat lot of good it did.

The overspending that occurred under Bush made the democrats salivate with anticipation. Do you know why? Because if republicans could get away with that level of irresponsibility, just IMAGINE what the people (and the media, who whined daily about the Bush overspending) would let democrats get away with. See, everyone KNOWS democrats are irresponsible with taxpayer dollars, so it would be no surprise (and apparently, no big deal). So obviously electing electable republicans isn’t going to fix the fiscal situation. But then you knew that.

You just like acting like a big (anonymous) man on the internet, bullying anyone who disagrees with you when they point out perfectly reasonable facts you don’t like. You have no argument against the coming collapse, you just prefer to put your hands over your ears and yell LALALALA. The adults will prepare.

Bugger off, child.

runawayyyy on December 13, 2013 at 12:17 PM

One of the key taxes I have seen highlighted that will result from this bill is how airlines will add yet another tax to fliers.

The answer to this is simple – People should unite together and STOP FLYING. You wuldn’t have to do it for a prolonged period of time…1 day…1 week….the Airlines would go insane as the impact would be immediate.

The sad thing is that it would never happen because people hate to be inconvenienced. The NSA Spying on of all Americans right now, violating our Constitutional Rights, is a great example. Are People outraged? H#LL YEAH! Are they outraged enough to take some action that might inconvenienece them a little? H#LL NO!

Read the story of our Founding Fathers and how much many of them sacrificed – jobs, homes, family members’ lives, and even their own. They loved this country and were determined to protect this nation to the point where they were willing to lose everything – including their lives. Today’s ‘Americans’ are not even willing to be INCONVENIENCED 1 DAY!

We’ll b!tch up a storm…but we won’t sacrifice anything while our nation is desroyed in front of our faces.

My oparents were part of a generation called ‘The Great Generation’, named so because they, like our Founding Fathers, were willing to work themselves to death, do without, and sacrifice everything for this nation to survive and thrive. Today’s generation is willing to drive the nation into complete destruction as long as they can suckle off Big Government’s teat and get as much for free as they can until the moment it collapses and goes under!
