Holiday news dump: WH to delay online ObamaCare exchange for small businesses for one year

A little something new to introduce into the dinner conversation tomorrow if/when one of your guests starts reciting OFA talking points. You might want to start making a list of your own, frankly. There’s a lot to talk about.

Gabe Malor notes that this will, conveniently, move the debut of the SHOP exchange until after the 2014 midterms, just in case they still don’t have their act together technologically a year from now.

Small businesses have been able to apply through paper applications since Oct. 1, and HHS will announce alternative sign-up methods, like enrolling through an agent or broker or directly through an insurer.

“We’ve concluded that we can best serve small employers by continuing this offline process while we concentrate on both creating a smoothly functioning online experience in the SHOP Marketplace, and adding key new features, including an employee choice option and premium aggregation services, by November 2014,” according to the HHS notice.

It’s not clear to me whether they gave up on SHOP because they couldn’t figure out how to build it or because they’re too busy trying to figure out how to build Healthcare.gov to try. Been a long time coming, though: WaPo notes that this is the third delay to the small-business exchange in seven months. After reading this recent NYT piece, I was under the impression that most or all of the unbuilt parts of the ObamaCare exchange were postponed by HHS in the last few weeks before launch as a matter of triage, so that they could devote themselves fully to repairing the individual exchange. Nope: Per WaPo, the feds announced in April that they wouldn’t be rolling out the “consumer choice” feature on the small-business exchange until 2015. (That would have allowed employees of small businesses to compare and purchase plans being offered by their employers online.) Then, in late September, they announced that the entire exchange would be delayed until this month. In hindsight, that was a blaring siren that they were already in triage mode on Healthcare.gov shortly before launch. Now it’s almost December and a decision had to be made: Result: See you in December 2014.

Question: Is there any reason apart from the political one flagged by Gabe to delay SHOP for a full year? At first I thought maybe they’d concluded that they can’t possibly build the small-business exchange before the March 31st deadline for enrollment, in which case why bother trying? But that logic doesn’t work. Enrollment on the small-business exchange is year-round; there’s no March 31st deadline, so even if the site wasn’t ready until June or July, it’d still be useful to some businesses. Something like 80 million employees are going to find their plans canceled sooner rather than later and it’d be nice to have SHOP available when they do, since they’re not all headed to the individual exchange. Or are they?

WILLIAMS: Me having health insurance on January 1st is better than me not having health insurance at all.

The question is, did he have health insurance last year, and why does he need to shop on the exchange to get it this year? Was his plan cancelled? Did he simply not have insurance by choice but must now by law? Seems like he’s a poster child for a “Screwed by Obamacare Too” campaign.

Regardless the businesses will begin preparing for the Obamacare employer mandate as early as June 2014 if not earlier… Firing employees, reducing employees hours below 30 a week, and reducing their healthcare benefits greatly… Tens of millions will be badly hurt…

They are scared $hitless. It won’t do them any good though. There are a lot of US Companies that operate on a fiscal year with some in July and some in October and they plan out the following year way ahead of those dates and insurance companies know this and will have the new rates for them and their employees just in time for the November elections.

It won’t be like the OMB telling business to ignore the law like they did about the shutdown, that can’t work this time.

Employers are not going to wait till November 2014 to avoid the Obamacare disaster… They have to prepare way ahead of time before the actual enrollment or non-enrollment of their employees in November 2014… They need to prepare their budgets and payrolls way ahead of time… They will start as early as June 2014 if not earlier firing employees, reducing employees hours below 30 a week, and reducing their healthcare benefits greatly

I work for a large employer and they begin the healthcare policy process beginning in late May to early June.

The more Obama delays this part of the law and that part of the law just will make insurance premiums go up when the policies do finally get issued.

Health Insurance companies are corporations owned by stockholders and they have to make a profit or they go bankrupt and go away.

The more delay and confusion Obama and HHS create will make the Insurers jack premiums up because they have no clue what it is actually going to cost them by the time they sell the policy with all of this turmoil, so they have to put a fudge factor in their to hedge against losses.

Obama does not understand anything about dealing with private business, and he apparently doesn’t care what he does to them.

I think this one might actually get brought to court. Unlike the employer mandate suspension (by which businesses clearly wouldn’t be harmed), the delay of the small business exchanges makes it difficult for businesses to shop for plans. This injury will give them standing. Since it’s a statutorily created utility, they can bring suit this time.

Assume a person is allowed by a state insurance commission and an insurance company to buy a plan that does not include all the ACA federal mandates. Then assume that the policyholder files a claim for a mandated service which is not covered by the policy. Will the courts side with the policyholder based on the legal mandates or with the insurance company based on the policy?

The fact that Obama got a bureaucrat to write a letter saying that the government will not enforce the law may not sway a judge in case of litigation.

Boehner is the Speaker of the House of Representatives. Whether he or any GOPer voted against ACA it is the law of the land and he should immediately petition SCOTUS to issue an order requiring Barky to see that the law is carried out AS WRITTEN. Failure to obey that order is a clear high crime.

If any justice remains in the world (I know, that’s a big if)lawsuits will not only be filed but will succeed. I’m not so sure that this delay would qualify though. It seems to me a business (or employee I would hope) would have to prove harm by the exchange not being available (perhaps someone has a better understanding?). As long as the clown party at HHS offers some kind of alternative to purchasing on the exchange I’m not sure you could make that argument fly, depending on what alternate means to purchase are available. Still sucks for the millions that will be tossed because of this POS scheme.

Small business preparations for the mandate have already begun (cut workers, cut hours, dumped employees into the exchange). That will continue this year. Businesses will inform their employees months before the election if they are going to cancel their insurance or have reductions in workforce or hours.

Obama and his Dem’s are so used to having most, if not ALL of their constituents on the public dole so…. as long as they got they iPods, iPhones, EBT cards, extra cash for the casino’s and dance clubs, free housing, free utilities, free day care, free birth control? They ain’t worried about when their next “freebee” will arrive.

Oh the optics…

First, Obama / Reid force a government shutdown. Then they blame the shutdown, with the assistance of the lapdog media, on the GOP because they are insisting that Obamacare get’s delayed (all treated equally as opposed to just Obama’s special interest friends) or repealed.

Then the EpicClusterFark rolls out to the biggest technology flop since Microsoft brought out Bob.

Since that point, we’ve seen nearly daily details of new massive clusterfarks and lies from Obamacare – to the point where nearly 6 million have lost their coverages – and the replacements aren’t affordable at all.

Now, in the face of an electoral disaster that could make 2010 look minor, Obama is rushing to unilaterally delay as much as he possibly can until after the mid-terms combined with giving even more breaks to special interest groups needed to support his caucus in Nov 2014.

The Congressional GOP leadership needs to call the President on his ability to unilaterally change the law – while prepping commercial after commercial highlighting these Presidential confirmations that the EpicClusterFark is really an EpicClusterFark.

It seems to me that with all these delays and exemptions for Unions that dear leader is making changes in taxes and this is the sole province of the House of Reps.
