Video: WH argued in court that majority of group plans would end despite grandfathering

We actually saw this three weeks ago from Avik Roy at Forbes, who perused the federal register and discovered that HHS noted quietly that the new mandates from ObamaCare wouldn’t just impact the individual market.  They estimated that as many as 93 million Americans will lose their existing group plans provided through their employers, making mince meat of the “you can keep your plan” promise from Barack Obama — made repeatedly even after the HHS commentary.  Andrew McCarthy upped the ante by finding a brief filed by the Department of Justice in Priests for Life v HHS that not only acknowledged that reality, but argued it in court:

It gets worse. My friends at the American Freedom Law Center (on whose advisory board I sit) are representing Priests for Life, a group aggrieved by Obamacare’s denial of religious liberty — specifically, the ACA’s mandate that believers, despite their faith-based objections, provide their employees with coverage for the use of abortifacients and contraceptives. On October 17, the Obama Department of Health and Human Services, represented by the Obama Justice Department, submitted a brief to the federal district court in Washington, opposing Priests for Life’s summary judgment motion. On page 27 of its brief, the Justice Department makes the following remarkable assertion:

The [ACA’s] grandfathering provision’s incremental transition does not undermine the government’s interests in a significant way. [Citing, among other sources, the Federal Register.] Even under the grandfathering provision, it is projected that more group health plans will transition to the requirements under the regulations as time goes on. Defendants have estimated that a majority of group health plans will have lost their grandfather status by the end of 2013.

HHS and the Justice Department cite the same section of the Federal Register referred to by John Hinderaker, as well as an annual survey on “Employer Health Benefits” compiled by the Kaiser Family Foundation in 2012.

So, while the president has been telling us that, under the vaunted grandfathering provision, all Americans who like their health-insurance plans will be able to keep them, “period,” his administration has been representing in federal court that most health plans would lose their “grandfather status” by the end of this year. Not just the “5 percent” of individual-market consumers, but close to all consumers — including well over 100 million American workers who get coverage through their jobs — have been expected by the president swiftly to “transition to the requirements under the [Obamacare] regulations.” That is, their health-insurance plans would be eliminated. They would be forced into Obamacare-compliant plans, with all the prohibitive price hikes and coercive mandates that “transition” portends.

Obamacare is a massive fraudulent scheme. A criminal investigation should be opened. Obviously, the Obama Justice Department will not do that, but the House of Representatives should commence hearings into the offenses that have been committed in the president’s deception of the American people.

Last night on The Kelly File, McCarthy called this deception “about as insidious as it gets”:

As I wrote at the time, this shows that the real damage from the ObamaCare rollout has yet to arrive.  Thanks to the delay in the employer mandate, those plans won’t change until 2015 — but that means insurers have to force people out of their existing plans by the time open enrollment for 2015 starts, which is October 2014.  That will just be a few weeks before the midterm elections, and the resultant outrage over the disruption of existing coverage will make the last few weeks look like a minor kerfuffle.

Yes. As bad as this has been for the regime, multiply it by at least 10 next year. Rates, up front high deductibles, out of pocket costs, disappearing doctors all will be know by then. Then the group and employer plans get cut.

And higher rates in 2015 than 2014.

As bad as it is now. It will continue to do nothing but get worse.

The employer mandate just forces companies with 50+ employees to offer health insurance or pay a penalty per employee. That was the only part delayed from up high. The Obamacare minimum coverage standards have already been baked into employer-sponsored plans for 2014 (I know my company’s plans were already made compliant). Am I wrong about this?

The vast majority of employers renewed their policies sometime between last September and this coming December. That means the minimum coverage mandates won’t effect these policies. When group renewals start next September the shiite storm really starts. Couple that with the employer mandate and watch as 1/3 of all employers who offer their employees insurance stop doing so. And for everyone there will be major cost spikes, much of which will be passed down to employees.

Employer-sponsored group plans (what most people have for medical insurance), do not have to meet the requirements of ObamaCare until CY 2015. This is the “employer mandate”. The individual mandate has already struck, and left millions without insurance.

Under the definition of “plans that changed and are no longer grandfathered”, merely changing the premium amount is sufficient to lose its grandfathered status.

Any plan you have, that changes in any way, will be cancelled. Period.

Also when it comes to the employers mandate the employers will begin adjusting for the law much earlier than October 2014… In other word the firing of employees, or the reduction of their weekly hours below 30, or the reductions in their benefits will begin as early as June 2014 if not before that and continue for the remainder of the year… The suffering that we are seeing now is only the beginning and it is going to get much worse for tens of millions of people and starting no later than June 2014…

I know that insurers around here have been trying to let employers change their renewal dates to Nov/Dec so they can stay on their current plans as long as possible. I was also told that 95% of my agents clients saw rate increases for 2014, and that increases will be a definite for everybody in 2015.

At least 93 million will lose their existing coverage – and all of this is according to plan, not accidental.

That’s what makes the President’s lie, ‘If you like your insurance, you can keep your insurance…’ one of the most blatant, mendacious, callous, and despicable lies foisted on the American people in the history of the office of the President.

We had a callous and insecure President resign over lying about his efforts to cover-up a third rate failed burglary – which only affected him and his closest advisers.

Our current President has not only lied where people died, but now has lied to foist a government seizure of 1/6th of the national economy and negatively impact easily 100 million Americans.

That this President still has defenders should be an affront to all – including the members of his own political party.

What’s fascinating as well as frightening is that as the rotten onion keeps getting peeled back we’re discovering not only the extent of the criminal conspiracy in the White House but the astonishing inability of the Republcian party to address the unfolding magnitude of this story and crime.

I firmly believe the republicans are just as terrified as the democrats of all this. They simply cannot handle the burdens of their office in this respect and tremble before the dawning realization of this governmental failure. They will have a massive psychological meltdown before they pursue any serious charges against Obama.

This is why I predict that this story will be over with in six months. I mean it, over. That is, it will continue to seethe and boil beneath the surface and in the country, but the media will stop reporting it and the republicans, except for pathetic little skirmishes here and there to mollify the base for 2014, will essentially give up trying to get to the bottom of it. Obamacare will be a fait accompli and just shut up and deal with it.

I have already been forced out of my old employee plan. The old plan had premiums of $184 per month, and a $2500 deductible. The smart and sexy new Obama compliant plan is $400 per month and a $6000 deductible.

I believe if the premiums just changed $5 (could have been $15, that was a change.

One change was if a woman was at “child bearing” age, they had to have maternity care, even if she had a hysterectomy, or was incapable of child birth, she had to have maternity care in her health plan.
And ironically, “Maternity care” included abortion.

It is so bizarre, that you would have to actually have had to pass it to actually believe what was in it…

The amount reported does not affect tax liability, as the value of the employer excludible contribution to health coverage continues to be excludible from an employee’s income, and it is not taxable. This reporting is for informational purposes only, to show employees the value of their health care benefits.

No. But that’s an approach that should be proposed and discussed. It’s a very expensive element of compensation anymore. Why shouldn’t it be taxed? The positive part of it is that people would become more cost conscious about health insurance costs and healthcare costs.

The idiotic thing is, they thought they were pulling a fast one by delaying the employer mandate past the 2014 elections.

They didn’t think about the notification period required for open enrollment.

The most incompetent bunch of “elites” I have ever seen. We can actually be thankful for that.
