ABC affiliate: Filner in mediation that may include resignation

I’d call this breaking news, except that everyone knows this is the end game anyway … or at least, everyone but Bob Filner.  With an avalanche of lawsuits and graphic sexual harassment claims becoming public and a recall effort under way, there isn’t much else to mediate except the exit strategy:

Two inside, anonymous sources told Team 10 Mayor Bob Filner’s attorneys were in a mediation session Monday morning with City Attorney Jan Goldsmith and LA-based attorney Gloria Allred.

One of Team 10′s sources said the meeting was scheduled for late morning, with no set end time.

Another source said a retired federal judge is presiding over the mediation, which was designed to include a review of a potential resignation by Filner.

No one knows for sure who’s in the meeting. Two city council members are in the building, and may or may not be participating in the talks, but it’s not clear what other business would be more pressing for San Diego at the moment.

Meanwhile, the petition drive to recall Filner will proceed until events make it unnecessary:

Armed with clipboards and pens, volunteers hit the streets of San Diego to collect signatures they hope will lead to the recall of embattled Mayor Bob Filner.

“We’re going to be everywhere. We’re going to be at sporting events. We’re going to be at street fairs, arts shows — you name it, we will be out there,” Dave McCulloch, a recall organizer, told CNN affiliate KFMB on Sunday.

Filner planned to push back with a public campaign today, at least until the mediation meeting took place.  It’s in the same kind of taste that Filner’s conduct exemplified, emphasis mine:

But while recall proponents scrambled to procure more than 101,000 signatures by September 26, Filner supporters planned a “We Will Not Be Silent” rally outside City Hall on Monday.

Wow.  Just a tad bit Orwellian, eh?  The odds of the pro-Filner campaign succeeding in rehabilitating his image are as slim as they are in good taste:

But the outrage is overwhelming. Roughly 81 percent of city residents want him to resign, according to a poll conducted by CNN affiliate KGTV. Another affiliate, KFMB, reported local radio hosts hired skywriters to spell out “Surrender Bob” over areas of the city last week.

Filner has been adamant so far that he would not resign.  However, according to CNN, the city attorney might file a restraining order to keep Filner from returning and continuing the “hostile work environment” his harassment creates.  That sounds like a long shot, and a bad precedent to set; any city attorney who has a political agenda could run that kind of attack against a duly-elected executive to run them out of office whether the complaints are legitimate or not.  However, the threat of it might be enough to get Filner to resign through mediation, if not the probability of success in the recall effort with those poll numbers.

Skywriting is done by one plane that can generally write up to six characters, with a skilled pilot at times maneuvering upside down as they decide when smoke is needed for the letters. Five to seven planes are needed for longer messages (up to thirty characters) so that the entire message is visible at once.

It’s a given that San Diego is going to be forced to pay out millions in settlements and legal fees. The recall is well underway. What does Filner have at this point as leverage in mediation?

At this point, any mediation by Filner is simply to secure his financial future. No sexual harassment lawsuits, and a pension or buyout. So another lousy Dem will stick the citizens for more money, even when caught red-handed. It’s the way Dems work.

I see no need for Filner to resign – after all, this is California we’re talking about. All Filner needs to do is go gay, and promise to only grope men from now on – this would instantly give him “protected ” status, and dramatically expand his liberal support base, and increase his popularity.

Slight correction: KFMB has long been a CBS station- I’ve never heard of them allied with CNN over anything. Of course, that doesn’t mean they don’t share stories.

It’s a rather unique situation. You don’t often have a sitting large-city mayor who has been credibly accused of sexual harassment. The real problem for Filner is he has a long history of this, strong verbal abuse and outright bullying (which he was convicted of when he tried to get his way on a commercial flight a few years back). The “hostile work environment” isn’t some imagined slight by one or two people decades ago. I think I trust Goldsmith on this one. Both sides of the aisle- for differing reasons, natch- know full well Filner has to go.

San Diego is broke, it cannot afford unlimited Gloria Allred lawsuits. Goldsmith is right to bar Filner from his office, as the hostile working environment is well established and so the city’s liability for any future harrassment would be substantial.

Surely they are not going to give Filner any kind of a pension, he’s only been Mayor for 6 months and has a sizable Congressional pension coming to him.

The problem with the hostile work environment issue is that it can be proven as fact. Perhaps they will negotiate a settlement that would stipulate he absorbs his own legal fees in defense of the anticipated cases. However, since the plaintiffs can establish actual and constructive notice on the part of the DEMOCRATIC PARTY, that exposes the DNC and everyone else associated with this filthy Creepy McCreepster.

When I was assigned in DC, one apparent aspect of the Congressional Office Buildings was the front office women our elected employed. I suspect that Filner hired many of the same young, dedicated female campaigners. Odd that no “Investigative Report” has sought information from these women? You don’t think a (then) 50 something Bob pressed his interest on any of the 20 something women in his staff employ? Come forward? Difficult for those attractive, bright women who often married the DC potential power elite or moved up and on within the realm of Washington influence. Those now 30 and 40 something women have lots to tell. Maybe one will? Does any reasonable person think our Bob did not put those girls through his normal “gymnastics”? Putting up with Bob was part of the job description. Wouldn’t be hard for a reporter to discover who was in his employ for those 10 terms. Worst case, a nasty looking 18 year old with the filner smile….ugg.
