McCain: States should take another look at Stand Your Ground laws

This starts off with Candy Crowley pressing John McCain to explain how the verdict of the George Zimmerman trial provided justice to Trayvon Martin’s family. Instead of explaining how courts of law work on reasonable doubt, McCain instead tells Crowley that no one has proved that the jury was corrupt, which is … a rather large non-sequitur, and a hint that McCain didn’t pay much attention to the trial in the first place.  An even bigger hint is when McCain brings up Stand Your Ground laws, which had nothing to do with the lethal-force decision in the shooting, but has become the favorite political escape hatch in Washington DC since the verdict.

Ah, well, any port in a storm:

John McCain urged all states with Stand Your Ground laws to review them in the aftermath of the George Zimmerman trial.

“I can also see that Stand Your Ground law may be something that needs to be reviewed by the Florida legislature or any other legislature that has passed such legislation,” McCain said on CNN’s State of the Union this morning.

He said that he was “confident” Arizona state legislators would look at the law again “because it is a very controversial legislation.”

All SYG laws do is remove the positive requirement to retreat before using lethal force where one reasonably fears the loss of life or grave bodily harm.  If the possibility of flight is removed at that point — as it was in the Zimmerman case, where the defendant argued (and the jury believed) he was pinned to the ground — then SYG is moot.  At that point, the basic laws of self-defense apply, not SYG, even though as Jazz argued yesterday in his post, SYG is really just a rational form of self-defense.

Basically, this is just an easy way for Capitol Hill denizens to pander a bit while retreating themselves.  There isn’t a single state that will review SYG laws on the basis of the blather, including McCain’s Arizona, and don’t expect McCain to even float the suggestion of repealing it when he’s back in his home state.  Right now, it’s the politically-correct response to any Zimmerman-Martin questions, but in a month no one will be talking about SYG at all.

I can’t believe we nominated this guy to go up against Obama in 2008. If Mccain is going to echo all of Obama’s talking points, it’s hard to see what difference it would have made to elect him.

Oh, right. We’d have had the same creeping socialism and we’d also be in Syria now.

I am now entertaining an unspeakable thought — that’s it’s better for the country that Obama won than Mccain did. The fact that I would entertain such a blasphemy, even for a moment, speaks to the measure of my disappointment with the man.

Either way we were screwed. The political fortunes of both men were orchestrated by the media to serve their purposes. It was a win-win for them. It merely goes to show just how corrupted the political process has become in this country.

I can’t help but think that’s the main reason Palin withdrew from running. This guy’s elevation to front runner status confirmed that to me.

“Street thug?” Trayvon had a tattoo, got in a few fights and smoked pot. I’m pretty sure this describes the behavior of a significant number of white teens. Are they all “street thugs?” The racism and hypocrisy is so intense. Oh well…..We are just going to keep organizing.

You left out a few things. Besides the fights (including punching a bus driver) and pot smoking, Trayvon was also a heavy user of the street concoction known as “Lean” or “Purple Drank.” It’s a codeine-based drink made with cough syrup, Skittles, and AZ Ice Tea brand Watermelon Fruit Punch.

“Lean” has been shown to cause aggression and paranoid behavior in users. Trayvon Martin was quite fond of “Lean” and drank it often, to the point that his autopsy showed liver damage (in a 17 year old!). BTW, does anybody believe the story told by the Martin parents, that Trayvon was buying the Skittles for his “little brother”? If so, I have some lovely oceanfront property here in AZ that I’d like to show you . . . .

In addition to his fights and drug use, Trayvon had also been suspended from school for multiple violations. After one incident in which he defaced school property, a school cop searched Trayvon’s backpack and found about a dozen items of women’s jewelry and a flat-head screwdriver (described by the school cop as a burglary tool). When questioned, Trayvon claimed that the jewelry had been given to him by a “friend,” whom he refused to identify. The school suspected Trayvon of burglary, but decided against reporting the suspected crimes to police, to keep the school’s crime numbers down. Also, Trayvon’s social media sites showed (before they were sanitized) that he was in the process of attempting to obtain a handgun.

I’ve read lots of comments here in the last week echoing Rush’s comments regarding Rachel Jeantel’s interview with Piers Morgan concerning her calling Zimmerman a creepy ass cracker (or is it cracka?). When I first heard about that, I thought it sounded an awful lot like an after-the-fact attempt by Jeantel to come up with a justification for the theory that Martin was afraid of Zimmerman (since the prosecution presented no evidence to that effect in the trial). So, I went back and watched Jeantel’s trial testimony. At trial, she testified that Martin laughed off her suggestion that Zimmerman might be a rapist. So, as I suspected, Jeantel’s suggestion in her interview with Morgan that Martin was afraid that he was being followed by a gay rapist was just another of her abject lies.

Oh, yeah, and McCain is a fool who obviously knows not of what he speaks.

Let’s address this false premise right away: the only way you can “seek justice” for someone is if they have been wronged; TM’s family was not wronged. Therefore, “seeking justice for the Martins” is a total strawman.

Let’s remember to add in there, “when in a place they are legally authorized to be” and “not breaking the law”. This is for all the morons (TimeLord, looking at you) who will come up with some hypothetical about how a bad guy can break the law then shoot his victim and claim SYG. Those are elements of the law and should not be forgotten, especially when the progressives are sniffing about.

Since it wasn’t claimed by the defense, it *is* irrelevant. If the judge tried to bring it in, fine, but the case was never made on SYG. Ever. BTW, does this mean you can claim that GZ might have been a child abuser, since the persecution prosecution brought it up in court?

McCain just isn’t very bright. It was no accident that he finished at the bottom of his class at Annapolis, and crashed several of his planes.

As for why he keeps getting re-elected, McCain is the poster boy for the value of incumbency (as well as marrying money). He has a deeply entrenched organization here in AZ, and it is very difficult for any other candidate to effectively challenge him.

Tracy Martin wasn’t at home that night. He didn’t find out until the next day that Trayvon never came home. Sybrina Fulton lived in Miami, where Trayvon had been living for a while, after the break-up of Tracy Martin’s latest marriage. Fulton had thrown Trayvon out of her home after his most recent suspension from school. That was why Trayvon had ended up in the Sanford home of Brandi Green, one of Tracy Martin’s baby-mamas.

Despite Trayvon’s behavior the night of his death, it’s hard not to feel sorry for this kid. He was reportedly bright, and may have been able to make something of his life, if he had had parents willing to make the effort to provide him with a stable home life and some guidance.

Violence begets violence, or something like that. All victims everywhere should be required by law to turn their backs and run away when confronted by rapists, murderers and various other bad people. This will make everyone everywhere safer while at the same time making the rapist’s and murderer’s job so much easier.

You are correct. A major factor in this incident and the general situation of the black community is the destruction of the family unit. This is due in large part to the policies started by LBJ. The Great Society and The War on Poverty. Both designed to keep them voting Democrat for the next hundred years. The destruction of an entire group of people all for the sake of some votes. John McCain urged all states with Stand Your Ground laws to review them in the aftermath of the George Zimmerman trial.

Florida did. No changes.

The fact of the matter is that I’m beginning to hate anybody who is out there suggesting that George Zimmerman somehow beat the justice system. Despite the heavy-handed bias of state officials, Zimmerman was tried and aquitted of manslaughter charges. To suggest that justice was somehow circumvented since Trayvon Martin’s despicable parents didn’t get their pound of flesh is just wrong.

The correct answer to Crowley’s question is that George Zimmerman was found not guilty of Trayvon Martin’s death. Therefore, the parents need to accept that Trayvon’s death is not Zimmerman’s fault.

The reason he’s dead is because he attacked a man who was armed and able to defend himself. You can blame society as a whole, or his parents for not raising him better, or the culture he grew up in for encouraging drugs and violence.

But blaming society is a cop-out, and while it’s indisputable that his parents failed to teach him to be law-abiding and nonviolent, it appears they were at least trying. And to blame the culture he was in is to attempt to absolve him of all responsibility.

The only person to blame for Trayvon’s death is Trayvon himself.

I can at least understand why his parents might have a hard time accepting that. But the rest of the world doesn’t have that excuse.

Only in the sense that the jury instructions said Zimmerman did not have a requirement to retreat. Since Zimmerman never had the opportunity to retreat, that clause made no difference at all in the trial. It is, therefore, completely irrelevant.

A few fights? The last fight involved him pounding someone’s head into the concrete, and being shot in self defense.

Even when you try to defend him, you can’t twist away from the fact that Trayvon loved to fight and attacked Zimmerman.

And yes, assaulting people is being a street thug. Whether you’re white or black. And when you’re acting like a street thug, you tend to die like a street thug. We can regret the death without trying to pretend it was unprovoked.

The guilty party for Trayvon’s death was … Trayvon. No wonder his parents didn’t get justice from a trial for George Zimmerman.

My Grandsons are mixed Asian/Caucasian. Their mother is Burmese (legally immigrated naturalized US citizen). Right after the first one was born I was visiting and a couple of my Daughter in law’s friends came in. They were from Burma but they were actually Chinese. One of them asked me if I thought that the child have problems because he was Asian? I put on a confused expression and replied “Why no. I don’t expect that he’ll have any problems at all because he’s not Asian.” She asked “Oh, what would you call him?”

I answered “American. Red blooded, apple pie eating American through and through.”

This effectively ended the conversation. Trust me you haven’t seen racial prejudice until you’ve gone outside the US. We’re amateurs compared to a lot of places.

I have 2 nieces that are also Asian/Caucasian. Their mom is originally from Hong Kong. Prior to have kids-my brother-in-law and sister-in-law live in Japan for a few years. He said that many natives were VERY racist against non-Asians.
