Video: The media’s got a fee-vah and the only prescription is complaining about “Stand Your Ground” laws

A nifty medley from Andrew Johnson at the Corner of our media collectively deciding what social justice now requires after the Zimmerman verdict. (Dick Durbin announced just this morning that he’ll be holding a Senate hearing on “stand your ground” laws, on the theory, I guess, that state legislatures are somehow incapable of doing so themselves.) Anyway: Is it true, as many supporters of the verdict have claimed, that “Stand Your Ground” had nothing to do with the outcome of the trial? Well, yes. And no. But also yes.

Had he chose, Zimmerman could have demanded a “Stand Your Ground” hearing in the pre-trial phase. If the judge had ruled in his favor, the charges would have been thrown out. He waived his right to that hearing, which means the media obsession with SYG is a total non sequitur, sort of like their obsession with gun laws post-Newtown that would have done zip to stop Adam Lanza. Right? Not exactly. The concept of standing your ground, i.e. having no duty to retreat when force is being used against you, is also part of the general self-defense law that Zimmerman did successfully invoke in being acquitted. From the jury instructions:

If George Zimmerman was not engaged in an unlawful activity and was attacked in any place where he had a right to be, he had no duty to retreat and had the right to stand his ground and meet force with force, including deadly force if he reasonably believed that it was necessary to do so to prevent death or great bodily harm to himself or another or to prevent the commission of a forcible felony.

Thirty-one states impose no duty to retreat on someone before they’re allowed to use force in their own defense versus just 19 that do. But wait — how do we know that SYG actually factored into the jury’s deliberations and affected the outcome? Just because the judge charged it doesn’t mean it mattered in the end. Well, thanks to juror B37, there’s circumstantial evidence to think that it did:

Juror B37: After hours and hours and hours of deliberating over the law, and reading it over and over and over again, we decided there’s just no way … because of the heat of the moment and the Stand Your Ground

Cooper: Even though it’s he [Zimmerman] who had gotten out of the car, followed Trayvon Martin, that didn’t matter in the deliberations? What mattered was those final seconds, minutes, when there was an altercation, and … in your mind the most important thing was whether or not George Zimmerman felt his life was in danger?

Juror: That’s how we read the law. That’s how we got to the point of everybody being “not guilty.”

Cooper: So that was the belief of the jury, that you had to zero in on those final minutes/seconds, about the threat that George Zimmerman believed he faced?

Juror: That’s exactly what had happened.

That’s just one juror’s read on the situation, not all six, but obviously SYG did make it into the jury room. The question is, would the verdict have been different if Florida law imposed a duty to retreat instead? I’m thinking probably not. If you believe Zimmerman’s version of the fight, which the jurors apparently did, Martin ambushed him with a punch, knocking him to the ground, and then jumped on top of him to continue the beating. There was no opportunity for “retreat,” a point also made by Jacob Sullum at Reason. The duty to retreat affects the outcome here only if you extend the concept of “retreat” temporally to apply before there was any confrontation. I.e. Zimmerman got out of his car to keep an eye on Martin, ergo he’s guilty of manslaughter for not letting the other guy bang his head on the concrete subsequently. Is that a more just result? Does it matter, for that matter, that even “stand your ground” laws don’t apply if the person claiming self-defense is found to have provoked the use of force against himself? How far does the left want to stretch the concept of “retreat” here?

Don’t take any of this too seriously, though. Like I said yesterday, the SYG outcry is less about the particulars of the Zimmerman case and more about giving liberals something to rally around for the midterms when the DOJ inevitably decides not to prosecute Zimmerman. This is politics.

The left has one over-riding goal(now that it has enough power with its success at bringing down our culture with moral degeneration and tainted candy) and that is their obsession with removing the guns from the hands of free men. Until then, they understandably hesitate to expose their real souls and do to us what they have sought for decade to do.

Obama has stirred the cauldron of hate again today. He said, in regard to Trayvon Martin, “That might have been me 35 years ago.” and he, too questioned the Stand Your Ground laws.

Trayvon Martin had options. He had a working cellphone. If he felt threatened, at any time, he could have called his father. He could have called the police. He could have simply kept walking and went to his father’s girlfriend’s townhouse. He could have simply stepped into the light and asked George Zimmerman why he was following him.

Instead, he chose to lurk in the bushes, under the cover of darkness, and attack George Zimmerman, knocking him to the ground, breaking his nose, sitting astride him while he banged Zimmerman’s head into the concrete, reaching for Zimmerman’s pistol, which culminated in George Zimmerman shooting him in the chest.

I’m confused, frankly, by Obama’s statement. Is the first White African American president saying that he, too, was predisposed to violence as a young man? Or perhaps Obama is suggesting that Trayvon lacked the intellectual resources to use a cellphone and ask for help from the police or his father, and that he, too, lacked (or lacks)such resources?

OF course he’s not. He’s race baiting, pure an simple. Why, you might ask. I believe it’s because of the first ridiculous and race based statement Obama made regarding this case. At the time, the major media were reporting that Zimmerman was ‘the white captain of the neighborhood watch’ and I think that Obama’s people didn’t bother to check and assumed, based solely on his name… George Zimmerman… and those widely circulated media reports, that Zimmerman was a Caucasian male. I think that Obama, as is his habit as proven by his jumping in,”Without knowing all of the facts” by his own admission, to say that “… the police acted stupidly” when his friend, Professor Gates was arrested by the Cambridge police, again simply spoke without finding out what the facts were in his zeal to weigh in on what he considered a race related crime.

Perhaps he does, in fact, lack the intellectual resources to make a sound judgement call, because he’s certainly proven repeatedly now that, unlike Trayvon Martin, he has the experience upon which to base sound judgement. He just doesn’t use it.

The last one was the day before the GZ verdict. He could have said something like this:

“America, where I am the first black president, in case you forgot, is still the greatest land on Earth. We have the best legal system in the world. No matter what your emotions are about the GZ case, no matter what the jury decides, we must respect and sustain this decision. If not, we are all doomed to transition toward an uncivilized and tyrannical form of government. If you should disagree, voice your disagreement peacefully. We should honestly discuss any topics, nationally, but the case will be decided based on the law and the evidence provided and litigated”

Alas, the tiniest man in America never rises to any leadership occasion. Mr. Nobel is ashamed, daily, in his grave.

Instead he hucksters and pimps on race and will go down in history worse than Carter. The geezer lived long enough to enjoy his status.

Well, there is evidence via the lovely and charming Ms Jeantel that Trayvon may have had some homophobic tendencies. OTOH, I recall seeing a pic of Barry in college seated on a sofa with a male Pakistani BFF kind of guy. Seated very closely, IIRC. So, here may be at least one difference.

And there are very few African-American men who haven’t had the experience of walking across the street and hearing the locks click on the doors of cars. That happens to me, at least before I was a senator. There are very few African-Americans who haven’t had the experience of getting on an elevator and a woman clutching her purse nervously and holding her breath until she had a chance to get off. That happens often.

And you know, I don’t want to exaggerate this, but those sets of experiences inform how the African-American community interprets what happened one night in Florida. And it’s inescapable for people to bring those experiences to bear.

You can bury your head in the sand, or you can actually try and listen and understand. Haven’t felt this positively about Barack Obama since before the appointment of Tim Geithner.

Wait, Obama actually had a press conference about a case so overblown that the trial is over and the the defendant acquitted of all charges?

Not very presidential. As the head of the executive branch, the only thing he should have to say is, “A jury has decided that Zimmerman is not guilty, so the agitators need to just go home.”

And so the fact that sometimes that’s unacknowledged adds to the frustration. And the fact that a lot of African-American boys are painted with a broad brush and the excuse is given, well, there are these statistics out there that show that African-American boys are more violent — using that as an excuse to then see sons treated differently causes pain.

I think the African-American community is also not naive in understanding that statistically somebody like Trayvon Martin was probably statistically more likely to be shot by a peer than he was by somebody else.

Most people have probably been followed when shopping at least once or twice. That’s because there are so many shoplifters. All you have to do is fit the profile: Stand around a little too much, wear a jacket. Since I’m usually just standing around a store while my wife does the shopping, I’m sure it looks like I’m loitering sometimes.

So now Obama has failed so convincingly with his show trials about racism, from the Cambridge police to George Zimmerman, that he has to get out there and talk about how he’s been discriminated against. The man’s led a privileged life, but he wants to pretend to be a victim.
