Holder: Let’s not do that whole subpoena thing, eh?

Clearly we won’t need to go to such great lengths as to subpoena Eric Holder in order to get him to give up the goods. Why? Because he managed to cut a deal.

Attorney General Eric Holder has agreed to meet with House Republicans as part of their probe into whether he misled Congress or acted inappropriately in the Justice Department’s investigation of two separate leaks to media outlets.

House Judiciary Committee Chairman Bob Goodlatte (R-Va.) made the announcement late Friday after exchanging several weeks worth of testy letters with the nation’s top cop.

In agreeing to meet with the lawmakers, Holder staved off the threat of a subpoena from Goodlatte for a second time in as many weeks.

The last time Goodlatte requested some answers from the Attorney General, he received a note from one of Holder’s deputies, Peter Kadzik, for his trouble. That almost resulted in a subpoena right there, but Holder is still managing to hold them off. The polite atmosphere isn’t carrying over to everyone on the Hill, though. Yesterday the President received a bit of a love note from a number of members of Congress who have clearly exhausted their patience.

On Friday, 46 Republican members of Congress sent a letter to President Barack Obama demanding he dismiss Attorney General Eric Holder. Six members of the Florida delegation signed the letter: Ron DeSantis, John Mica, Rich Nugent, Bill Posey, Dennis Ross and Ted Yoho.

The letter mentions Holder’s role in the “Fast and Furious” scandal, recent revelations concerning the Justice Department’s handling of the phone records of reporters from Fox News and the Associated Press, and the FBI’s handling of the phone records of many ordinary Americans.

Whether it’s Congress, the press, or even the New York City Police Department, it seems as if there isn’t anyone who Holder hasn’t ticked off recently. All the while, he remains busy making sure somebody else is the bad guy. (To be fair, Snowden is almost undoubtedly a bad guy also, but that’s a story for another column.) We should really get a pool going here: is Holder finally on the way out? And if so, how long can Obama keep this albatross around his neck before he finally cuts him loose?

I’ll take Labor Day weekend. Summer will be over and the next election cycle will be shifting into the mid-range gears by then, and a long weekend is the perfect time to dump not only news, but unwanted employees. Place your bets, folks.

Obama will never, ever do anything that resembles accepting guilt or blame. His mental illness renders him utterly incapable of it. Firing Holder under pressure (or “accepting his resignation”, same thing) would look like a confession of wrongdoing, so it won’t happen. The only way Holder will go is either if Obama can publicly and flamboyantly pin everything on Holder (“I found out he was a criminal the same way you folks did, when I read it in the paper!”), or if Holder has some life event that allows everyone to paint a polite fiction that he’s resigning for personal/family reasons.

Albatross? There are no more elections for Obama. He’s not worried about it. As long as he’s still polling in + favorables, why does he care? Holder is doing his bidding and he’s been a very good soldier in advancing Obama’s agenda. He’s not going anywhere.

If anything Obama is trying to figure out how to promote him to a greater position. If he could figure out a way to get Holder in Biden’s place he’d jump at it in a heartbeat.

Why on earth would Obama fire him?

As far as Holder leaving in handcuffs, be serious. In order for Holder to be prosecuted, Obama or Holder would have to approve the prosecution. The chances of that happening are only slightly less than the chances of an asteroid striking the Earth before Obama leaves office.

Sadly, the citizenry is not going to be given the choice as to whether we would rather weather an asteroid strike or three and a half more years of Obama.

What will more likely happen is, when The one is in the last days of this term, an opening will occur on SCOTUS, and if the Dems still control the Senate, Holder will be appointed on a party-line vote. With or without a few compliant RINOs.

Think of the way 5-4 votes, such as those on Heller, will go then. You can bet The One is having “Big O”‘s at the very thought.

I’m not seeing how there can be enough pressure put on Obama to give up his friend and fellow ideologue. If the pressure increases to the point a normal AG would go, they’ll just pull out the race card and wave it in front of the likes of Joe Scarborough and Chris Matthews, LA times, NYTimes and everybody in between. The Republicans will run for the hills and the trouble will pass. Remember, Alberto Gonzales got hammered far harder and left a whole lot sooner.

I presume that the President would not be unhappy were Holder to go. But, I also sense that it is unlikely that the White House would act in a sui generis manner to remove Holder — at least not publicly.

So if Holder decides to hang in there, the President is not likely to tell him to quietly take a hike. Holder is a political power monger, who has solidified his position because he was willing to perform real dirty work (e.g., Fast & Furious) for this Administration, much as he was willing to do so for Bill Clinton (e.g., Mark Rich).

The President would definitely seek to save face if Holder is to be put on the chopping block. Thus, he would want someone to quietly persuade Holder to leave on his own, perhaps citing some trumped up personal reason, and then Obama would express sadness, but in the same breath reluctantly accept Eric’s resignation.

On the other hand, if there are a series of very public Republican demands for his ouster, the White House would continue to resist because the last thing Obama and his team want is to be perceived doing, is folding under Republican political pressure, especially in the midst of the scandal-ridden atmosphere currently gripping Washington. Obama does not want to have Eric Holder viewed as the first cabinet official forced out as a result of the spate of emerging scandals in his Administration.

So, my guess is that the following would be about the least favorable headline from the Obama point of view:

So, it seems to me that politically the shrewdest thing the House Republicans could do right now would be to pin yet another well-earned corruption tail on that donkey, and then rev up the demands that he leave. Maybe even suggest impeachment — of Holder.

The cumulative negative effect of his presence is having it’s effect. If Obama is seen as stubbornly holding onto a damaged Eric Holder for political reasons, that will continue to harm his own image, and justifiably so.
