Did Holder just sort of … “drift away” from this whole mess after his recusal? Remember, this was no ordinary investigation. Yesterday Holder himself called the leak in the AP case one of the most serious, if not the most serious, he’d ever seen. He must have recognized instantly that there was a chance that reporters’ phone records would be subpoenaed to get to the bottom of it, which would be politically explosive for the White House. And yet he never formally notified anyone that he was backing away, huh? At this point, Obama should fire him even if he’s telling the truth.

Update: Holder says he had to recuse himself because he was a “fact witness”:

The attorney general recused himself because he was interviewed as a “fact witness” — “a possessor of the information that was ultimately leaked” — meaning that he could theoretically have leaked the information about the thwarted terrorist attack that was the subject of the AP report.

If they were looking at Holder as a potential leaker, the leak must have come from very high up. That jibes with Holder’s rhetoric about the seriousness of the situation; they must be looking at someone at or near the cabinet level, potentially, as the AP’s source.

Wouldn’t the AG be a potential “fact witness” in lots of leak cases, though, given the sensitive info he’s privy to? Why recuse himself in this particular case?

Update: Dave Weigel points to this DOJ press release last summer in which Holder announced he was assigning attorneys to lead the leak investigation. That would have been the moment to announce his recusal, but there’s nothing in there about that.

Obvious question: Did he refuse to recuse himself publicly from an explosive national-security investigation because that would have made for particularly bad headlines five months before the election?

Update: More good news from CNS: Holder’s not 100 percent sure which deputy AG actually authorized the AP subpoenas. Simply amazing.

I also loved how Holder kept saying that he “was recused” blah blah. Maybe you could say it’s shorthand for “recusing himself,” but make no mistake–nobody is ever recused by someone else. Instead, recusing is something you do to yourself. In effect, you decided to take yourself out of the matter. You do it to yourself; noboday does it to you.

Holder responded to Rep Issa who pressed him hard on the AP scandal by angrily telling Issa, “The way you conduct yourself as a member of Congress is unacceptable and shameful.”

The guy has already perpetrated 3 FELONY counts of PERJURY before Congress during the Fast-&-Furious investigation for which he should have been convicted but was protected because the DOJ refused to do its job & press charges) yet still became the 1st Attorney General in U.S. history to ever be Censured.

He is up to his ARSE in this scandal, the crime/acts being perpetrated on his watch. During the hearing today Rep Sensenbrenner, frustrated at not getting a response, suggested Holder go to the Truman Museum and “take a picture of the thing on his desk that said ‘the buck stops here.'”

He has COMMITTED CRIMES in covering up other crimes/failures that have resulted in the deaths of over 300 people, to include 1 dead U.S. BPA, he arrogantly lies, acts as if he is being insulted & put out (much like his boss), & arrogantly tells ISSA that HIS behavior is “unacceptable and shameful”?! Part of Holder’s arrogance, pomposity, & ‘untouchable’ attitude comes from believing his boss & the DOJ will protect him because he is Obama’s backside protection.

I so hope they burn this SOB down, that they get to walk into his office & take him out with handcuffs! I hope this time is the ‘1 scandal too many’ he doesnt escape from!

Not recusing yourself in writing when you are a fact witness in an investigation should be a firing offense for any Attorney General. And James Cole should be fired for not demanding a written recusal from Holder.

This really stinks, more and more.

The wiggling around to keep from admitting anything harmful.
The obfuscation.
The flat look on their faces while they’re lying and obfuscating.
