Breaking: Verdict reached in Gosnell trial; Update: Guilty of 1st-degree murder for 3 of 4 babies

Fox News and CNN are on alert as I write this:

Stand by.

Update: Like Ace, I think the fact that they were hung on two counts this morning bodes ill. If they’ve already found him guilty on the four murder counts, they wouldn’t let divisions over a lesser charge delay the verdict. If, on the other hand, they’d already found him guilty on two murder counts and are stuck on the other two, you would think the “guilty” faction would relent on the two that are undecided since they’ve already nailed him twice. The likeliest disposition is that they’ve acquitted him on two counts and are, or were, fighting over murder charges on the other two.

Needless to say, with 263 counts, they’re going to get him on something. He’ll do time. But the murder charges, for obvious reasons, are what people are interested in.

Update: In case you’ve seen the now-famous photo from the trial of a baby with its spine slit, don’t look for a verdict on that murder charge today. The judge has already dismissed it on grounds that the prosecution couldn’t prove that the baby was born alive before it was, effectively, decapitated. Perfectly legal in America to kill it in the womb and then cut its spine in half, just to be sure.

The local NBC affiliate reports that sentencing will begin on July 15th.  They will empanel a different jury to consider the death penalty for the murder charges.

The local NBC affiliate reports that sentencing will begin on July 15th. They will empanel a different jury to consider the death penalty for the murder charges.

Gah! If it were here in Texas, the same jury would turn right around and start deliberations in the penalty phase.

It is a defense tactic to not testify if you don’t think the state has made it’s case and you might do more harm. For example, I just served on a jury for a DUI related case (not DUI though). I was all ready to vote “Not Guilty” when the state rested…right up until the defendant took the stand and opened his stupid mouth. Guy talked himself into 9 months in jail.

You are both stupid and dishonest. The unveiling of what occurs at an abortion clinic is not “old news” as you so dishonestly characterize it. The Gosnell case is spectacular in that it displays openly for the world to see what really goes on in those places. No news organization has ever covered that or aired that so the public has no idea. Thus, to call it unexceptional and not newsworthy on that basis is the height of dishonesty. But you realize that, just as you realize almost everything else you say is dishonest.

The very reason the left (media) won’t cover this story in depth is because they know it will sway public opinion against abortion and lefties worship abortion. Tracing their lineage to fascism, as they do, leftists worship violence in the name of politics and abortion allows them to sate their blood lust slightly. That is why abortion is the highest sacrament in the lefties religion.

It’s a common strategy for the defense to simply rest after the prosecution presents its case. the defense doesn’t have to prove anything it merely has to poke holes in the prosecution’s case.

So, the fact that the defense did not put on an affirmative case is not alone grounds for overturning a verdict on the basis of ineffective assistance of counsel.

Granted, that alone is not enough.

At a minimum Gosnell would have to claim he strongly disagreed with what was done but reluctantly went along with it. And/or that he was unable to make a sound decision at the time, for medical or psychological reasons, or something.

Not saying it would succeed. I hope he fries. I haven’t followed the legal machinations in the trial. Nor do I know the applicable laws in the state.

I’m wondering if such an appeal could be used to avoid the death penalty.
