Breaking: Verdict reached in Gosnell trial; Update: Guilty of 1st-degree murder for 3 of 4 babies

posted at 2:26 pm on May 13, 2013 by Allahpundit

Fox News and CNN are on alert as I write this:

Stand by.

Update: Like Ace, I think the fact that they were hung on two counts this morning bodes ill. If they’ve already found him guilty on the four murder counts, they wouldn’t let divisions over a lesser charge delay the verdict. If, on the other hand, they’d already found him guilty on two murder counts and are stuck on the other two, you would think the “guilty” faction would relent on the two that are undecided since they’ve already nailed him twice. The likeliest disposition is that they’ve acquitted him on two counts and are, or were, fighting over murder charges on the other two.

Needless to say, with 263 counts, they’re going to get him on something. He’ll do time. But the murder charges, for obvious reasons, are what people are interested in.

Update: In case you’ve seen the now-famous photo from the trial of a baby with its spine slit, don’t look for a verdict on that murder charge today. The judge has already dismissed it on grounds that the prosecution couldn’t prove that the baby was born alive before it was, effectively, decapitated. Perfectly legal in America to kill it in the womb and then cut its spine in half, just to be sure.

Update (Ed): From JD Mullane, a nuanced split decision on the murder charges:

Looks like the jury was really trying to get this right. Stand by for more.

Update (Ed): Also guilty of involuntary manslaughter for the death of Karnamaya Mongar, the woman who died in a late-term abortion.

Update (Ed): Last week, Kermit Gosnell was smiling and laughing in the courtroom.  Not any longer:

Update (Ed): This may seem redundant, but these charges would have allowed the jury to take a pass on 1st-degree murder convictions if so inclined:

The local NBC affiliate reports that sentencing will begin on July 15th.  They will empanel a different jury to consider the death penalty for the murder charges.

Update (Erika): …And the babies, no?

Update (Erika): NARAL‘s statement also straight-up skates over the fact that Gosnell was just convicted for the murder of three babies:

Kermit Gosnell has been found guilty and will get what he deserves. Now, let’s make sure these women are vindicated by delivering what all women deserve: access to the full range of health services including safe, high-quality and legal abortion care.

On the count of underpaying the receptionist, guilty. On all other counts, not guilty and the defendant is free to go.

IMHO guilty on everything but two murder counts.
They hung on whether 2 of the babies might not have been alive when spine severed.

The left better hope for their sake he gets sent away for a long time. The last thing they need after Benghazigate and the IRS scandal is to have a literal baby killer set free by an idiot jury. All of that will mobilize conservative voters in a way that’ll make 2010 look like a tea party(and I mean the kind where people actually sip tea).

Doughboy on May 13, 2013 at 2:33 PM

I bet he skates on the murder charges. They were hung up on a couple counts because there were one or two pro lifers on the jury, but the rest were able to twist their arms on them since this morning.

I’ve got a bad feeling about the murder charges when you have an all female jury. It only takes one more interested in affirming the “right” of abortion than justice. And, in reality, the real culprits are not on trial here- health department officials who let this place operate for 17 years without a bit of oversight.

Per Jill Stanek:

http://www.jillstanek.com/2013/05/gosnell-verdict-reached/

2:27p: Per CNN’s David Ariosto (via Twitter): ‘The jury in the Philadelphia abortion doctor Kermit Gosnell case has reached a verdict on all 263 counts.”

Now waiting the verdict. Courtroom locked down. All electronic equipment ordered off, reporters banned from leaving courtroom until all the results are read.

2:30p: On Fox News, Megyn Kelly says she just saw an ultrasound of her 24-week-old baby, which is the age Pennsylvania law currently limits abortion.

2:43p: @PhillyInquirer on Twitter: “It could be an hour or more before the Gosnell verdict is disseminated. The jury must convey its decision on each of the 250+ charges.”

The likeliest disposition is that they’ve acquitted him on two counts and are, or were, fighting over murder charges on the other two.

I read this differently. But could easily be wrong.

I read it the other way.

How long would one or two jurors who insist on a guilty verdict on two of four counts, when they have already agreed to not guilty on the other two, really hold out? Would they really hold out until the foreman is forced to tell the judge they are hung on those two?

Vanceone on May 13, 2013 at 2:41 PM

That would take one hell of an activist jury though. Remember, the defense didn’t present a case. They rested when asked to call their first witness. At least Orenthal’s so-called dream team spent months going after the veracity of the LAPD’s crime scene investigators and lab workers and played the race card.
