Breaking: DOJ secretly seized two months of Associated Press phone records?

posted at 4:51 pm on May 13, 2013 by Erika Johnsen

What the heck? From the Associated Press:

WASHINGTON (AP) — The Justice Department secretly obtained two months of telephone records of reporters and editors for The Associated Press in what the news cooperative’s top executive called a “massive and unprecedented intrusion” into how news organizations gather the news.

The records obtained by the Justice Department listed incoming and outgoing calls, and the duration of each call, for the work and personal phone numbers of individual reporters, general AP office numbers in New York, Washington and Hartford, Conn., and the main number for AP reporters in the House of Representatives press gallery, according to attorneys for the AP.

In all, the government seized those records for more than 20 separate telephone lines assigned to AP and its journalists in April and May of 2012. The exact number of journalists who used the phone lines during that period is unknown but more than 100 journalists work in the offices whose phone records were targeted on a wide array of stories about government and other matters.

AP President and CEO Gary Pruitt dispatched a letter to AG Holder on Monday, and the man is understandably not pleased about what looks like a very serious intrusion from the federal government:

“There can be no possible justification for such an overbroad collection of the telephone communications of The Associated Press and its reporters. These records potentially reveal communications with confidential sources across all of the newsgathering activities undertaken by the AP during a two-month period, provide a road map to AP’s newsgathering operations, and disclose information about AP’s activities and operations that the government has no conceivable right to know,” Pruitt said.

Update: The Associated Press says that, in the letter they received from the DOJ on Friday notifying them of the DOJ’s actions, they were offered no explanation for the seizure, but sounds like the AP suspects it had to do with a DOJ investigation into who “leaked information contained in a May 7, 2012, AP story about a foiled terror plot” that disclosed “details of a CIA operation in Yemen that stopped an al-Qaida plot in the spring of 2012 to detonate a bomb on an airplane bound for the United States.”

This is not a good day for the White House. The IRS has been specifically targeting conservative groups; HHS Secretary Sebelius has been extorting money from health industry executives; and now it looks like the DOJ has been seriously meddling into the freedom of the press? No doubt they’ll claim that it was all for the sake of national security and plugging leaks of classified information, or hey, perhaps that this was just a mix-up by some low-level Justice employees, or something… Or maybe they’re going for a, ‘Heck, let’s just overwhelm everybody and air the thugocracy scandals out all at once’-type strategy?

Update: Optics.

Update: Here’s the AP president’s letter to Holder in full.

Update: And the statement from the DOJ:

We take seriously our obligations to follow all applicable laws, federal regulations, and Department of Justice policies when issuing subpoenas for phone records of media organizations. Those regulations require us to make every reasonable effort to obtain information through alternative means before even considering a subpoena for the phone records of a member of the media. We must notify the media organization in advance unless doing so would pose a substantial threat to the integrity of the investigation. Because we value the freedom of the press, we are always careful and deliberative in seeking to strike the right balance between the public interest in the free flow of information and the public interest in the fair and effective administration of our criminal laws.

Update: No comment from Carney:

Update (MKH): This is apparently the leak that launched a thousand phone log seizures:

WASHINGTON (AP) — The CIA thwarted an ambitious plot by al-Qaida’s affiliate in Yemen to destroy a U.S.-bound airliner using a bomb with a sophisticated new design around the one-year anniversary of the killing of Osama bin Laden, The Associated Press has learned.

The plot involved an upgrade of the underwear bomb that failed to detonate aboard a jetliner over Detroit on Christmas 2009. This new bomb was also designed to be used in a passenger’s underwear, but this time al-Qaida developed a more refined detonation system, U.S. officials said.

The FBI is examining the latest bomb to see whether it could have passed through airport security and brought down an airplane, officials said. They said the device did not contain metal, meaning it probably could have passed through an airport metal detector. But it was not clear whether new body scanners used in many airports would have detected it.

Karl Rove Indicted on Charges of Perjury, Lying to Investigators

By Jason Leopold

t r u t h o u t | Report

Saturday 13 May 2006

Special Prosecutor Patrick Fitzgerald spent more than half a day Friday at the offices of Patton Boggs, the law firm representing Karl Rove.

During the course of that meeting, Fitzgerald served attorneys for former Deputy White House Chief of Staff Karl Rove with an indictment charging the embattled White House official with perjury and lying to investigators related to his role in the CIA leak case, and instructed one of the attorneys to tell Rove that he has 24 business hours to get his affairs in order, high level sources with direct knowledge of the meeting said Saturday morning.

Rove was never indicted.

But truthout never retracted this fake story, and it is still on their web page.

Then there is Democrat Senate Majority Leader gleefully celebrating the US “losing” the Iraq War, even as that war was still being fought.

Thanks for playing, Kid! Endlessly entertaining!

But, since you are so apparently ignorant about presidential threats, which I did not make, I suggest that you go read Watts v United States, 394 U.S. 705 (1969)…

‘I have already received my draft classification as 1-A and I have got to report for my physical this Monday coming. I am not going. If they ever make me carry a rifle the first man I want to get in my sights is L.B.J.’

- Robert Watts, at an antiwar rally, 27 August 1966

The Supreme Court of the United States of America…

HELD:

‘The language of the political arena… is often vituperative, abusive, and inexact….Thus, considering the context, and regarding the expressly conditional nature of the statement and the reaction of the listeners, the statement was not a true threat…and was political hyperbole.’

Now, run along and put some ice on that…point on the top of your head.

For the same reason Stalin wasn’t nicer to his underlings; he’s not a nice guy. That reminds me – for a Trostkyite, Teh SCOAMT is quite a passable Stalinist.

The main difference is, he’s not an actual dictator yet so he can’t just stomp all over his most key allies in a fit of paranoia like Stalin could and order them disappeared if they complain.

As for impeachment possibilities, do you really think the Rats want to prove the third time is the charm, especially considering they only had to threaten impeachment of Nixon to force the only non-assassination mid-term change?

Steve Eggleston on May 13, 2013 at 5:36 PM

Oh, there’s no doubt in my mind that the bar for impeachment is still incredibly high. However, the absolute minimal hurdle that must be cleared is for the media to turn against Obama. The Republicans may be able to move forward on it if this causes major Democrat press organs to turn on Obama, because the media turning on him makes it possible to bring actual pressure to bear on the Democrats.

Remember that even if Obama is removed from office via resignation or a successful impeachment, it doesn’t mean a Republican gets the big chair. It just means President Biden. Obama isn’t running for anything anymore, but Hillary certainly is. The media might decide removing Obama will help Hillary 2016 chances. If his administration is still around and still a scandal-ridden catastrophe, that will make things much tougher on the Democrats in 2016 even if the Republicans run another empty suit like Romney.

I still think impeachment is very unlikely, but it has at least a small chance of happening now.

Just so you “baggers” understand, the new uniforms for all employees of the IRS, DHS, HHS, and DOJ are not brown, they’re “chocolate”.

Gotta have 67 Senators voting yes….
How many dems could we flip??

They might want to get rid of Obama worse than the Republicans do…..

redguy on May 13, 2013 at 5:55 PM

Depends on if you factor in the no to removal votes from McCain, Graham, and Collins. ;0

Did the Administration of Dear Leader just jump the shark?

Queen0fCups on May 13, 2013 at 6:01 PM

Ironic that #Obama and #Holder would choose to track @AP staffers, but not guns sent to Mexico. #FastandFurious

antipc on May 13, 2013 at 6:01 PM

My strategy. Pace ourselves. Put these events into a crock pot and let them get boiling hot by mid-terms 2014. We hold House, take Senate and then we impeach him.

hillsoftx on May 13, 2013 at 5:53 PM

There are plenty of scandals to go around to numerous committees. Each one can hold pressers from time to time on how things are going.

It takes time to interview witnesses, subpoena documents, etc. The next year doesn’t look good for Obama.

To rephrase Rush, that means things look good for America.

petefrt on May 13, 2013 at 6:02 PM

I don’t really know what the best strategy is, to be honest. Given how spineless the Republicans are, they will still probably not touch him unless the media turns on him hard.

Doomberg on May 13, 2013 at 5:59 PM

There needs to be a high standard for impeachment. But when it is reached it is like smut….. you know it when you see it. We are quickly reaching that point with the current administration.

Happy Nomad on May 13, 2013 at 6:02 PM

Incoming via Fox – the Justice Department is claiming they were investigating national security leaks.

That raises the obvious question – where’s the investigation into The New York Times?

Steve Eggleston on May 13, 2013 at 6:02 PM

He’s testing the waters on that. As long as Dingy Harry Reid has his back, we’re not getting to 67 to convict in the Senate. Honestly, as long as we keep getting Bo(eh)ned in the House, it won’t even get to the Senate.

I agree on this. On other hand, everything changes if the media turns on him and we start getting a drumbeat of negative coverage on him. If they go “flood the zone negative” against Obama and his approval numbers collapse into the thirties, Dingy Harry and Boehner might be willing to give impeachment a serious look.

Clinton isn’t getting the 2016 nomination. The Rats, unless there is a President/Vice President on the table, go for somebody even pundits barely heard of 4 years prior.

Steve Eggleston on May 13, 2013 at 5:58 PM

I dunno. Clinton is the most popular politician in the country right now. I’ve heard many on our side say those numbers can be brought down in a campaign, but it’s hard to deny that her “positives” look very strong right now.

I do think she might get some competition from Julian Castro. I am not sure O’Malley or Cuomo bring anything to the table Clinton doesn’t.

Maybe Chris Christie if he switches parties?

Doomberg on May 13, 2013 at 6:02 PM

Hitler started off by curtailing civil rights of Germans. Obama is doing the same in America.

Freedom of the Press limited- check

Freedom of religion under attack by the state- check

Getting rid of the right to bear arms- In progress. Those Newtown deaths turned stale too quick

Government harassing dissenters- check.

You really are as stupid as we all think if you don’t think there is a valid comparison here.

Happy Nomad on May 13, 2013 at 5:54 PM

Conservative4ev on May 13, 2013 at 6:04 PM

I think the media is at a crossroads. They realize with the trifecta of scandals Obama is effectively a lame duck as the GOP has no reason to cooperate at all with his agenda. I can see them getting on Cankles bandwagon now and beginning to expose Obama in sporadic acts of journalism…

hillsoftx on May 13, 2013 at 6:04 PM

Obama is now eating people on his own side…

William Eaton on May 13, 2013 at 6:05 PM

Update: The Associated Press says that, in the letter they received from the DOJ on Friday notifying them of the DOJ’s actions, they were offered no explanation for the seizure, but sounds like the AP suspects it had to do with a DOJ investigation into who “leaked information contained in a May 7, 2012, AP story about a foiled terror plot” that disclosed “details of a CIA operation in Yemen that stopped an al-Qaida plot in the spring of 2012 to detonate a bomb on an airplane bound for the United States.”

Wish I saw that update before Fox News finally got on the story with Special Report.

Steve Eggleston on May 13, 2013 at 6:05 PM

Holder picking on the AP? The people who do nothing but carry water for Barry and Company? If anything, they’re looking for those WHO AREN’T CARRYING ENOUGH WATER.

GarandFan on May 13, 2013 at 6:06 PM

Will the media serve the left to the grave? They have sacrificed their credibility and used much of their waning power to protect this administration and what do they receive in return? They get paid with incompetence and disloyalty. How close are they to turning and biting the hand that they love?

The festering heat he has brought
‘Tis no reason why his assault on America
Should ever be forgiven, or forgot

He who gives us the smack of his rod
Soon now we will rend him to bits
We will give him the Judgment of God!

That was a long time ago. What difference, at this point, does it make.

OT/ Special Report covering the Gosnell case. Planned Parenthood was quick to get out there and distance themselves from this monster. I wonder what letter they would have released if Gosnell had beat the murder charges. My guess it would be a whole lot different. They are scared about future revenue if there is a call for greater scrutiny over abortion factories.

WTF.

The POS is losing it. Now says it’s all Rush’s fault.

President Obama told donors like Jessica Biel, Justin Timberlake (who was wearing hipster
glasses), and Tommy Hilfiger that Washington
gridlock is pretty much Rush Limbaugh’s fault on Monday evening at a fundraiser at Harvey Weinstein’s house in New York’s Greenwich Village.

Benghazi Part Deux? From the Politico story linked in one of the updates in the main post:

The May 7, 2012, AP story that disclosed details of the CIA operation in Yemen to stop an airliner bomb plot occurred around the one-year anniversary of the May 2, 2011, killing of Osama bin Laden.

The plot was significant because the White House had told the public it had “no credible information that terrorist organizations, including al-Qaida, are plotting attacks in the U.S. to coincide with the (May 2) anniversary of bin Laden’s death.”

Cue Lt. Frank Drebin.
