‘Gang of eight’ source: One-year window to apply for provisional legal status

Border ControlOne of the lingering questions I’ve harbored about the forthcoming “Gang of Eight” immigration bargain (the Tuesday roll-out of which was appropriately postponed due to the events in Boston) is how long the “open enrollment” period for amnesty would be.  Surely the bill includes a finite time box, rather than unleashing an ongoing, open-ended new policy, right?  Right.  “There’s a cut-off after one year,” a GOP source familiar with the plan tells me.  The federal government would begin accepting applications for provisional legal status “after the first two security triggers are met, and [the government] begins the application process.”  Here’s how the source lays out the Gang’s six layers of enforcement “triggers:”

(1) DHS must create, fund & begin border security plan (6 months)

(2) DHS must create, fund & begin border fence plan (6 months)

(3) DHS must achieve 100% awareness & 90% success in high-risk sectors of Mexican border (5 years)

(4) If DHS fails at number three, then Border Commission create & implement plan to achieve number three (10 years)

(5) Universal E-verify must be implemented (10 years)

(6) Visa-exit system must be implemented for all international airports & seaports (10 years)

So the application floodgates won’t open until the first two triggers are satisfied.  Then come the trickier benchmarks, upon which permanent residency and a chance for citizenship rely.  Unless and until action items three through six are achieved, “no green cards,” and thus, no path to citizenship.  (For a dose of pointed skepticism about the seriousness and practicality of these thresholds, read Allahpundit). Back to the 365 day time frame for a moment: Won’t the resulting “magnet effect” create a powerful incentive for people to enter the country illegally prior to the deadline?  In theory, no.  The amnesty option will only be extended to illegal immigrants without criminal records who’ve been living inside the United States since before December 31, 2011.  How the government plans to adjudicate millions of timeline-related claims from people who’ve been “living in the shadows” for years is beyond me.  I’ll leave you with with this explicitly positive early review from the president of the American Conservative Union:

“Our current immigration system is broken, our borders are not secure and we have de facto amnesty in which government picks winners and losers among those who are here illegally, including who is deported or not.  The proposal put forward by the ‘Gang of 8’ in the Senate puts border security first and puts legal immigration ahead of those who are here illegally, with appropriate triggers and penalty fines. It is clear that under the Obama administration none of these things will happen without legislation and that’s why this proposal as described deserves a positive response. We look forward to gaining a thorough understanding of this complex legislation once it is introduced and urge the Congress to give it a proper vetting and allow robust debate though the Committee process before acting.”

Marco Rubio couldn’t have fashioned a favorable statement himself.  It repeats his line that the status quo amounts to de facto amnesty, underscores the plan’s border security elements, and backs up his repeated calls for an open debate process.

How can it put legal immigrants in front of the illegals when the illegals are enjoying every benefit of living in the United States of America including likely voting while the legal immigrants from some countries are forced to wait more than a decade to even enter the country at all!?!

A Senate Republican aide not authorized to speak on the record tells me that there are six triggers for green card eligibility (required time frame is in parentheses):

1) DHS must create, fund & begin border security plan (6 months)

2) DHS must create, fund & begin border fence plan (6 months)

3) DHS must achieve 100% awareness & 90% success in high-risk sectors of Mexican border (5 years)

4) If DHS fails #3, then Border Commission create & implement plan to achieve #3 (10 years)

5) Universal E-verify must be implemented (10 years)

6) Visa-exit system must be implemented for all international airports & seaports (10 years).

Critics of any immigration reform may argue that the pre-green card legalization (“registered provisional” status) doesn’t require all that, “only” a criminal background check, fine and payment of back taxes. But understand these people are here now, with no real threat (or ability on the U.S. government’s part) of sending them “home.” In essence, as Sen. Marco Rubio has pointed out, the status quo now is “amnesty”; this at least gets these immigrants into a system and collects a fine and tax revenue.

Nothing is perfect, but we could do worse, and probably will if we do not pass something like this.

I want serious committee work on any legislation. Not backroom deals. IMO this will come back to crush whatever higher aspirations Rubio might have had. He’s proven himself as trustworthy on GOP values as McCain or Graham.

Questions that should be asked…

1) Who are the specific people in charge of managing the E-verify & Visa-exit programs?

2) What are the specific obstacles that are preventing the USA from having functional E-verify & Visa-exit programs by the end of 2013?

3) Where can American Citizens go online to see monthly progress reports for these projects?

It is time to start holding a specific person responsible for each of these projects, before we even discuss allowing ILLEGAL aliens to stay in our country.

Who will be the first “Investigative Reporter” to ask these questions?

Janet N will swear the afternoon the bill is signed into law that 1-3 are accomplished, meaning we skip 4. They can piggyback the e-verify on the obamacare/gunowner database using an increasing amount of space as the guns are confiscated. That leaves just the exit visa system. But does that really need to be 100%? If so, we’ll have Eric Holder drop by and tell us it’s not a problem.

Repeating the talking points of amnesty shills doesn’t make those talking points legitimate simply because they are repeated by a so-called conservative leader. His comments don’t even make sense. Obama won’t enforce the legislation, so the only solution is to pass legislation, lol.

You can’t even set up utilities or rent an apartment without documents. These people have documents. They may have fake SSNs and other information but these people have documents.

What a jerk O’Reilly is. I just watched a segment where he lectured Steve King about this immigration bill. O’Reilly is, of course, all for it. He says the Republicans need to “bend” on this so they can get Latino votes in the future. O’Reilly is a JERK. I will not watch his show again.

This immigration monstrosity is so complicated – there is no way this Federal Government is ever going to enforce it. Hell, they don’t enforce the laws that we have NOW. But they will create a massive expansion of the bureaucracy in order to give the appearance they are trying. Very few illegals are going to want to go through this process. Most of them don’t even care about citizenship.

Result; Yearly reports taking 200+ pages to define and describe “awareness training”. %90 success will be defined as “%90 of personnel must have completed the training every year”.

Result; Still more studies.

(5) Universal E-verify must be implemented (10 years)

Result; Studies to determine exactly what is meant by E-Verify. Taking 20 years minimum.

This might actually get done, since illegal aliens rarely come through official ports of entry. And without the actual accomplishment of the rest of the list, there will be no appreciable number of illegals to deport through those international portals, anyway.

Endgame; Progressives get what they want; lots more tax money to spend on bureaucracy, and lots more “undocumented” Democrat voters.

Everybody else gets the shaft. As always.

Anyone who thinks that Schumer & Co. are honest, or serious, about this hasn’t been paying attention for the last forty-odd years.

The Visa-exit system was first mandated in 1996, and has been re-mandated 5 times since, yet has never been done. Adding this new 10 year mandate means it will have taken 27 years to implement this one security requirement…assuming it even gets done then. I wouldn’t count on it.

I suppose, but do you really think the Feds are going to go to all that trouble? And besides, most illegals get a false identity, SSN, etc., before they sign up for anything.

It’s like the Dream Act provision that Obama did with Executive Order. Border Agents have no way of knowing if a person came here under circumstances eligible for that amnesty – so if the immigrant SAYS they are eligible for the Dream Act, they have to release them.

We know that every amnesty application will just get rubber-stamped for approval. Just like in the 1986 amnesty, the government does not have the money or the personnel to verify the validity of supporting documentation for millions of amnesty applications, so just like in 1986, they won’t even bother to try. This will be like 1986, and the Pigford settlement, all over again: just submit your phony documents, and get your taxpayer-funded prize! No questions asked!

Unlike in 1986, we have many millions more illegals who will be applying this time. Also, it is much easier today to produce fraudulent, back-dated to 2011 school documents, utility bills, etc., than it was in 1986.

Sorry, but unless the left is screaming bloody murder we didn’t get jack sh!t. How about for every 1 mile of double layer security fence that is built and certified as operational by the border patrol, DHS gets to legalize 10,000 people? The left would go nuts because they would actually have to build the fence to get something. Everything needs to be in baby steps where each side gets a little something and gives a little something. Do the same thing with interior enforcement and elimination of sanctuary cities. Giving the dems everything right away in return for promises of making plans is joke.

The problem is that the United States of America has an immigration policy and a carefully managed set of borders for legal entry, but it doesn’t work…and people just saunter into the country and then get de facto adopted as needy waifs by the idiot politicians.

We can easily figure out what to do with the illegals, all in good time…just as soon as we remove the incentives for them to sneak into the country. When I look at Marco Rubio, now all I see is the face of John McCain looking back at me and I can almost hear, “My friends, my friends …” coming from his mendacious mouth. It has become very clear that Rubio is The Man Who Never Was. He’s just a conman with a no longer very convincing con, so teenage girls you can get over your crush on him and now would be a good time.

Since Marco Rubio is now calling amnesty, “earnesty”, I am wondering when he will officially/legally change his name from Marco Rubio to Marco Orwell. He certainly should. Perhaps in the next Batman movie, as the series gets ever more worn out, he can play a composite of the Joker and Two-Face. And since Rubio is Spanish for Blond, maybe he will wear a blood wig as he goes about his quest with Obama Bain for the extinction of the Republic.

I no longer trust Rubio, McCain Mini-Me, at all, zip, zero, nada. Rubio was big on the Arab Spring and probably still is. He, along with his new dad John McCain, and his new mom Lindsey Graham, pushed at Obama to get even more involved in Libya, so Benghazi is blood on his hands too. Rubio, like McCain [who incidentally, for anyone who somehow hasn't yet noticed, calls everything he advocates, bipartisan], seems absolutely incapable of learning anything – ever. That’s ‘assuming’ that he is the least bit sincere which is quite unlikely. Be it about Muslims, who will never be for liberty, or illegal Mexicans, who if made legal will overwhelmingly vote gimmiedat/democrat to the point of obliterating what’s left of the Republican party and much of America.

How about for every 1 mile of double layer security fence that is built and certified as operational by the border patrol, DHS gets to legalize 10,000 people? The left would go nuts because they would actually have to build the fence to get something. Everything needs to be in baby steps where each side gets a little something and gives a little something. Do the same thing with interior enforcement and elimination of sanctuary cities. Giving the dems everything right away in return for promises of making plans is joke.

In 2006 the Z visa had a 90 calendar day waiting period after application, during which time the FBI had to complete a criminal background check. If the FBI didn’t finish in time – AUTOMATIC and IMMEDIATE permanent legal residency and the beginning of the pathway. Analyzing the pieces of this legislation is as useful as looking for faces in the clouds. Does any rational human being believe that what will be written and discussed will bear any resemblance to what is in place 10 years from now?

If an illegal immigrant does not sign up, will he be deported? NO!

If you do not need a green card to work, get benefits, get a drivers license and social security card, and vote. What significance is a green card, or citizenship?

Some form of e-verify has been in place for 20 years or more, obviously it is not enforced.

I am truly disgusted by the state of our current government!
