Video: Gosnell staffer, defense attorney argue over whether babies were alive

posted at 9:21 am on April 11, 2013 by Ed Morrissey

The national media aren’t interested in telling the story of a man accused of butchering women and slaughtering babies, but at least local news outlets are still in the news-reporting business. Delaware Online has a reporter assigned to the trial of Kermit Gosnell, and Sean O’Sullivan of the News Journal provided this low-budget video wrap-up of the testimony of a key witness. Lynda Williams helped Gosnell “ensure the fetal demise” of the babies that resulted from his botched late-term abortions, and got into an argument with Gosnell’s defense attorney about whether the babies were actually alive at all:

Attorneys sparred today over whether the child whose neck Lynda Williams said she “snipped” at Kermit Gosnell’s abortion clinic was alive or dead at the time.

Gosnell’s defense attorney John McMahon also brought out on cross examination that the 44-year-old Williams, of Wilmington, never saw movement, breathing or any other signs of life in the 30 or so other fetuses that she said she saw Gosnell cut the spinal cords of to ensure “fetal demise.”

But Williams ultimately stuck to her testimony that she saw independent movement in a child that she said she cut the neck of on Gosnell’s orders and that what was going on at Gosnell’s clinic was wrong.

I understand that Gosnell’s attorney has a duty to present a robust defense of his client, and that there isn’t any rational defense to be found. However, this is sophistry at its worst. If the babies were dead, Gosnell wouldn’t have directed his staff to chop their spinal columns at the neck, would he? The direction to do so shows that Gosnell’s state of mind was concern that the babies would survive, and his response to ensure they didn’t demonstrates his intent to kill.

These are the kinds of details, though, that most media would find fascinating in any other criminal trial.  Kirsten Powers makes the same point in a column at USA Today this morning, wondering why national media outlets can’t find room to discuss a butcher who maimed women and the government agencies that looked the other way:

Infant beheadings. Severed baby feet in jars. A childscreaming after it was delivered alive during an abortion procedure. Haven’t heard about these sickening accusations?

It’s not your fault. Since the murder trial of Pennsylvania abortion doctor Kermit Gosnell began March 18, there has been precious little coverage of the case that should be on every news show and front page. The revolting revelations of Gosnell’s former staff, who have been testifying to what they witnessed and did during late-term abortions, should shock anyone with a heart. …

A Lexis-Nexis search shows none of the news shows on the three major national television networks has mentioned the Gosnell trial in the last three months. The exception is when Wall Street Journal columnist Peggy Noonan hijacked a segmenton Meet the Press meant to foment outrage over an anti-abortion rights law in some backward red state.

The Washington Post has not published original reporting on this during the trial andThe New York Times saw fit to run one original story on A-17 on the trial’s first day. They’ve been silent ever since, despite headline-worthy testimony.

Let me state the obvious. This should be front page news. When Rush Limbaugh attacked Sandra Fluke, there was non-stop media hysteria. The venerable NBC Nightly News’ Brian Williams intoned, “A firestorm of outrage from women after a crude tirade from Rush Limbaugh,” as he teased a segment on the brouhaha. Yet, accusations of babies having their heads severed — a major human rights story if there ever was one — doesn’t make the cut.

You don’t have to oppose abortion rights to find late-term abortion abhorrent or to find the Gosnell trial eminently newsworthy. This is not about being “pro-choice” or “pro-life.” It’s about basic human rights.

Indeed.  Powers calls the silence “a disgrace,” but it’s a revealing disgrace.

you know I never see abortion supporters railing against laws that charge someone for killing a fetus (baby) when they assault a woman.
seems to me if the woman wanted the child they are fine with extra charges being filed (as am I) but they are fine with killing it otherwise.

dmacleo on April 11, 2013 at 11:02 AM

The Libs seem to think it’s all or nothing; black or white. Someone should tell them they can be pro-abortion, yet STILL be against things like this.

NotEasilyFooled on April 11, 2013 at 10:30 AM

That’s a very difficult position for them to take. If you start thinking of that tissue mass as a baby, then you start wondering “well, why wasn’t it a baby 5 minutes ago, when it was still inside the mother”? Once you start down that road, you realize that abortion is just a term to make infant-killers feel better.

That’s why showing mothers the ultra-sound of their babies is so vehemently opposed by pro-abortion groups. Seeing the ultrasound makes you realize there’s a living, growing baby inside you.

This is my biggest problem with self-professing conservatives who are ambivalent on abortion. Most of them hop right on the bandwagon in supporting fetal homicide laws without any thought for the fact that the difference between fetal homicide and abortion is only whether the woman wants her child to live. YMMV folks, but I find that that pretty chilling.

Will B.O. be shipping the parents of these slaughtered infants to Washington on Air Force 1?

No. For two reasons:

1) The parents will not show their faces in public.

2) B.O. is glad these children were mutilated to daeth.

I am pretty much 100% prolife and fully anti-abortion for birth control reasons.

oh come on, the way Powers was addressing it, she was definitely going for the sensationalistic appeal: “Infant beheadings. Severed baby feet in jars. A childscreaming after it was delivered alive during an abortion procedure. Haven’t heard about these sickening accusations?”

nonpartisan on April 11, 2013 at 9:32 AM

So? It should be sensationalized, so people understand the horrors that occurred there (and are probably occurring in other murder factories). It’s not like the media doesn’t mind sensationalizing other stories, either, ones that fit in with the agenda they’re peddling.

Indeed, reporters should be talking about the baby parts in jars, beheadings, their cries of anguish. Too many out there would like to believe that abortion is only about a mother’s choice…they’ve completely blocked out the fact you’re snuffing out another life in the process. It’s high time they were confronted with the awful truth.

changer1701 on April 11, 2013 at 9:52 AM

I think that was the main thrust of Ms. Power’s article. The sensationalism angle alone should be enough for the MSM to run with the story. The fact that they haven’t because it doesn’t fit their agenda is what is a disgrace…or a revealing disgrace…or as I would say, a revolting disgrace.

What is the difference between the mass murder of the kids in Newtown and the slow motion slaughter of hundreds of babies at Gosnell’s death chamber.

Had Gosnell yanked those infants from the womb and blown off their heads with an AR15 this debacle would be front page news. Slicing their spinal cords with a scissors, “Hey whatever! Let’s talk about the Idol results!” says the bootlicking media.

dmacleo on April 11, 2013 at 11:12 AM

Here’s a dirty little secret:

In the vast majority of cases where pregnancy actually threatens the mothers life, abortion is either A) not necessary, or B) medical science has no way to trade the baby’s life for the mother’s.

i.e. Eclampsia is a condition that causes systemic inflamation and a massive sudden rise in blood pressure, often resulting in a stroke or heart attack. It can be detected early by way of a syndrome called pre-eclampsia, and the only treatment is delivery of the baby. Not termination of the pregnancy — delivery of the baby. Statistically, the odds of eclampsia in a mother whose fetus is medially unviable is astronomical.

gryphon202 on April 11, 2013 at 11:20 AM

The really bad thing about this story is that not a bit of it is shocking.

It’s hardly shocking that an abortion clinic would not see the babies they were trying to abort as worth saving.

It’s hardly shocking that the abortionist, in the rush to make money the easy way, would just induce labor in pregnant women, then kill the babies once delivered. So much easier than all that tiresome work carving the baby up in the womb.

It’s hardly shocking that the media wants to pretend nothing is going on.

It’s hardly shocking that the world at large isn’t even aware of the trial going on.

Don’t get me wrong. Every bit of the above is really sad. But none of it is shocking. When you can rationalize away the killing of innocent life, the rest follows.

Resist We Much – your posts are exactly right. It’s infanticide.

A live child, and that includes a premature infant, no matter how it emerges from the womb, is not the private property of the mother or doctor. They cannot alone decide its life or death. It is morally defined by Natural Law with rights to: life, liberty and the pursuit of happiness. And legally, that infant is a citizen, and thus, under the protection of the state.

It’s infanticide. There is no other definition for this practice.

Also, saying obama makes you lose any shred of credibility you may have had.

nonpartisan on April 11, 2013 at 10:38 AM

Actually, it means that he did his research and understands what Obama advocated as Illinois state Senator…

Obama votes “No” on Illinois born-alive bill. This is a scanned PDF of the actual recording of the vote. The “Born Alive Infant Protection Act “provides that a live child born as a result of an abortion procedure shall be fully recognized as a human person and accorded immediate protection under the law. All reasonable measures consistent with good medical practice, including the compilation of appropriate medical records, shall be taken to preserve the life and health of the child.”

This bill was created after an Illinois nurse named Jill Stanek testified before the Health and Human Services Committee that she had discovered that babies were being aborted alive and allowed to die in soiled utility rooms. One baby was accidentally thrown into the trash.

Obama never bothered to attend the committee hearing that precipitated the bill, even though he voted against the bill not once or twice, but FOUR TIMES.

If you look up Jill Stanek, you can read about this in detail.

Transcript of Obama’s speech against the born-alive bill, where he describes a baby that survives an abortion as “fetus or child, as some might describe it, is still temporarily alive outside the womb”. In other words, he describes a baby as a fetus and says that others may claim its a child, but he still considers it a fetus, outside of the body, that is still part of the abortion decision to be killed. He also vocally laments the burdening of doctors to keep them alive. (Although why is that a burden, unless they aren’t really doctors under the hippocratic oath…)

Those items coupled with the interview where he describes he would support killing his own grandchildren if his daughters were “burdened” with a child, pretty much confirms the original poster comments.

Apparently, you don’t know much about the monster you voted for…

Dire Straits on April 11, 2013 at 11:39 AM

Funny you would say that. :) The skill set comes from exactly the same place.

When you look at Powers’ rundown of the coverage — which is ridiculous; why are we even talking about Kirsten Powers and her “courage” in doing her job for once? There are other sources. If this is about claiming her for our side, as a kind of in-your-face, lefty, side-story, my vote is to put her back over there where she goes — the point of view the media have had seems similar to Nonpartisan’s. They think of it as a juicy abortion story, and they aren’t into juicy stories that are juicy for the other side. Hence the continuous bankruptcy proceedings.

Contrast that with the other point of view: A franken-doctor has been quietly waging a massacre of babies.

Makes me wonder about conversations in other streets in other nations about other things at another time, none of which I am allowed to specifically mention . . . ’cause the comparison is never valid . . . for some reason I can’t remember at the moment.

Yes. Welcome to Hot Air, where the trolls are able to say pretty much what they want, hijack threads, name call and generally degenerate any thread.

You know, what we’d be banned instantly forever for on any other site.

I have been looking, albeit not that hard, for another site where I can get a decent news aggregate.

Suggestions?

kim roy on April 11, 2013 at 11:50 AM

Why don’t some of you posters create a better place? Many of you have struggling little one-man blogs that will never leave a mark.

Look at the big successful blogs, they all start with a group of three or four bloggers that get together and start something. That’s how Malkin started Hotair, that’s how Instapundit and Gatewaypundit started. You can’t make it on your own. There aren’t enough hours in the day for one person to do it. Walker and RWM would be a good start for example. Quit bitching and get to work.

Bonus, some day you will find you own a corporate entity worth some real money and you can quit your day job.

you know I never see abortion supporters railing against laws that charge someone for killing a fetus (baby) when they assault a woman.
seems to me if the woman wanted the child they are fine with extra charges being filed (as am I) but they are fine with killing it otherwise.

YHGTBFKM. Pro-abortion groups DESPISE Unborn Victim of Violence Acts. Where have you been?

Maddie on April 11, 2013 at 1:32 PM

So, if a late term abortion results in a live healthy birth then it’s ok to kill the baby. How long can the death be delayed – seconds, minutes, hours, days? Now what if the abortion death (demise) happens years after the live birth? What if happens if the late-term live birth aborted fetus lives into adulthood and someone murders the adult late-term live birth aborted fetus? Then is it murder or is it just finalizing the abortion with demise?

“Judge I didn’t kill anyone because it wasn’t a person it was a late-term live birth aborted fetus and I assisted with its demise,” said the alleged late term abortionist (not killer).

Of course that opens up the argument of when does life start. I know a lot of politicians, attorneys and judges who still have no soul. Maybe that’s why they have no problems with their conscious when fighting against the rights of the unborn and now the recently born.

We lost our daughter to pre-eclampsia two years ago. The OB performed a C-section to save my wife’s life (who was in near critical condition), and our daughter was too young to be viable at 22 weeks. She lived only a few minutes. I have personally met those astronomical odds.

stvnscott on April 11, 2013 at 3:14 PM

It’s my opinion that a person would have to be insane to be an abortionist or one of their assistants; stone-cold, black-hearted insane.
Bishop on April 11, 2013 at 9:53 AM

In a recent online argument regarding horse slaughter, it was brought up that the person doing the actual killing in a slaughter plant had to go through psychological testing and they rotated out every few weeks so they wouldn’t get desensitized and start to enjoy the killing. I think that regulation would be a good one for abortion mills.

Gosnell: Kill the baby before it’s a newborn “well-child” so I don’t have to care for it! /Gosnell off

If a delivered baby is truly stillborn, there is no need to “snip” his/her spinal cord. If the baby was born alive, cutting his/her spinal cord is infanticide. Even lefty liberal pro-choice Kirsten Powers knows that.

Throws this murdering monster Gosnell in jail and throw away the key!!!

Steve Z on April 11, 2013 at 5:07 PM

These are the kinds of details, though, that most media would find fascinating in any other criminal trial. Kirsten Powers makes the same point in a column at USA Today this morning, wondering why national media outlets can’t find room to discuss a butcher who maimed women and the government agencies that looked the other way:

Kirsten Powers is the Captain Renault-Casablanca of the democrat party. Because of your occasional orangey bad dye job, we all know the carpet doesn’t match the drapes. So, you can drop the dumb blonde act already, honey.

RovesChins on April 11, 2013 at 5:38 PM

That’s why showing mothers the ultra-sound of their babies is so vehemently opposed by pro-abortion groups. Seeing the ultrasound makes you realize there’s a living, growing baby inside you.

hawksruleva on April 11, 2013 at 11:03 AM

A friend of my brother called him right before Easter saying the friend’s girlfriend was thinking about having an abortion. My brother drove 5 hours to see them on Easter, took her to a place to get an ultrasound, and she decided to keep the baby.

Folks like Andrew Sullivan and Kirsten Powers are allowing me to actually REACH some libs through FB.
I’ve given up posting any conservative links, since I KNOW they shake their heads in pity for my stupidity and ignorance, BUT, posting the aforementioned columnists, FBers are lured into actually reading these truths.
Doesn’t hurt.

pambi on April 11, 2013 at 12:15 PM

Brilliant strategy.
The trick is finding someone among the columnists they do read who will publish the things they need to know. That a few media personalities on the Left are breaking ranks is a start to reaching the tipping point.
The second trick is getting your friends “converted” before they learn not to follow any links you post, regardless of the source.
The drive to avoid cognitive dissonance is very powerful.
