Via Newsbusters, something to tide you over on a news day that started out fast and has slowed considerably. Give Harris-Perry credit, at least, for fine-tuning her messaging. You’re not going to sell swing voters on far-left liberalism by telling them their kids don’t really belong to them, but tell them that they have a right “at all times” to things they need and you’re golden. If you polled the public on whether people should have a right to all of this, where would the numbers top out? Seventy percent? Eighty? The American public loves, loves, loves government spending, partly because they’re never asked to consider the zero-sum nature of federal expenditures in a budget that balances and partly because they still don’t fully appreciate the consequences of endless borrowing. Both parties spent years shrugging at the fallacy that current spending levels can be supported by current tax rates. Under those circumstances, why wouldn’t the average low-information think everyone should have the right to housing, food, etc? Throw in the right to phone service and personal transportation while you’re at it. Put it on our collective tab.

Note, per Newsbusters, that she’s all for having the most productive members of society earn “a little more.” Whew. By the way, if you think these promos are bad now, just wait.

i tried to watch Chris Hayes (one of the repeats) last night. Could not get past his squeaky voice. Kid really needs to get some voice lessons..

but he was interviewing some dumb football player who had the nasty habit of undermining his legal case against the NFL. So Chris in a yeoman like manner saved the story by guiding him bank to the narrative. He then interviewed some slip and fall lawyers about Workplace injuries.

There is no right to Medicare (and, by extension, Obamacare). See Heckler v Ringer, 466 U.S. 602 (1984). The Secretary of Health and Human Services renders a “final decision” on the claim in the same manner as is provided in 42 U.S.C. § 405(g) for old-age and disability claims arising under Title II of the Social Security Act. Title 42 U.S.C. § 405(h), to the exclusion of 28 U.S.C. § 1331 (federal question jurisdiction), makes § 405(g) the sole avenue for judicial review of all “claim[s] arising under” the Medicare Act. The DHHS Secretary makes the final determination of what is covered and whether you are entitled to a particular treatment.

Patients whose medical care is provided by public funds have no constitutional right to whatever care [their physicians] using “the highest standards of medical practice”…may “judge necessary”… or to obtain that care “from a physician … of their choice.” - AAPS v Weinberger, 395 F. Supp. 125 (1975).

Unlike the “right to die” or the “right” to have an abortion, the right to choose one’s medical treatment is constitutionally protected. A US Circuit Court has ruled that a Medicare beneficiary may not even spend his own money to buy a service that Medicare regulations say is “unnecessary”, New York State Ophthalmological Society v Bowen, 861 F.2d 1283 (1988).

By declining to hear the appeal, SCOTUS upheld the finding of the District Court that physician participation in Medicare was “voluntary.” Underlying the constitutionality of the challenged legislation is the basic premise that each individual physician and practitioner “has the ability to choose whether or not to participate in the system.” It is true that there will exist economic incentive or inducement to participate in the programme; however, such inducement is not tantamount to coercion or duress.

There is no right to housing, Lindsay v Normet, 405 U.S. 56 (1972). The Civil Rights Act guarantees only that access to housing accommodations be free of discrimination. There is no other major legislation that even mentions housing. A right to housing has been argued for since the New Deal and has lost every time.

and food at all times

There is no right to food. If the Federal government can prevent a farmer from growing food for his own family, then you have no right to food. See Wickard v Filburn, 317 U.S. 111 (1942).

More specifically, there is no right to welfare, including food stamps. The Court ruled in Goldberg v Kelly, 397 U.S. 254 (1970), only that welfare recipients facing “brutal need” are entitled to a due process hearing before benefits can be terminated.

These liberal precepts are exactly why the Left opposed Bork so much.

For Constructionists like me, this is all BS.

The primary right I have is to free to determine my life. If I bomb out getting a house on an estate, tough noogies for me!

I scrimped and saved at a crappy part time job to pay my college tuition. I wanted it and did what I needed to make it happen. No one owed me a thing; I have no ‘right’ to it.

I don’t have a ‘right’ to food. Besides, liberals like Bloomberg make it hard as they/he can to leave the hungry on their own, attacking charities. So liberals can’t tell me a thing. If I have a ‘right’ to food, then I end up stealing from others if I refuse to cover my own ass. My view is, if I’m a problem, then I’m my own and shouldn’t be yours.

Liberals: Far overpriced at a dime a dozen.

Both parties spent years shrugging at the fallacy that current spending levels can be supported by current tax rates.

Here’s your problem. Once the democrats took over the Republicans suddenly became cognizant of fiscal reality issues and Democrats forgot about them. Because THAT’s how you get elected. But the first time one of them actually follows through upon receiving the stamps of the offices, I may fall over dead.

But by all means, use this to garner election chances. Because its hollow coming from those asking for votes.

Except maybe Rand Paul, and god know’s everyone is ready for his crazy slip to show at any moment. The rest? Your a fool if you emotionally invest yourself in believing it.

And probably better to tax and spend rather than borrow and spend in the interim until some semblance of sanity can possibly rear it’s ugly head. Which I don’t expect.
