Occupy Los Angeles has chosen to honor Chris Dorner in the wake of his death, despite the body count he apparently amassed…

The statement of support and solidarity was posted on the Occupy Los Angeles’ official Facebook page Wednesday. The statement came in the form of a posted picture captioned with the phrases “Rest In Power Chris Dorner” and “Assassinated By The Police for Trying To Expose LAPD Corruption.”

The “We Stand With Christopher Dorner” Facebook page had drawn almost 22,000 likes Thursday afternoon. “We Are All Chris Dorner” drew 4,400…

Scott Talan (@talan), a professor of public communication at American University in Washington, told USA TODAY that some people have grudges against government, police or other authority and see a bit of themselves in Dorner…

He noted that social media make visible what some people say in private. “We can see the posts. We can see the tweets,” he said. “Before, they would have said these things in a car, in a bar, in a home, and no one else would have known.”

Online support for Dorner in the days since his rampage has crept out of the internet’s more extreme corners — where such perverse boosterism is commonplace — and into more mainstream venues. Dorner is now hailed as a kind of folk hero by some on the Chomsky-esque left and the Ron Paul right, who view the killer’s manifesto as an articulate indictment of the “police state” they have always opposed.

“This story has a lot of moving parts, thanks in large part to Dorner’s long manifesto,” said J.M. Berger, a journalist and expert on domestic extremism. “With the fragmentation of the media these days, people are more prone to selection bias — they pull out the parts of a story that resonate with them and ignore the parts they don’t like. This is really a common practice among extremists, but it’s creeping into the mainstream more and more.”

“The LAPD’s troubled history and continued bad reputation are also big factors here,” Berger said. “I think it’s difficult for a lot of people to root for the LAPD under any circumstances. But you really have to ignore big parts of Dorner’s story in order to cast him as Dirty Harry or Rambo, as many people have. Dirty Harry didn’t kill the daughters of people who got on his wrong side.”

It is important to remember that Dorner murdered a young woman and her fiancé simply because she was the daughter of a cop — the man who acted as Dorner’s defense advocate in the LAPD proceedings against him. But as one comment on a left-wing site noted, that was a good idea: If the cop had been murdered, he wouldn’t have suffered, but now that his daughter and her fiancé have been murdered, the cop will experience real pain until he dies.

Any public figure, and especially any member of the clergy, who does not unambiguously condemn Dorner as a psychopathic murderer is failing his or her duty. This is not the time to discuss allegations of racism in the Los Angeles Police Department. For one thing, being wrongfully dismissed from a job — if, indeed, that is what happened to Dorner — inhabits a different moral universe than murder. For another, the more the public pays attention to this murderer’s “manifesto,” the more murders-for-attention will take place…

What we have here is another proof that nothing leads to murder and other evils more than a sense of victimization.

Back during those frantic bail-out days, Pelosi made it a point to make sure American Samoa was exempt from any federal minimum wage rules…

Of course, StarKist is headquartered in her district…and her husband owns a big chunk of tuna, over $18 million or so.

But, the kicker is that American Samoa and other US territories were allowed to remain exempt from federal minimum wage rules because…wait for it…to make employers pay a higher minimum wage would mean a lot of employers would pull out of American Samoa and other US territories and seek cheaper labor elsewhere….Western Samoa, for example. And the locals would suffer enormous unemployment and loss of dignity.

But…Pelosi and crew all demand that we, here, blindly accept yet another Progressive demand for a higher minimum wage so those with large families here in the USA can afford to live and live with dignity.

Ummm…yeah.

This evening on the CBS Evening News, they ran audio recordings of the police yelling out that they should burn down the cabin.
No too long after that, they hurled CS-gas canisters into the cabin .. you know .. the ones that have a history of starting fires and burning down structures like the Branch Davidian compound in Waco, TX. And true to their history, they caused the cabin to become engulf in flames.

I’m not going to defend Dorner, but that doesn’t mean he was the only “bad actor” in this story.

Dorner was involved in a homicidal rampage – he had already murdered four people, and had threatened to kill untold numbers more. The rampage had to be ended. If that meant the death of the homicidal maniac, then too effing bad. He signed his own death warrant when he embarked on his rampage. He had many opportunities to surrender or turn himself in.

My question to you is: HOW MANY MORE LIVES would you want to sacrifice, in order to satisfy your moral desire for a perfect outcome (which is evidently a capture alive, without “excessive force”).

Unless you are a forensic pathologist and have conducted his autopsy, you are assuming facts not in evidence. No one knows the cause of death unless they were involved in the autopsy or have been made privy to the coroner’s report. If there is NO carbon monoxide in his blood or soot/singeing in his throat, then the fire played NO role in his death.

There was blood at the scene of the initial shootout and there are reports that a single gunshot was heard prior to the blaze, which you might be interested to learn happen about the same time that the SWAT team was closing in on his location in the cabin. The police were there at the cabin so I’m not quite sure that we should assume that they started the fire or that the CS ignited it.

OTOH, if you are a forensic pathologist and conducted the autopsy, can you share your findings and the autopsy report you prepared?

Now, as to the allegations that the San Bernadino police acted illegally.

On the use of deadly force and law enforcement, in Tennessee v Garner, 471 US 1 (1985), the Supreme Court held that law enforcement is only permitted the use of such force against dangerous suspects, who are in flight, when killing the suspect is “necessary to prevent the escape and the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others.”

In Fourth Amendment cases, the Supreme Court has stressed that “the use of deadly force to prevent the escape of all felony suspects, whatever the circumstances, is constitutionally unreasonable. It is not better that all felony suspects die than that they escape. Where the suspect poses no immediate threat to the officer and no threat to others, the harm resulting from failing to apprehend him does not justify the use of deadly force to do so. It is no doubt unfortunate when a suspect who is in sight escapes, but the fact that the police arrive a little late or are a little slower afoot does not always justify killing the suspect. A police officer may not seize an unarmed, nondangerous suspect by shooting him dead.”

Deadly force was held not justified where a suspect’s vehicle was “moving slowly and in a non-aggressive manner, could not have hit any of the officers, and was stationary at the time of the shooting.” Kirby v Duva, 530 F.3d 475, 482 (6th Cir. 2008). Also, in Smith v Cupp, 430 F.3d 766, 774-75 (6th Cir. 2005), the Court held that suspect who had taken control of officer’s patrol car, although he was in possession of a dangerous weapon, “was not threatening the lives of those around him.”

Given the fact that a) he had killed an officer at the final shootout site, b) sent another officer to ICU where he is in critical condition, and c) continued to shoot from the cabin, lethal force could be used because:

1. It was “necessary to prevent the escape;”

AND

2. Officers had “probable cause to believe that the suspect posed a significant threat of death or serious physical injury to the officers or others.”

While I would prefer that LE not use lethal force because I don’t support state-sponsored killings, I have no problem with using it if the alternative is the deaths of more innocent people. LE would have been completely within the law to take him down.

Thanks for the legal perspective on lethal force. However, I don’t think that J Crater is going to answer my question about how many more people should die, in order to achieve a picture-perfect arrest.

When dealing with real-life homicidal maniacs, the endings often do not go quite as smooth as they do on TV. Maybe J Crater thought that we could make a clean, no-excessive-force arrest by carpet bombing the area with pixie dust and unicorn farts.

Please see RWM’s post on the law concerning the use of lethal force in the process of making an arrest, or (particularly relevant in this case) prevening the escape of an individual posing an immediate risk to the community at large. Dorner had already murdered four people, and had threatened to murder many more. Yea, capture him if you can, but he gave every indication that he was going to go down fighting, and wanted to take a lot of people down with him. He had many opportunities to surrender peacefully, and chose not to.

Using lethal force to end a rampage like this is obviously not ideal, but it is better than allowing the rampage to continue. Better to have the murderer go down, than lose any further lives (whether they be civilian or law enforcement). Would you agree?

MOSCOW (AP) — A meteor streaked across the sky above Russia’s Ural Mountains on Friday morning, causing sharp explosions and injuring more than 400 people, many of them hurt by broken glass.

“There was panic. People had no idea what was happening. Everyone was going around to people’s houses to check if they were OK,” said Sergey Hametov, a resident of Chelyabinsk, about 1500 kilometers (930 miles) east of Moscow, the biggest city in the affected region.

“We saw a big burst of light then went outside to see what it was and we heard a really loud thundering sound,” he told The Associated Press by telephone.

Fragments of the meteor fell in a thinly populated area of the Chelyabinsk region, the Emergency Ministry said in a statement.

Interior Ministry spokesman Vadim Kolesnikov said more than 400 people had sought medical treatment after the blasts, and at least three had been hospitalized in serious condition. Many of the injuries were from glass broken by the explosions.

Kolsenikov also said about 600 square meters (6000 square feet) of a roof at a zinc factory had collapsed.

Reports conflicted on what exactly happened in the clear skies. A spokeswoman for the Emergency Ministry, Irina Rossius, told The Associated Press that there was a meteor shower, but another ministry spokeswoman, Elena Smirnikh, was quoted by the Interfax news agency as saying it was a single meteorite.

Amateur video broadcast on Russian television showed an object speeding across the sky about 9:20 a.m. local time (0320 GMT), leaving a thick white contrail and an intense flash.

Russian news reports noted that the meteor hit less than a day before the asteroid 2012 DA14 is to make the closest recorded pass of an asteroid — about 17,150 miles (28,000 kilometers). There was no immediate demonstrable connection.

Many years ago, I recall reading a story in the local paper about a police officer who shot and killed an armed suspect. Shortly thereafter, I saw a letter to the editor complaining – I kid you not – that the officer should not have used lethal force because he should have just kicked the gun out of the guy’s hand (and no, the suspect was not lying down).

I guess she had seen too many episodes of “walker: Texas ranger”.

Apparently our police are supposed to be ninjas of some kind.

There was a show on the other day for the anniversary of the LA/Rodney King riots. The guy who hit the trucker with the brick said he didn’t regret it. He said it was just cause because Rodney King was beaten.

Exhibit A of the sickness in this country..and Obama and pals have been fertilizing it and it grows. People consumed with hatred quite easily become the thing they hate. They don’t see the evil in themselves but see it in everyone else.
I was appalled when I watched the OJ verdict. I was pretty young..the display of cheering,crying,celebrating solely because a black man beat the system hit me like a 2×4. 2 people slashed to death and no big deal..just collateral damage for some social justice.
No moral compass. That goes for Reginald Denny,Dorner and countless other examples. Makes me ill.
