Open thread: Feinstein assault-weapons ban stage show

posted at 10:01 am on January 24, 2013 by Ed Morrissey

It begins at 11 am ET, and it should be a big event.  Senator Dianne Feinstein will surround herself with dozens of weapons that her new bill, being introduced today in the Senate, will ban.  According to Dana Bash at CNN, she’s learned something from David Gregory, too:

Actually, I’m not sure that the DC police would have done anything about it anyway.  Article I, Section 6 states clearly that:

They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.

I guess it could have been considered a felony to have all those weapons together in one place, but if so, doesn’t that undermine the need for the ban? Still, better to get the police informed up front rather than have the DC AG give a lame excuse later for not prosecuting a lawbreaking stunt. Katie Pavlich has more on the substance of Feinstein’s proposal, and this part will be the most contentious:

Requires that grandfathered weapons be registered under the National Firearms Act, to include:

-Background check of owner and any transferee;
-Type and serial number of the firearm;
-Positive identification, including photograph and fingerprint;
-Certification from local law enforcement of identity and that possession would not violate State or local law; and
-Dedicated funding for ATF to implement registration.

ATF, ATF … say, wasn’t that the agency that shipped the same weapons over the border without demanding fingerprints, registration, or even an attempt to track them?  Sounds like putting a tax cheat in charge of the Treasury.  Oh, wait

As Katie wrote earlier, this basically treats current law-abiding citizens like criminals for conducting perfectly legal transactions in the past.  It will, in fact, turn them into criminals at some point if they don’t comply with this intrusive requirement.  And that will prevent school shootings how?

Don’t expect that to survive in the Senate anyway.  The Hill reports that Harry Reid will open the floor to amendments on the gun bill, perhaps in hope of gutting it without his own fingerprints on the knife:

Senate Majority Leader Harry Reid (D-Nev.) on Tuesday pledged to hold an open amendment vote on a major gun reform bill — a move that could trim the scope of the expansive measures being sought by liberal Democrats and gun-control groups.

The decision could significantly increase a bill’s chances of passage, granting centrist senators on both sides of the aisle more leeway to vote safely on specific aspects of gun control that could otherwise haunt them at the polls in 2014. …

The open amendment process also holds the potential to weaken the bill by allowing Republicans to put forward amendments tempering the measure’s strong language and broad reach.

The bill will need 60 votes to pass, don’t forget, even under Harry Reid’s proposed filibuster reform. Right now, with Democrats like Joe Manchin wavering and at least a half-dozen other red-state Democrats having to face voters in 2014, I doubt they can even get a simple majority for this kind of bill.

bgibbs1000 on January 24, 2013 at 10:09 AM

Why doesn’t the NRA or anybody else on the right care about all the various (mainly state) laws banning certain types of knives, spears, clubs, pepper spray, tasers, and other home made weapons? The 2nd amendment doesn’t just apply to firearms.

Tc0061 on January 24, 2013 at 10:09 AM

I want every Dem to support it, as she presents it. The Constitution prohibits bills of attainder and retroactive laws, but the Dems should circle the wagons and vote for it anyway.

I know they won’t, with the ensuing comedy of them squirming and trying to win wiggle room on a political razor’s edge will be fun to watch.

Bill Introduced To Repeal ‘Gun-Free School Zones Act’ Because Deadly Mass Shootings Up Five-Fold Under It
http://cnsnews.com/blog/craig-bannister/bill-introduced-repeal-gun-free-school-zones-act-because-deadly-mass-shootings

Rep. Steve Stockman (R-TX) has introduced a bill to repeal the “Gun-Free School Zones Act” of 1990 (updated in 1995) on the grounds that mass shootings at schools have increased five-fold since its passage.

The “Safe Schools Act of 2013″ (H.R.35), co-sponsored by Rep Broun, Paul C. [GA-10] notes that the 1990 “gun-free” law has made schools unsafe because “shooters now know that they can victimize American school campuses with no fear that victims will be armed.”

The California Democrat intends to expand on the ban that expired in 2004, by including handguns and shotguns, in addition to rifles. She would decrease from two to one the number of cosmetic features on a gun to have it be considered an “assault weapon.” This means that if a gun has just one item like a pistol grip or bayonet lug, then it is illegal. Gov. Andrew Cuomo signed into law the same ban in New York last week.

Bans the sale, transfer, importation, or manufacturing of: 120 specifically-named firearms; certain other semiautomatic rifles, handguns, shotguns that can accept a detachable magazine and have one or more military characteristics; and semiautomatic rifles and handguns with a fixed magazine that can accept more than 10 rounds.

So democrats waive that big scary AR around with the talking points “who needs a gun like this”….then their corrupt, lying asses go after shotguns and handguns to.
….all we have heard from the Morgan/MSDNC/Bloomberg crowd is that they are only going after “assault rifles”……and as usual….democrats lie their asses off.

Once again reinforcing the fact that liberals are just a bunch of tax hiking, liberty taking, over spending, gun grabbing lying Sons-of-b!tches.

….oh yea…and major hypocrites to:

(via Instapundit)
Bloomberg:

Oh, and when he jets off to Bermuda, he takes armed New York City detectives as bodyguards. “The mayor also takes along a police detail when he travels, flying two officers on his private plane and paying as much as $400 a night to put them up at a hotel near his house. . . . Guns are largely forbidden in Bermuda — even most police officers do not use them — but the mayor’s guards have special permission to carry weapons. A spokesman for the Police Department declined to comment.”

….Us Peasants don’t deserve the right to defend ourselves the way that the elitist get too…..know your place!!!!….now eat cake!!!!

FONTANA, Calif. – The school police force in this Southern California city has acquired 14 high-powered semiautomatic rifles for officers to bring to campuses.

Fontana Unified School District police purchased 14 of the Colt LE6940 rifles last fall, and they were delivered the first week of December, a week before a gunman killed 26 students and educators at a Connecticut elementary school.

California Senator Feinstein….explain please.

Missouri lawmaker introduces bill criminalizing failure to report gun ownership to child’s school
http://dailycaller.com/2013/01/23/missouri-lawmaker-introduces-bill-criminalizing-failure-to-report-gun-ownership-to-childs-school/
The bill, introduced by Missouri Democratic State Sen. Maria Chappelle-Nadal, would make it a crime to fail to report gun ownership to a school and to store a firearm in a place where a child could possibly access it. The legislation also criminalizes failure to prevent illegal possession of a firearm by a child under the age of 18.

“I am not trying to take away the gun rights of any parents or any other citizens.,” Chappelle-Nadal said.

They are playing for the next massacre. They know the average gun owner won’t do something stupid but they are trying to get some fringe nuts to start pushing lead down range as further ‘proof’ that guns have to go.

Limerick on January 24, 2013 at 11:00 AM

Poor Di, in her waning years, still trying to relive the glory days of 1994.

Did anyone bother to ask Di HOW MUCH all of this was going to cost? Or would that be ‘irrelevant’?

Prior to taking a vote, maybe Harry or Nancy-poo will also mention “We voted FOR the ban in 1994 – and got voted OUT of office in 1996.”

Yeah, the “hero” Milk was quite the scumbag. But Mayor Moscone was quite well liked and Dan didn’t seem to have a beef with him. Oh well, “what difference does it make” now that Twinkies are off the market.

A phrase from all this revisting ‘gun control’ legislation:
‘The only assault weapon I am fearful of, is a politicans pen.
We get the government leaders we deserve.
Leahey, Schumkie Chucklie Schumer, Levin, Franken, Frankenstein, Pelosi, Gonzales, Grijalva, Boxer, … the list is astoundingly LONG. And most, if not ALL are members of the Gimmedat Party.

Missilengr on January 24, 2013 at 11:06 AM

How about the death penalty for the use of a gun while committing a felony?

Better.

Even so, I used a metal shredder on my guns weeks ago. They’re gone, dust, feel free to paw through the local landfill for them, maybe you will find a chunk of picatinny or a trigger guard.

Bishop on January 24, 2013 at 10:18 AM

Heyyyyyy – wait a minute…. didin’t all your guns fall into the lake a month ago – like mine did?

How unfortunate that the Draco AK pistol I should be picking up tomorrow will likely fall in the lake on my way home…..
Now I need to find a lake…..

dentarthurdent on January 24, 2013 at 11:07 AM

While I admire the optimism that nothing like this would ever pass the Senate or House, may I remind everyone that we all said the same GD thing about Obamacare?

Melt the phone lines, people.

Scott Brown to vote yes!

Oh wait…

Eph on January 24, 2013 at 11:12 AM

Of course I would throw in something crazy just in case she has been coached, such as “I see that AK there has an tunable shroud extender, would you be banning those as well?”

Bishop on January 24, 2013 at 10:28 AM

Heh. “Will your bill prevent an accidental jibe? Will you be banning scuppers and boom bails?”

SailorMark on January 24, 2013 at 11:18 AM

As a note, currently NFA applications are taking between 9 months to a year for the ATF to process.

Oh, and her bill will probably ban transfers. So I won’t be able to leave my 69 year old M1 carbine to my kids. Well, I wouldn’t if I intended to comply with any such law. Which I don’t.

Spade on January 24, 2013 at 11:18 AM

Although I support the spirit of your post, do you really think the GOP will keep this unconstitutional action on the front burner?

Mr. Arrogant on January 24, 2013 at 10:24 AM

Then, it’s kind of up to US to make sure it stays out front, isn’t it?

Jeez, people! Rather than whining about the “bend-over, fold-up, ineffective GOP” all the time…why not start doing something for ourselves. Lead the way…instead of waiting around for a leader. Take the initiative.

Adapt. Improvise. Overcome.

Solaratov on January 24, 2013 at 11:19 AM

CNN running caption under Feinstein that says something like “No 2nd Ammendment Right To Own Every Weapon” Gee, what part of “shall not be infringed” are they not getting.

apostic on January 24, 2013 at 11:20 AM

Carolyn McCarthy just acknowledged that their will be a black market for guns and magazines even if the DiFi gun ban is passed. Only those that don’t have the ability to get to the black market will not be able to buy them…for the children.

d1carter on January 24, 2013 at 11:25 AM

Not watching. Is she waving the weapons around like an idiot without regard to where the barrel is pointing (always assume it’s loaded!)? Is she putting her finger directly on the trigger again (always assume it’s loaded!)? Does she have a callous disregard for whether or not the safety is engaged (always assume it’s loaded!)?

Red Cloud on January 24, 2013 at 11:25 AM

Feinstein = former mayor of San Francisco.

What does that tell you? It takes a special kind of stupid to be mayor of that town.

UltimateBob on January 24, 2013 at 11:25 AM

Well….crap. Most guns these days are sentient and operate by themselves so this is not good.

I’ve heard liberals fantasizing about how the military would obliterate “wingnuts” who tried to fight a gun ban.
They are in for a rude awakening should it comed to armed resistance.

Criminals are exempt from registration requirements.

Requiring a felon to register his firearm would be a violation of his Fifth Amendment rights.

Thus sayeth the SCOTUS.
