In his first term, FDR had to deal with a Supreme Court that did not just roll over and play dead to his actions when it reached the Court. If the Court still believes in private property, freedom of contract, etc., then it might just declare significant sections of law unconstitutional. At that time the Court was not even unanimous in the struggle between progressive ideals and Constitutional limitations.

Hence the court packing attempt but that would have invested way too much power in a single administration so it failed.

After FDR’s re-election by an overwhelming margin, the Court could see that “the Country wants it” and, besides, FDR would be able to appoint new justices when, and it was expected, there would be retirements, so the Court then changed its tune. Thus started the changes in our society, for better or for worse.

Obama is just the recipient of 70+ years of steady progress in expanding government. It is not too surprising to think he accomplished (for better or for worse) more in 2 years than FDR did in any similar fashion.

I would add that Republicans were shaped by how events flowed. So in one sense I am not too surprised at how they try to operate — it was the environment they had to live with — and do not seem to be able to stem the flow.

There’s a subtext that we can’t ignore. Reid, Obama and Pelosi consider themselves historic figures and they’re proud of forcing these disastrous and unpopular changes on an unwilling nation. They pride themselves on their imagined fortitude and place in history.

Part of our job is to help them understand that their actions may be historic, but not for their imagined reasons and not to their credit.
