Breaking: Obama to announce gun-control proposals tomorrow

No big surprises, except perhaps the timing:

President Obama will unveil a sweeping set of gun-control proposals at midday Wednesday, including an assault weapons ban, universal background checks and limits on the number of bullets magazines can hold, according to sources familiar with the plans.

The announcement, to be delivered at the White House, is also expected to include a slate of up to 19 executive actions that the Obama administration can take on its own to attempt to limit gun violence.  The White House has invited key lawmakers as well as gun-control advocates to appear at Wednesday’s policy rollout, according to two officials who have been invited to the event.

The rollout event looks like a revealing bit of theater.  I’m going to guess right now that there won’t be a broad bipartisan showing at it, since the above proposals don’t even have unanimous Democratic support, especially the assault-weapons ban.  Instead, it seems that Obama wants to surround himself with as many supporters as possible and claim it shows a broad consensus for his plans, even while Harry Reid is downplaying the likelihood that its centerpiece can pass the Democratic-controlled Senate.

Why rush the rest and get ahead of Reid on the assault-weapons ban?  Obama could easily have just announced all of the EOs and been depicted as a Commander in Chief, even though — as Allahpundit pointed out earlier today — the amount of authority he can exert through EOs is very limited.  If Reid isn’t fully on board, then there’s simply no way that Obama will get 60 votes in the Senate to clear cloture on this package, and some of the nays may well come from red-state Democrats eyeing the 2014 contests nervously, like Mark Pryor in Arkansas.

I think most lawful gun owners are just putting too much faith in the D.C. crowd to ultimately stand up for our 2nd Amendment rights. I really believe gun owners believe this will have a happy ending for all concerned.

Everyone should understand that the next “mass” shooting will prompt Obama to issue his “Executive Order” ultimatum. He will bypass Congress and simply order law enforcement agencies to start rounding up legal, registered guns and that will be the start. Where else can he begin, except to order the confiscation of registered guns? And I believe that will include all firearms, including those firearms used for hunting and target purposes. Next, he will allow a time limit for those lawful citizens that “cling to their guns” to turn them in voluntarily. Let’s say 90 days, and then “clingers” who still refuse to give up their firearms will face very stiff fines and jail time for failing to comply.

What happens next after the majority of lawful gun owners comply? Hard to say, except the criminals will still have their illegal and stolen firearms in their possession. Not sure how he’ll deal with that. But one has to understand who Obama is. Ted Nugent called Obama psychotic and I truly believe that. He will go forward with his “Executive Order”, leaning back with his head cocked towards the sky, honestly believing that his ordained destiny is to disarm the American citizenry.

What’s frightening is that no group of people can stop him. Oh, there may be pockets of resistance here and there, but this is not the 2nd Revolutionary War were talking about. This is reality and we are doomed as a country. I submit that within 6 months after his “Executive Order”, millions upon millions of lawful citizens will not have their firearms anymore. And many firearm manufacturers will be out of business, as well as the retail gun shops. Do you all believe that bloggers and their followers are going to mobilize and stop the madness of Obama? And speaking of mobilizing, that is the only possible way to combat the agenda of Obama, but no one is really willing to put forth the effort. It just isn’t going to happen, and those that dream of armed resistance in the name of freedom and liberty are in for a rude awakening.

You should know that quote is of dubious provenance. The Nazis did not impose new gun regulations until 1938. They did not need to given the fact that civilian possession of all firearms and ammunition, including those then currently owned, was banned in 1919 by the Weimar Republic when it enacted the Regulations on Weapons Ownership. Germany was required to disarm its populace, in large part, by the Versailles Treaty. The following year, the Weimar government passed the Law on the Disarmament of the People, which put in place the Versailles Treaty’s limitations on military-type weapons in both the hands of the government and the people.

In 1928, the Weimar government passed the Law on Firearms and Ammunition, which loosened gun laws, but imposed very strict and mandatory licencing. It repealed the 1919 law, Regulations on Weapons Ownership.

The German Weapons Act of 1938 replaced the 1928 law. As with the Law on Firearms and Ammunition of 1928, all but exempted citizens were required to register their weapons and be permitted before acquiring a gun and then permitted again before said firearm could be carried. The law restricted gun ownership to those “…persons whose trustworthiness is not in question and who can show a need for a (gun) permit.”

Under The German Weapons Act of 1938:

* Gun restriction laws applied only to handguns, not to long guns or ammunition. Rifles and shotguns were completely deregulated under this law, as was the ammunition used with either.

* The groups of people exempted from registration and permitting requirements were expanded to include members of the Nazi Party, holders of annual hunting permits, and government workers.

* The legal age of gun ownership was lowered from 20 to 18.

* Gun carry permits were valid for 3 instead of 1 year.

* Jews were not allowed to manufacture or trade in firearms or ammunition.

* Like the 1928 law, gun sellers at both the wholesale and retail levels were required to maintain records with the names of buyers, types of weapons, and the serial numbers. All of this data was required to be turned over to the national government every year.

In 1939, the Nazis also decreed via the Regulations Against Jews’ Possession of Weapons that no Jew could possess firearms, ammunition, and other specified weapons.

Nevertheless, the point remains: Hitler disarmed the people he wanted to exterminate or control most: The Jews.

Thanks. It wouldn’t surprise me. The US exported eugenics to Germany. Why would it surprise anyone that the US would import gun control policies from Germany? After all, much of the Left’s “Absolute Shall” dogma, Hegelian and Nietzsche philosophical bases, and Bismarckian socialism. Herbert Croly, Richard Ely, etc, were big cheerleaders of German social policy, for example.

Absolutely and they do so because they believe in the rule of law. The problem is that criminals never follow the rule of law. (I’m not referring to street thugs here) They also put too much trust in the police and military to do the right thing. I don’t have the friends or platform for the level of community organizing it would require, but someone should get the word out that as soon as the effective date hits any gun owners who can should carry any magazine, bullet, etc. down to their local police station or sheriff’s department to turn themselves in and/or seek guidance on the law.
 
Don’t be bullhorned away once they catch on. Each individual needs clarification on their particular situation, and each needs it in writing.
 
Then go home, get something else, and bring it for the same clarification.
 
It’s the only way to fight this. If just 10% of the new criminal class could do this it would be overwhelming. I figure here in Charlotte it would be ~50K people, and that’s not including the county.

‘Peaceful resistance’ was 24yrs of legal challenges, hardware development, and legal Q&A that resulted in the ‘Off List Lower’ movement, the ‘Bullet Button’ device and things like the Monster Man Grip, whereby more AR- and AK- pattern rifles where legally imported sold and built in CA, than were ever barred by the feeble ban attempts of 1989 and 1991.

THroughout it all and the clear expression of the public’s will in massive purchases of arms and all their accoutrements in the winters of 2008 and 2012, the Left just keeps pushing and pushing. I’m with you, texgal. But until it actually happens, we’re not going to know who stands and who kneels, and that’s something the libs understand all too well. If they thought they could simply issue an EO banning all guns, they’d do it. But they don’t, so instead it’s ‘death by a thousand cuts.’ They’ll push for what they can get now, then in a year or two, they’ll push for more.

The only way to cause a reset in their thinking is via a massive and overwhelming response from the citizenry and the GOP leadership. Unfortunately, all they’re hearing now is crickets.

Has the constitutionality of “background checks” ever been litigated?

I am looking into it. I know that background checks played a part in Printz v. United States, 521 U.S. 898 (1997), but that case turned on whether the Federal government could force state and local authorities to conduct background checks pursuant to the Brady Handgun Violence Prevention Act. Certain portions of the Act pertaining to “commandeering,” ie, the Feds telling state and local officials/personnel that they MUST act on behalf of the Federal government was struck down as unconstitutional.

Since the case turned on unlawful commandeering and the petitioners were LEOs, I don’t believe that the Court ever delved into the issue of the constitutionality of background checks.

If a right is not bestowed upon by the government as per the constitution, shouldn’t everyone have equal access to that right, including the mentally challenged?

Yes, but absolute rights long ago went the way of the dinosaur. In United States v Lopez, even Scalia said that the right to bear arms was not unlimited or absolute and the government could regulate ownership provided the law survived strict scrutiny.

I know the mentally challenged are allowed to vote (See B.H.O elected twice) but curious as to how it applies elsewhere.

Generally, such limitations, provided that they are narrowly-tailored and are the least intrusive will survive strict scrutiny because the government does have a compelling interest in keeping weapons out of the hands of the mentally impaired. I agree that this is a very slippery slope, which is why I generally think that gun control laws should be on a state basis and always contain a right of appeal.

You should also note that felons are barred from voting in almost every state and that has been upheld. See: Richardson v. Ramirez, 418 U.S. 24 (1974). Of course, there is no constitutional right to vote, per se, (see: San Antonio Independent School Dist. v. Rodriguez, 411 U.S. 1, 35 (1973)).

You are wondering why there is silence on this issue. It is because many people are waiting for the EO that makes them outlaws. Both sides know exactly what is at stake here. You guys remind me of the Liberals who were sayng just before the first Gulf war that maybe Saddam didn’t “get it” until Tariq Aziz came out and said, “Of course we get it.”

Americans know that if Obama comes out with an EO banning guns in any way that we will have another Civil War on our hands and are planning accordingly. All the letters have been written, all the phone calls have been made, all the pleas have been spoken, written and discussed and all the data analyzed for decades. It has done no good. Tomorrow, we enter a new American phase where the USA begins to make war on its own citizens.

It begins…You see, they are giving lawful gun owners a time frame to comply with their new laws. Non-compliance will mean lawful people have now committed a misdemeanor, whatever that may mean in New York. Rest assured, that misdemeanor charge may prevent you from legally owning guns in the future, when the 5-yr. license to own firearms expires in the state of New York. Or maybe that misdemeanor charge may be enough to confiscate your firearms. Who knows, but like one commenter said, the left will never sleep until this issue is put to rest…meaning the end of the 2nd Amendment.

They mentioned another part of the new gun laws for New York…the so-called “Webster provision.” The nutcase that killed the two firefighters was released from prison by the very same leftwing nuts that are against lawful and responsible ownership of firearms. This nutcase slaughtered his grandmother with a claw hammer for cryin’ out loud. He should have been done away with years ago with a bullet between his eyes.

With all the attention this issue is getting, there will soon be another nutcase that will go bonkers and kill several people with a firearm. These crazies love the notoriety. When that happens and Obama is still in office…the country-wide confiscation begins.

I’ve said repeatedly – that the answers aren’t going to come from Washington, DC – but from the states. Don’t expect anyone of any party, within the beltway, to stand up for the 10th amendment.

It’s going to take STATES standing up and saying NO! Texas already has a proposed bill to make it a CRIME for any federal officer to attempt to enforce more gun laws within it’s borders.

The Feds can’t even enforce marijuana laws now because some states now refuse to allow it.
