Breaking: Obama to announce gun-control proposals tomorrow

No big surprises, except perhaps the timing:
President Obama will unveil a sweeping set of gun-control proposals at midday Wednesday, including an assault weapons ban, universal background checks and limits on the number of bullets magazines can hold, according to sources familiar with the plans.
The announcement, to be delivered at the White House, is also expected to include a slate of up to 19 executive actions that the Obama administration can take on its own to attempt to limit gun violence. The White House has invited key lawmakers as well as gun-control advocates to appear at Wednesday’s policy rollout, according to two officials who have been invited to the event.
The rollout event looks like a revealing bit of theater. I’m going to guess right now that there won’t be a broad bipartisan showing at it, since the above proposals don’t even have unanimous Democratic support, especially the assault-weapons ban. Instead, it seems that Obama wants to surround himself with as many supporters as possible and claim it shows a broad consensus for his plans, even while Harry Reid is downplaying the likelihood that its centerpiece can pass the Democratic-controlled Senate.
Why rush the rest and get ahead of Reid on the assault-weapons ban? Obama could easily have just announced all of the EOs and been depicted as a Commander in Chief, even though — as Allahpundit pointed out earlier today — the amount of authority he can exert through EOs is very limited. If Reid isn’t fully on board, then there’s simply no way that Obama will get 60 votes in the Senate to clear cloture on this package, and some of the nays may well come from red-state Democrats eyeing the 2014 contests nervously, like Mark Pryor in Arkansas.

It must be reinstated via Congress. Executive Orders do not trump the Constitution or Federal law. They cannot be used to create new law. All that an Executive Order can do is to direct departments and agencies within the Executive Branch to act, react, or not act at all.
The Supreme Court has overturned Executive Orders when the President has violated the Constitution and/or attempted to use powers to act in a manner not authorised by Congress. For probably the best example under exigent circumstances, see Truman’s failed attempt to nationalise the steel industry, which had been swept by strikes that had impacted war materiel manufacturing, during the Korean War. The case was Youngstown Sheet & Tube Co. v. Sawyer, 343 U.S. 579 (1952).
If the Commander in Chief cannot violate the 5th Amendment during wartime when strikes are impacting the country’s ability to wage war, the idea that a President can use an Executive Order to ban guns or create new laws/restrictions on the Second Amendment is equally dubious.
Anyone impacted by an Executive Order can sue in Federal Court for relief.

A question for you as you seem to know quite a bit about this subject.
Has the constitutionality of “background checks” ever been litigated? If a right is not bestowed upon by the government as per the constitution, shouldn’t everyone have equal access to that right, including the mentally challenged?
I know the mentally challenged are allowed to vote (See B.H.O elected twice) but curious as to how it applies elsewhere.

EO’s are signed, not as a law, but as I read it, a ‘suggestion’ to all depts agencies and other arms of the gov’t to act upon or not.
Now I think I understand the addition of our 2nd amendment rights to the HC law…
It would appear to me, that unless and until Congress acts, nothing obumbler does amounts to much more than stirring up a hornets nest, and everyone gets stung and or trampled on in the ensuing stampede.
That’s my take on it.
I know I could be wrong, but it’s what I see for now…and I know I shall be corrected, which I welcome!!
