D.C. police warned “Meet the Press” in advance that they couldn’t use a high-capacity magazine; Update: Or did they?

So says William Jacobson and he’s got the official confirmations to prove it. Yesterday this was a story about how onerous gun regs could trip up even an unwitting, innocent reporter. Now it’s a story about media self-regard:
Officer Aziz Alali of the MPD Public Information Office … gave me this statement by telephone:
“NBC contacted the Metropolitan Police Department inquiring if they could utilize a high [capacity] magazine for thie segment. NBC was informed that that possession of a high capacity magazine is not permissible and the request was denied. This matter is currently being investigate and I cannot get into any further specifics on this investigation.”
Could be that Gregory ended up using a prop, not a real magazine, but that’s not how he identified it during the segment and that’s not something that NBC has ever claimed. More from WaPo:
A police official said the case has been assigned to detectives in the gun unit. Investigators will first determine whether the segment was taped in the District and then whether the clip Gregory held up on air was real and contained bullets.
The official, who spoke on condition of anonymity because the investigation was ongoing, said detectives would be reaching out to NBC officials, but had not yet spoken to Gregory. Any request to use a magazine would have been turned down as a matter of course, the official saids, because it would have implicated police in an illegal act.

That’s the point of calling for Gregory to be prosecuted, though — to highlight how gun regs frequently force cops to waste time hassling non-dangerous, otherwise law-abiding gun owners. Charging a guy for possessing a high-capacity magazine when he had neither a gun nor ammo with which to use it is an absurd illustration of policing the weapon instead of the “shooter.” In fact, given the publicity this has gotten online, maybe they don’t even need to charge him now. Maybe the mere possibility of it happening (or the possibility of Gregory having to address this on Sunday’s show) is so ridiculous that the point has already been made.
Question, then: If the cops warned him beforehand that he couldn’t lawfully display the magazine, why’d he do it anyway? The most arresting thing about the MTP segment is how gratuitous that part is; a photo showing a high-capacity mag alongside a regular one would have made the point just as well. Why risk prosecution for such a negligible bit of showmanship, especially when gun-rights advocates could point to it as proof of how easy it is to bring a HCM into a jurisdiction with laws as tight as D.C.’s? I think it’s a simple matter of Gregory and his producers wanting to signal to their audience that their commitment to journalism trumps all else. If there’s a risk of prison here, hey — that’s something they’re willing to accept in order to please their audience with a dumb, dramatic flourish while grilling Wayne LaPierre. Besides, the risk is small. How likely is it that an anti-gun district like D.C. is going to send a reporter to jail for something he did while confronting one of the gun lobby’s top spokesmen on TV? Even if they were inclined to prosecute, the public outcry — and resulting skepticism towards gun laws — from a harsh sentence would force them to let him off easy with only the tiniest wrist slap. He risked basically nothing with his stunt and got tons of free press for it. I guarantee you that he’d do it again if he could.
Update: The confusion over gun laws deepens…
Well-placed law enforcement sources tell TMZ … a staffer from “Meet the Press” called ATF before the show aired to inquire about the legality of David holding the empty magazine during a segment on gun control. We’re told the ATF person contacted the D.C. police to find out if the District of Columbia — the place where the show is broadcast — had a law prohibiting such a display.
Our sources say the D.C. police official informed ATF David could legally show the magazine, provided it was empty. An ATF official then called the staffer from “Meet the Press” to inform them they could use the magazine.
So two different D.C. cops told them two different things?

Gregory wasn’t practicing “journalism”, he was trying to push an agenda. NBC has a sorry record of disregarding laws (and ethics) to do just that. Remember when they rigged gas tanks to explode for a Dateline segment on truck safety?
Plus, he and elites like him feel they are above such laws. Those rules are for everyone else, the great unwashed. Our kids should go to schools without armed guards, because that would be ridiculous and unsafe. His kids, though? And Obama’s, and probably most other “journalists”? Not so much. Same with DC’s silly gun laws…he can flout it. We cannot. Interesting, because all he’s done is demonstrate such laws don’t work, when someone is bound and determined to ignore them to do something WITH them. You know, like shooters are bound to.

Okay why would anybody outside the military or police need assault cutlery? If we are able to save just one person from getting fat by banning assault forks then it is worth it! Just look at the fork-related results in any upper-midwestern community. Responsible citizens would agree that they don’t need assault forks when sporks are more than adequate for recreational eating.

The only reason he won this time was because he got 10% more of the high school dropout vote in 2012 than he did in 2008, when he set a new record with 70%. You must be so proud of that.
As for training programs…many states and/or cities already do require that as a precondition.
And last time I checked, most states required such courses to be completed before one could receive a hunting license. “Hunter Safety Programs”.

What if it turns out to be Gregory’s personal property? He can’t even blame a producer or assistant. If it’s not his, then the NBC staff will be wondering how much of the blame Gregory will take for the violation and how much they will suffer.

Liberals and their concept of ‘reasonable’ gun laws are totally flawed. It is illegal to have shipped to a resident any replica of a firearm made after 1898 even if it cannot fit live or blank ammunition to the following states: CT, MA, WI, MN, and NY. In NY, however, theatrical groups and police are allowed if the group has a bona-fide account to make such purchases.

Well, just yesterday, I stuffed one just like it full, with 30 rounds. Problem was, the magazine lock wouldn’t engage (without a vigorous pounding) unless I took a couple of rounds out of the magazine. So really, I figure it only holds 28. What’s the problem?

(b) No person in the District shall possess, sell, or transfer any large capacity ammunition feeding device regardless of whether the device is attached to a firearm. For the purposes of this subsection, the term large capacity ammunition feeding device means a magazine, belt, drum, feed strip, or similar device that has a capacity of, or that can be readily restored or converted to accept, more than 10 rounds of ammunition. The term large capacity ammunition feeding device shall not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.
7-2507.06. Penalties. Any person convicted

Yes. And you guys just made me realize that public schools are teaching our kids to be criminals. I learned basic sheet metal bending in (mandatory) 8th grade shop class.
I’ve commented on this a few times in the last week or so. Someone with basic machine shop training and equipment can make a full-auto gun from scratch. (how good and reliable it is depends on the actual skill level and machine quality)

There’s nothing in the law about an exception for practicing an act of journalism. If that moronic ‘exception’ stands and is the reason used for not following the law and prosecuting Gregory, then anyone can take a 30 round magazine into DC to stand on a soapbox in front of the White House with the intent to expound on both the need for or against regulating 30 round magazines, without fear of prosecution by DC authorities.
Otherwise this law is nothing more than a bill of attainder and unconstitutional.
While this is true, it is also true that that attitude is the prime motivation for disregard of laws one doesn’t like and the breakdown of society.

If you got a few thousand a low end lathe, DRO’s and a used computer with CNC freeware can get you much better. Costs a bit more to stand up, yes, but then you can make everything at home. Have to learn the basics of machining, yes, but then the sky is the limit.
At the rate we are going the Left will be calling for the banning of plastic. Steel, on the other hand, is a different story. For another thousand you can make your own propane furnace and heat treatment rig and get into metal casting.
I love the modern age! Maybe, some day, the Progressives will get out of the 19th century.

Where is the location of this extremely dangerous magazine? Has the DC PD secured it yet? How do we know it hasn’t fallen into the hands of a criminal?

Regarding the update: The DC law is clear in that the mag cannot be legally owned whether loaded or empty. Doesn’t MTP have researchers to check the law itself online? Standard practice is if getting two conflicting opinions, get a third–like a network lawyer.
But I’m sure this new version is how all involved will get around the criminality of the event, while keeping the law fully in force for everyone else.

It wouldn’t surprise me in the least. I don’t know how many times I’ve gotten different answers from different officials about the same law.
The only thing that is almost always true is the the first answer will be incomplete if not incorrect. You need to play 20 questions to find out what you really need to do to stay within the law.

Bah, another strawman construction. DC cops told them one thing and ATF told them that the DC cops told them another thing. The second is merely a secondhand report and is as good as gossip until evidence is produced.

Besides the simple possesion charge we can also get Gregory, the production assistant, the shows producer and the prop man on conspiracy charges. Should be able to haul at least 5 or 6 people down to the jail when they get back from vacation next week.
He is also lucky he was not trying to load ammunition into the magazines, possesion of ammunition is also a serious crime in DC.

Gregory will be protected by the Obama Administration and there will be no prosecution or even an unbiased investigation. NBC and Gregory will drink deeper of the Obama holy water to show their undying thanks and give even more favorable coverage of their favorite man.
This story titillates the right but won’t go further than that.

Right …. what does it matter if a magazine is empty or not? Ammunition isn’t illegal, just the magazines in that crazy place. And what is the point of holding a magazine up, anyway? It’s not as if people haven’t seen these things in just about every movie and TV show.
It doesn’t matter what some DC cop said to Gregory. I know that Barky thinks he can waive any law for any person but that is really not how it works. The law is pretty clear. Gregory needs to go to jail for a year, and so does everyone at NBC who touched or was involved in getting that magazine. One year each. At least.

You’ll never find out. It’s owned either by someone who works at NBC or a friend of a worker at NBC. I wouldn’t be surprised if there are two or three firearms at NBC right now that would break DC gun laws. Laws are for the peons, not the credentialed elite journalists.

Has anyone noticed the recent trend in the MSM to come out, days apart, with conflicting details of big news stories? It seems intentional, to buy time muddying the waters until the next big story comes around to report so the current one can be forgotten.
