Rigging the electoral college?
posted at 7:01 pm on December 8, 2012 by Jazz Shaw
This is a somewhat troubling question which I first noticed being addressed by Dr. James Joyner over at Outside the Beltway. He’s talking about a definitely hyperbolic entry from Mother Jones which accuses the GOP of trying to rig the electoral college through various acts of villainy in advance of the 2016 elections. The basic crux of the story is a renewed plan to try to move the Keystone State from the winner takes all model to a split decision such as is used by Maine and Nebraska. Mother Jones sees it as a plan to undermine democracy, but Joyner isn’t so sure.
Changing the rules in September would have been blatantly unfair, since the campaign had been waged under existing rules and the likely outcome was predictable. But, surely, changing the rules nearly four years out—well before the campaign has commenced—isn’t inherently a bad idea.
This proposal is, as I said, similar to the split used in Maine and Nebraska, but not identical. They award theirs based on who wins each congressional district, plus a two point bonus to the overall winner for the Senate based seats. This new plan for Pennsylvania would just break up the electoral votes based strictly on the state’s popular vote, with – again – a two vote bonus to the winner. So is this undemocratic, Dr. Joyner?
To the extent that Pennsylvania’s 20 electors are a lock for the Democrats, he current system is “rigged” (to use Baumann’s scare word) in their favor. After all, while a 5 point statewide margin is substantial, it’s nonetheless the case that 47% of Pennsylvanians are disenfranchised by the result. Obama should have gotten 10.3 electors to Romney’s 9.7; or, since that’s not possible, 11 to Romney’s 9. And even that would substantially overstate Obama’s margin of victory. Since Pileggi is proposing a 2 point “bonus” (actually, just an awarding of the 2 electors based on the Senate) to the winner, the 11-9 outcome would make sense.
I can see Joyner’s point, but this question looks very different depending on whether you’re examining it from the state level or the national level. Anyone who is a fan of states’ rights should recognize that the Constitution allows each state to allocate their electoral votes however they choose, but it also serves as a reminder of a larger issue. I’m talking about the difference between state elections for state offices and state elections for a national office. If New Hampshire decides to elect their governor by having citizens drop colored stones into clay pots, that’s their business and they have to live with the results. But state by state differences in how we elect the President and Vice President leave certain possibilities open which are troubling to say the least.
In the example given above, it’s noted that the GOP is trying to switch both Pennsylvania and Wisconsin to a split electoral college vote. It doesn’t take much imagination to guess why, given that both of them are states with a significant number of EC votes which the GOP has been losing consistently by small margins, while essentially gerrymandering the state level structure to give them control of the local government. (Don’t get upset by that last sentence. New York and other states do the same thing to favor the Democrats. It happens all over the country on both sides.) And it is also noted in the article that there mysteriously seems to be no effort by the GOP to push for such reforms in reliably red Texas.
The long and the short of it is that if the Republicans can force the Democrats to split the electoral votes in the states where Democrats win and keep the red states winner take all, it provides a decided advantage. But is that fair? Would you want to win under those circumstances? I suppose the immediate question is, could the Democrats manage the same feat? I’m not sure if we have any examples of states where Democrats lose the presidential election but control the state government. Joyner asks that question as well, but doesn’t provide any examples. Perhaps some our more experienced readers can suggest some.
All in all, it’s yet another thing which nudges me toward the idea of having some sort of national standards for elections which only apply to the Presidential race. It’s an ugly thought and sounds very much anti-states’ rights, but there are just so many variables in election laws that the system begins to look a bit suspect the more you tamper with it. So what do you think? Is this even a problem? And if so, what should be done about it?

Wow….I was wrong.
They only needed one pro-abortion juror. In Philadelphia. How tough could it be for the defense to find one?
That evidence must have been even more horrifying than I had imagined. The pro abort could have held out, no matter what, unless she couldn’t bear the reality presented by the prosecution. And she couldn’t possibly have been the only pro abort.
I just knew this guy would walk. Happy to be proven wrong. Well done, jurors.

Planned Parenhood made a statement clearly stating that any laws that prevent the murder of babies born alive during extreme late term abortions must be rejected. After all, women were told to go to this legal clinic for the express purpose of having extreme late term abortions. Let no one have any doubt that this organization is about one simple thing and one thing only – killing babies for profit and convenience.

Let me try and parse this idiocy here. Gosnell is “exceptional” (despite not being exceptional because he’s not an exception at all according to you) entirely on the basis that the evil monolithic mainstream media has never before covered abortion in this way. Except you also maintain that this same mainstream media has not been covering Gosnell. So the one thing you’ve cited that distinguishes the Gosnell case as exceptional (mainstream media attention) doesn’t actually apply at all; Gosnell would only be “exceptional” if the media, to borrow a line from some idiot, “did its job” and engaged in wall-to-wall coverage of his trial.

I have been an Atheist probably longer than you have been alive and I am pretty sure a video of a DNC gets you wet in all the wrong places. Abortion is the religion of the devolved, subhuman.
Cute that you think you are the adult, when in fact the entire concept of children terrify pvssies like yourself, much like guns.
Why? Because they are both the ultimate mantle of responsibility and consequences which your ilk finds abhorrent in all their puerile morality. This is why your stunted kind attempts to equate owning a pet to raising a child to try and minimize the true sacrifice it requires. A pet dies and you whine for a bit but go get a quick replacement. You let a kid die and everyone sees you for the immature, narcissistic, scumbug you really are.

It’s called the banality of evil. See, what he does is apparently “unexceptional” in his area of practice – it’s done all the time, to varying degrees of professionalism – some kill women accidentally, some kill new born children, etc. The routine.
Now, when it’s actually covered by the mainstream media, and the practices are actually demonstrated and reported on, then that coverage, that report, IS exceptional – because it is reporting something that gets no coverage normally
I’ve never seen these “stings’ or undercover video or any real detail on the abortion procedure on any main stream media source. Ever.

I have a hard time combining “high quality” with abortion. Aren’t these the same people who think that any modicum of standards equating an abortion clinic with a medical facility is interfering with a woman’s right to chose?
Cindy Munford on May 13, 2013 at 4:42 PM
Sorry for the delay. I had to find the stats, and I was interrupted!
I can’t tell you the reasoning of women who have late term abortions. Having had children myself, at the point at which a pregnant woman feels the baby move, usually I think in the fourth month, it’s beyond shocking that a woman would somehow rationalize herself into having the child killed. There’s something evil at work.
As for stats, I don’t think there is no requirement for states and areas to report abortions to the CDC. The most recent available data I had from the CDC without doing a search right now is on early abortions. CDC stats lag behind the current.
Women need to understand that their baby is being killed no matter what week of gestation the little one is in.

As far as the death penalty goes, I’m a Christian and that was a clear command of God. In his book Genesis In Space and Time, Francis Schaeffer wrote in reference to Gen. 9:5-6, that I quoted above,
Schaeffer goes to to emphasize that cp isn’t to be administered carelessly. Premeditated murder is carefully delineated from murder by mistake or accident. There were cities of refuge established in Israel to which people could flee until their case was heard.

The jury will return May 21 to hear evidence on whether Gosnell should get the death penalty.
The same jury will return to court next week to decide if Gosnell will face the death penalty on the three counts of first-degree murder on which he was convicted.
I thought that it sounded weird that another jury was going to be empaneled. It would be HIGHLY UNUSUAL for a different jury to decide the penalty than the one that determined guilt. Both sides would have to re-litigate much of the case.
Convicted of:
3 counts of 1st degree murder
3 counts of infanticide
3 counts of conspiracy in connection with the deaths of the babies
1 count of involuntary manslaughter
16 counts of performing illegal abortions after 24 weeks of pregnancy
211 counts of failing to comply with a state law that requires for a 24-hour waiting period before an abortion is performed (each count carries the possibility of up to one year in prison)

Allah, please remove the above. It is incorrect as to both the date and the ‘different jury.’

I say go “medieval on his @$$”.
An argument I have with my liberal sister-in-law is that the death penalty will not prevent others from murdering people.
I always tell her I am not worried about my neighbor killing me but the death penalty will sure as hell prevent a convicted murder, prone to violence, from killing me or anyone else.
I would think the verdict in this case will piss her off.
As an ex-oncology nurse she has stated she does not believe in the sanctity of human life at any stage. And of course she is a member of PETA and talks about the inhuman suffering of Animals inflected by people.
Can’t wait for the next family get together.

The DP isn’t just for deterrence purposes-which you pointed out.
In many cases it doesn’t deter murder.
As a side note..
A work associate I had..her family was anti-DP.
UNTIL..her little brother was kidnapped, raped and decapitated by a man who just had been released from prison ..for molestation.
Lets just say..they changed their minds real quick on the DP.
They attended his execution a few years back. They wanted to watch him die. For them, justice.
When it becomes personal..minds change.

Well, the Gosnell headline has been superseded on Yahoo! by such more-important headlines like Taylor Swift ‘rocking good girl/bad girl look’.
Priorities…
Pffft!

it’s what you said plus it’s the lack of personal responsibility. avoiding personal responsibility is HUGE for the left. that’s one of their biggest founding principles, honestly. it manifests itself in many issues, including abortion. acknowledging that an unborn baby is a life that should not be killed means acknowledging that pregnancy/sex has consequences. you can’t just do whatever you want in life and avoid consequences. you can’t just do whatever you want in life and demand that everything will happen in just the right way to convenience YOU, and anything (or anyone) that gets in your way must be taken away (or killed) it’s selfishness. it’s putting yourself above everyone else. the lack of personal responsibility is all about blaming everyone else but yourself. you can do no wrong. no one is allowed to tell you that you are wrong. everyone else is wrong except you.
plus it’s desensitization. once you’ve killed one person, then another, then what’s killing a few more? then it’s no problem to kill a bunch more. you get used to it!

How horrificly gut-wrenching beyond thinking.
The dp is about justice, whether or not anyone is deterred.

I just got back from the gym, and was watching FNC(despite the truther trash being on w/Shep) when the verdict was announced. I’ll admit-I cheered…out loud.
Though I strongly support capital punishment, I think Kermie should be sentenced to ‘life’…and put in the general prison population.

It’s time for one of the other Kos/HuffPo shut-ins to clock in for the evening shift.
Dr. Carlo Lombardi on May 13, 2013 at 5:17 PM
Wow! Just wow!
There is a gym in Lubbock that shows FNC instead of CNN or MSNBC…

Speaking of trolls.
Some of the ones here aren’t too awful. I’ve seen a lot worse.
Good trolls are actually pretty good for a board if they generate good discussion and get you all riled up over a topic. And of course they allow you to get all p-offed and vent by wishing horrible things on them.
They are a sign of good board health- think of them like mushrooms in your lawn.
And the rare good ones need to be fed and watered regularly- nurtured if you will.
I’d rate the HA troll population as a solid B-. They could do with a bit more sense of humor. But, all in all, not too bad.

They will hook some folks.

It was…
They had to live with it for years…awaiting justice.
Then when they put a stay on the DP for a couple years due to some bungle/suit ..they waited.
Crist finally lifted it.
It was beyond tragic..it changed them forever.
My associate/friend..has never been the same…nor are her parents or siblings.
Famous case here years back INC.
The sick thing…he had been just released and had a record as a predator. As they always do.
We have a big problem..
Anyway..it is about justice, it is about making sure they never ever free for any reason.
One day..I will enlighten you on a serial killer from TX that almost walked..due to a deal and the system screwing up.

Each cardio machine has individual controls(w/a headset jack) so that you can ‘watch’ whatever channel you want. Hell, even the Mickey D’s ’round here have FNC on. Smart azz.

amazing post, thanks so much!

I can understand never being the same (understatement). I don’t know how I missed that case. We were up in NJ and NH for 11+ years before returning to FL—maybe that’s how.
