After what I saw happen last week, I am a little sick of the real world for a bit.

I’m interested to see if anything comes of the several states with petitions to leave the union. I think Texas might be the only state that might be serious. That’s another way out of Obamacare. I read that they already have enough signatures.

According to section 1311 of the Affordable Care Act (ACA) the Secretary of the Treasury is authorized to issue refundable “premium assistance tax credits” through Exchanges “established by a state under Section 1311.”. By contrast, there is NO provision for the Federal government to make essential subsidy payments to Federally established exchanges. Thus, if a state declines to set up their own exchanges, the essential linchpin of Obamacare, the federal tax credits and subsidies for individuals to be able to purchase the insurance, collapses.

Section 1401 also, explicitly, limits those tax credits to purchases made in exchanges established under the act’s section 1311 — which requires that exchanges must be “a governmental agency or nonprofit entity that is established by a State.” So, repeatedly in the law’s text, Congress made the state-created exchanges — and not the federal exchanges — the only exchanges where individuals and businesses could get federal insurance subsidies and tax credits.

Most importantly though is these subsidy and tax credit entitlements are what trigger the financial penalties imposed on employers who decline to comply with the Obamacare law. But, if a state does not create the exchange and no available mechanism for the tax credits or subsidies exists, then there also is then no mechanism for penalties to be assessed on business owners who do not comply with the law, which can be as high as $3,000 per employee. Thus, the most damaging part of the law to business owners disappears and states that did not create the Exchanges will be competing for businesses to move from the states that did.

I would encourage everyone to contact Governor Deal with your opposition to the creation of Georgia State health care Exchange.

I heard a commenter today say if the state refuses to set up an exchange and the feds have to do it, employers will not have to contribute to it. Or something like that. When they wrote it they forgot to include it.

They gave the rule #, but can’t remember it. It would really hurt obamacare.

Very true. We’re in NV and if HusseinCare is to be implemented here we are ready to move to a state where it will not be. A number of states will not be implementing this idiocy, remains to be seen how communist states of America go it alone and make it a success. Not that I don’t know the results already after having hands on experience with that in USSR. This will not be pretty.

It was definitely an error made by the democratics in hastily assembling the odious Obamacare. Not a simple typo, but a strategic error. I am sure the democratics would dearly love to patch that hole, and will try to do so in 2013 through trickery and manipulation. That’s one of the things the House has to hold tough on.

My sister-in-law is a member of one of CAN’s major orchestras. Some years ago their conductor-maybe he was a guest conductor-slipped from his spot in front of the podium and hit his head. He was elderly. He was taken to the local ER and had to wait five hours before he was seen by a doctor. Five hours. At the hospital ER near me, a senior w/a head injury would be seen immediately.

The family doctors really do their best, but they are victims of the system, as well.

At the time when everybody in the US was laughing about Palin’s “death panels”, the Fraser Health authorities in British Columbia stopped health programs for seniors and the mentally ill. The most vulnerable members of society always suffer first.

Obama is truly historic. He became the first President to win reelection with fewer EVs, popular votes, states and percentages in American history. Sheesh, HAL, that pig, Andrew Jackson, even beat Henry Clay by a larger margin (56% to 43.6%). Obama/Romney was 51%-48%.

No mandate and, if you want to claim he has one, then the Republicans in the House can and should do the same.
