Open thread: The second Massachusetts Senate debate

7 p.m. ET airing live on C-SPAN and WHDH.com. You already know why this is important so I won’t belabor it, but here’s the poll trend just to drive the point home. The question tonight: On what ground will this battle be fought? Another round over Warren’s phony Native American status, no doubt replete this time with indignant how-dare-you reproaches from the challenger? Or will Brown cite Legal Insurrection’s work and attack Warren on her habit of apparently practicing law in Massachusetts without admission to the bar? Over at Breitbart, Michael Patrick Leahy is optimistic. It would certainly fit with Brown’s strategy of attacking Warren first and foremost on her character: In a state as blue as Massachusetts, the “liberal loon” lament has less purchase than it does nearly anywhere else.

…Brown wouldn’t have to look far for work, either with Romney or on TV…

…but it would be typical Mass.

..I like Brown. I hope he wins, ’cause I don’t see Mandel beating Brown in OH. I forsee a lot of Romney people still puling for Brown because the only positive Mandel has going is his service. Everything else screams “corruptible”.

Practicing law without a license is illegal. The rules are clear and strict, and she simply ignored them.

She should be up on inquiry before the disciplinary authority with jurisdiction.

Mendacity is one thing, but even if it was in service of fraud to improve her employment opportunities, it pales in comparison to the blatant lawlessness of practicing without a license. She is a law professor. How can she possibly excuse not being knowledgeable of the rules and her duty to comply?

Brown has to raise the issue.

I think Brown should stay away from the fact she practiced law without being a member of a bar. Since she is (family lore) full on, (not exactly) bona fide, (zero percent) 100 percent Native American I would imagine she can practice law anywhere she pleases!! Her people were here first. Brown doesn’t want to walk into her “Laws of the White Man” trap.

Brown gives full explanation about how Warren used heritage and made things up for the sake of personal advantage, and changed back to being white after she was done climbing the ladder. Brown is questioned as to whether she was hired because of it. Brown says the way to answer is to release her personnel records.

Warren says she’s not hiding anything and that she’s answered this already. Says Boston Globe has backed her up, former solicitor general has backer her up who had voted for Scott Brown. Turns to general issue of character: how you live your life, daughter of janitor, ended up a law professor working with POTUS, proud of her family and teaching, and hopes to have inspired people. Has worked to make legal system better over time. Wishes she had been faster in confronting the heritage issue, but can’t believe that her own mother had lied to her her entire life.

Brown is questioned as to whether it’s disqualifying. Brown says no. Disqualifies her as a scholar? Brown says no, but you shouldn’t mislead voters, and that she self-reported.

Current advantage: none. Brown’s not hitting as hard as last time, and Gregory’s giving Warren an assist.

Brown says not an exaggeration, he was making a point about economic issues, and that you need to talk with people from wealthiest leaders to poorest farmers. Brown says he’s made mistakes before, said his daughters were available (self-deprecating joke, not particularly good). Warren misled voters though for 5 weeks.

Gregory accuses Brown of not releasing his client list. Brown says he did 1 week ago. Warren says she hasn’t seen a list of Brown’s clients — she says that Brown has claimed to represent the people while representing banks.

Brown answers that only she is required to provide a list, which must be given to Harvard per her employment terms. She only released hers recently, and he’s a real estate attorney which is different. Warren isn’t representing the little guy. LTB Steel she represented against workers. Travelers’ Insurance again and asbestos case.

Gregory asks Brown if she was adopting the policy positions or just serving as an attorney. Brown says you have choice of whether or not to take the client. Brown does not say whether or not she agrees, but just that she chooses who to accept or not accept.

Warren says Brown’s throwing out random charges. I’m a teacher, a consumer advocate, author, and have taken a client from time to time. For me it was about protecting individuals, employees, homeowners so that they didn’t get run over by banks and that system continued to work for them. Worked for Senator Kennedy for 15 years, wrote books, and even went to SCOTUS. For Brown to say that I hurt asbestos victims, is not only not true, but exactly wrong direction. Worked for asbestos victims for years, including at SCOTUS for a half billion dollar award for them so that their asbestos related diseases can be compensated. The asbestos victims have stood up and said Brown is wrong and have crossed a line. Brown is attacking the families of people who have been hurt. It was not a mistake to take on these clients, because I was trying to protecting the asbestos victims. Brown’s charges are dishonest and misleading, I went to SCOTUS and I’d do it again.

And didn’t that award ultimately get thrown out, and the asbestos victims ended up with some measly compensation that was something like $5,500 each?

Way to stand up for the little guy, Lizzie. I bet your attorney fees in that case were a lot more than $5,500 — that was probably what you billed for lunch in that case.

Alright. We’re back. Warren is saying that she could work across the aisle (apparently Gregory had said Ted Kennedy was bipartisan – WTF?!) with Dick Lugar… who Brown points out won’t be there. I’m in the race because I’ll work with anyone, Democrats, Republicans, libertarian, vegetarian. (I missed about a solid 5 minutes due to a dead livestream)

Brown is asked about Mitch McConnell. Says he’d like to respond to Warren first and then he’ll respond. The crowd cheers for Brown!

Brown says that McConnell will need to earn his vote. He’s independent and he’s disgusted with both parties. Warren is a straight party-line leader. So few Democrats ever cross the aisle. Lugar, Collins, and Snowe all cross the aisle. Brown is cheered again!

That debate is happening less than a mile form my house. It is in an arena full of UMass Lowell Students. They are overwhelmingly liberal and in favor of Warren. Scott Brown could not be in a more hostile environment.
