Feds arrest Mohammed filmmaker on probation violation

No word yet on what the violation was, but I assume it must be far more serious than using an alias or a computer. Given the insanity of the past two weeks, replete with the White House nudging Google to pull the video off of YouTube and the State Department running ads on Pakistani TV to apologize for a movie they had nothing to do with, I can’t quite believe the DOJ would risk the perception that they’re punishing this guy for a thoughtcrime unless something serious was involved. There has to be a real crime underlying this. Right?

The California man behind a crudely produced anti-Islamic video that has inflamed parts of the Middle East was arrested Thursday for violating terms of his probation, authorities said.

[The filmmaker] has been on probation for a 2010 federal check fraud conviction that brought a 21-month prison sentence. Under terms of his probation, he was not to use computers or the Internet for five years without approval from his probation officer…

A U.S. District Court hearing was scheduled for [him] on Thursday afternoon. It was closed to media and the public.

Meanwhile, new from Fox News:

Two weeks after the killing of a U.S. ambassador in Libya — an attack the Obama administration blamed in part on an online video mocking the prophet Muhammad — a majority of likely voters thinks the first thing a president should do in such situations is stand up for free speech, and not criticize how Americans exercise their First Amendment rights.

A Fox News poll released Thursday finds 61 percent of voters think the president of the United States should “stand up for freedom of speech, even if it’s offensive,” while 22 percent say the president should “condemn offensive speech if it might provoke Islamic violence.”

Those 22 percent know something important that the 61 percent don’t, namely, that the future must not belong to those who slander the prophet of Islam. And if we occasionally have to haul a guy in on a probation violation to ensure that the future doesn’t belong to him, hey. Exit quotation from our new kinda sorta ally in Egypt: “Egypt respects freedom of expression … [but] not a freedom of expression that targets a specific religion or a specific culture.”

Update: In order to prove that it’s evenhanded about blasphemy, Egypt’s gone ahead and arrested a Muslim cleric for burning a copy of the Bible. Note to The One: If you want to show the Middle East that American free-speech principles are not, in fact, an anti-Muslim plot and apply even to people who insult the faith of most Americans, this is a fine opportunity. Speak up in this guy’s favor.

Update: According to TMZ, the guy’s probation report is sealed. Question for criminal defense attorneys: Is there any way to force it to be unsealed, or is that at the discretion of one or both of the parties? There’s a public interest at this point, I think, in knowing why they’re sending him back to prison. Did he commit a serious crime that we don’t know about, or are they using a technicality to punish him for blasphemy?

The tolerance level for probation violations varies a bit, but I can’t imagine a probation officer taking it upon himself or herself to make a judgment call on this guy. The probation officer works for the judge, not the DOJ. If there are clear violations of conditions related to Internet access and use, and use of aliases, those aren’t minor. So he gets cited, and the judge will decide.

Docs should be unsealed at the hearing, unless there are compelling interests against it.

The scariest part of all this? Obama consistently equates offensive SPEECH with violence, which has two effects: 1) It tends to chill free speech 2) It tends to trivialize violence.

He did this with the Tuscon mass killings, and now this stupid Mohammed video. It’s REALLY REALLY creepy that our president wants to trample on the First Amendment whenever a liberal pet cause is mocked or threatened — while downplaying actual violence. Free speech should not even be an ISSUE when someone resorts to violence!

By creating new classes of “thought crimes” Obama arrogates more power to the state while simultaneously encouraging the same kind of violence he pretends to oppose. A society without free speech must resort to violence to resolve differences.

Forgot to add: According to Spencer’s book, the earliest that people became aware of the existence of islam was likely the 700′s.

This was AFTER 2/3rds of the Roman Empire had been overrun by the barbarian hordes. It seems most likely that mohammed and islam were invented AFTER the main conquests to create a reason for the conquests, and the perfect system to enslave conquered peoples and erase completely their past.

To the point where the modern “Egyptian” only occupies the same PLACE the Pharoes who built the pyramids, they are not the societal successors at all. Today’s Italians, as sad as they are, still have SOME cultural connection to the Romans, as a contrast.

Yep, I said similar earlier in the thread.

He was probably accused of something the government couldn’t prove but didn’t have the ability to fight off. So to get a “win” and at the same time, avoid possibly losing if he DID manage to scrounge up a lawyer willing to go to trial that is why the government offered probation and sealed it.

There are a lot more cases like that than you would care to know about. I know someone who went through EXACTLY something like that.

Paging Eugene Volokh, or Floyd Abrams, and the 1st Amendment bar generally. This is a case in which lawyers can provide a valuable service to a persecuted individual (and by doing so, to this country.) There has to be a a team of quality lawyers out there who will take this case pro bono, to make sure we do not have a pretextual prosecution for jaywalking, when the man is actually being punished for constitutionally protected free expression.

The Peter Zenger trial, way back in 1735, established in what was to become the United States, that the truth was a defense against slander or libel…and hence was the basis for our own First Amendment.

If Nakoula’s arrest is predicated on even an inkling of libel or slander, we are all in for a huge surprise once Team Obama has “more flexibility” after the election (should the electorate be stupid enough or corrupt enough to re-elect him.)

If he has been arrested for a probation violation (using the internet without permission) there’d better be a huge drove of other felons on probation being rounded up and charged for their own various violations of probation….and even in this I am quite uncomfortable.

There is no rule of law in this nation anymore.

This should bring Obama down. If it doesn’t then we can’t keep doing the republican committee F&F game show any more. The Op-Ed is spot on except a clarification might be useful. Ghei’s Op-Ed could be misread as implying that without the rule change, BATFE lacks power to seize and administratively forfeit property. That is not the case. BATFE already enjoys broad power to seize and administratively forfeit. However, it currently has to to tie the seizure to some specific offense (within its authority)-even if there is no charge or conviction against a person. In practice, expanding BATFE authority to seize and administratively forfeit for controlled substance offenses is granting BATFE authority to use fill-in-the-blank catch-alls for seizures and forfeitures.

Courts often accept that unexplained property possession is drug related-even when there is no direct evidence of drugs. Bulk currency is the obvious example but it could be anything. In theory, that would (and should) be the same with controlled substance act violations. In practice, it is not.

In a final rule published last week, the Justice Department granted the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) authority to “seize and administratively forfeit property involved in controlled-substance abuses.” That means government can grab firearms and other property from someone who has never been convicted or even charged with any crime.

The muslim world ceased to innovate or advance after the fake religion took root. They did have the upper hand against the West until about 1,000 AD or so. By the 19th Century the entire islamic world had been conquered by the West. It got the technological trappings of the West during that time.

If this is something that happened once, it might be a coincidence.

The fact that it seems to happen EVERY SINGLE TIME to anyone who runs for office against Barack HUSSEIN Obama, I’d call that evidence.

They HAVE Romney’s tax returns. Not coincidentally, an Obama stooge is in charge of the IRS. Romney won’t release them, so a “hacker” got ahold of them.
