Feds arrest Mohammed filmmaker on probation violation

No word yet on what the violation was, but I assume it must be far more serious than using an alias or a computer. Given the insanity of the past two weeks, replete with the White House nudging Google to pull the video off of YouTube and the State Department running ads on Pakistani TV to apologize for a movie they had nothing to do with, I can’t quite believe the DOJ would risk the perception that they’re punishing this guy for a thoughtcrime unless something serious was involved. There has to be a real crime underlying this. Right?

The California man behind a crudely produced anti-Islamic video that has inflamed parts of the Middle East was arrested Thursday for violating terms of his probation, authorities said.

[The filmmaker] has been on probation for a 2010 federal check fraud conviction that brought a 21-month prison sentence. Under terms of his probation, he was not to use computers or the Internet for five years without approval from his probation officer…

A U.S. District Court hearing was scheduled for [him] on Thursday afternoon. It was closed to media and the public.

Meanwhile, new from Fox News:

Two weeks after the killing of a U.S. ambassador in Libya — an attack the Obama administration blamed in part on an online video mocking the prophet Muhammad — a majority of likely voters thinks the first thing a president should do in such situations is stand up for free speech, and not criticize how Americans exercise their First Amendment rights.

A Fox News poll released Thursday finds 61 percent of voters think the president of the United States should “stand up for freedom of speech, even if it’s offensive,” while 22 percent say the president should “condemn offensive speech if it might provoke Islamic violence.”

Those 22 percent know something important that the 61 percent don’t, namely, that the future must not belong to those who slander the prophet of Islam. And if we occasionally have to haul a guy in on a probation violation to ensure that the future doesn’t belong to him, hey. Exit quotation from our new kinda sorta ally in Egypt: “Egypt respects freedom of expression … [but] not a freedom of expression that targets a specific religion or a specific culture.”

Update: In order to prove that it’s evenhanded about blasphemy, Egypt’s gone ahead and arrested a Muslim cleric for burning a copy of the Bible. Note to The One: If you want to show the Middle East that American free-speech principles are not, in fact, an anti-Muslim plot and apply even to people who insult the faith of most Americans, this is a fine opportunity. Speak up in this guy’s favor.

Update: According to TMZ, the guy’s probation report is sealed. Question for criminal defense attorneys: Is there any way to force it to be unsealed, or is that at the discretion of one or both of the parties? There’s a public interest at this point, I think, in knowing why they’re sending him back to prison. Did he commit a serious crime that we don’t know about, or are they using a technicality to punish him for blasphemy?

If that is the case, I think that a different protection program would be a better alternative, but the DOJ has become known as the king of clusterfarks, so an “arrest” might not seem like bad optics to them.

It could be a regulation passed by EPA the town council 200 years ago.

Almost everyone could conceivably be convicted of a felony when we have a legal code that is so huge, so complex that lawyers can’t even understand it. How is it just to say that ignorance of the law is “no excuse” for common citizens when the law is impossible for them to know or understand?

Ever taken a piss into a stream or a river or even behind a tree (for one example)? You could be sent away for decades by the EPA for illegally dumping raw sewage in a “protected waterway” or “wildlife area”.

This is a reprehensible and despicable act of obfuscation more suited to a craven and incompetent than a President of the United States.

Obama is responsible for what happened in Benghazi. It is his responsibility as he’s the executive in charge of this administration and he’s appointed those beneath him to implement his policy decisions. He is the Commander-in-chief. He is ultimately responsible for those who serve under him.

For him to stand before the U.N. and even imply that a person who makes a shabby film is in any way responsible for the actions of homicidal maniacs and religious fanatics is an abrogation of his duty as president. It denies the First Amendment of the Constitution of the United States.

For Obama to seek to draw a moral equivalency between someone who makes a movie, writes a book, speaks, sings, paints or draws, something that another may find offensive and a heinous murderer who murders people and commits acts of mayhem at will is despicable. Worse, his failure to stand firmly and unequivocally for freedom of speech and expression is a betrayal of the core values of this nation, the unalienble rights of human beings, and the Constitution which he was duly sworn to defend.

Things can change, but I honestly don’t see how Romney gets a head of steam without a masterful debate performance, even then, I’m not sure it matters. Obama and his media lackeys have done a brilliant job of making Americans tune out.

People keep pointing to Reagan and Carter, Obama isn’t Carter and Romney certainly isn’t Reagan. Demagogues are hard to beat. They’re even harder when you have no avenue to show the public that they’re being fooled.

What percentage of the public knows the Democrats had a filibuster proof majorty? 35%? I’d be willing to bet that a healthy majority believes that the GOP controls the House and Senate. This is the biggest problem from 2010. By not winning the Senate we gave Obama something to demagogue without forcing him to veto things. It’s a perfect storm.

You would also be frightened to know how the majority of “successful” prosecutions are due to the fact that prosecutors abuse their office, deny people a trial while piling on extra charges, then offering something like a plea deal or diversion resulting in no imprisonment at the cost of probation.

Ergo: just because someone is on “probation” doesn’t necessarily mean they committed a crime or even did anything wrong, they lacked the resources to get a lawyer that would actually buck the prosecutor and win a case that the prosecutor never could have successfully prosecuted had it gone to trial and he or she actually had competent defense.

There are a lot more Mike Nifongs and Angela Coreys out there that DONT get noticed…

The scariest part of all this? Obama consistently equates offensive SPEECH with violence, which has two effects: 1) It tends to chill free speech 2) It tends to trivialize violence.

It’s REALLY REALLY creepy that our president wants to trample on the First Amendment whenever a liberal pet cause is mocked or threatened — while downplaying actual violence. Free speech should not even be an ISSUE when someone resorts to violence!

By creating new classes of “thought crimes” Obama arrogates more power to the state while simultaneously encouraging the same kind of violence he pretends to oppose. A society without free speech must resort to violence to resolve differences.

Update: According to TMZ, the guy’s probation report is sealed. Question for criminal defense attorneys: Is there any way to force it to be unsealed, or is that at the discretion of one or both of the parties? There’s a public interest at this point, I think, in knowing why they’re sending him back to prison. Did he commit a serious crime that we don’t know about, or are they using a technicality to punish him for blasphemy?

Sure, there is a way for anything involving this guy’s record to be unsealed: Run for office against Obama.

No word yet on what the violation was, but I assume it must be far more serious than using an alias or a computer.

We all knew they would trump up a violation. I mean seriously there is probably not a dozen people on probation in America that have not in some way technically broken that probation.

There is no way he would have been to a judge over this had he not made this movie and the Jihadist had not dictated to us we arrest him.

As a resident of California, and knowing how we do things here, I am inclined to believe that is the most likely explanation. And believe me, I don’t trust the cops or legal system here half as far as I can throw a Abrams tank.

I think I know who Obama’s real father is. Mohammad raped a goat and the goat literally died from shame. The goat was buried in the desert and around 1960 archeologists dug it up and retrieved the sperm from Mohammad and impregnated Obama’s mother with it.
