Source tells Glenn Beck: DOJ negotiating with Egyptian government for return of “blind sheikh”?

I’m going to inch out onto the limb and predict that the Foreign Policy President will not, repeat not, be handing over this cretin before election day.

The U.S. State Department is currently in negotiations with the Egyptian government for the transfer of custody of Omar Abdel-Rahman, also known as “the Blind Sheikh,” for humanitarian and health reasons, a source close to the the Obama administration told TheBlaze…

The negotiations are allegedly part of the ongoing discussions with the Egyptian government to resolve the crisis plaguing the Middle East, the source told TheBlaze. Calls to the State Department for comment referred us to the Department of Justice, and nothing has been confirmed.

The Blind Sheikh is serving a life sentence in American prison for his role in the 1993 World Trade Center bombing. His release has been called one of the top priorities of the new Islamist administration in Egypt. Many have pinpointed the cause of last week‘s unrest in Egypt to be protests over the Blind Sheikh’s release– not an anti-Islam YouTube video.

Read Tom Joscelyn’s post from last week on the blind sheikh as a cause celebre among Egyptian Islamists during the embassy assault. No less a jihadi than Ayman al-Zawahiri mentioned the sheikh by name in his video eulogy for Abu Yahya al-Libi released on September 10th, the day before the attack in Benghazi and the standoff in Cairo. It’s also true, as the Blaze claims, that the sheikh’s release is a goal for the new Islamist government. Morsi mentioned him more than once on the campaign trail; there are enough hardboiled Islamists in the Egyptian electorate that securing Rahman’s release would be a huge political coup for Morsi and the MB.

Just one question: What would Obama get out of it, assuming he followed through on this in a second term? His credibility on counterterrorism would be shattered instantly; all the GOP accusations of appeasement, which have failed to get traction against the guy who ordered Bin Laden taken out, would finally have a track to run on. After years of trying, the Dems have finally pulled even with the GOP on the question of which party is better on fighting terror; hard for me to believe O’s going to give that away in one fell swoop. Granted, a lame duck wouldn’t have to worry about his own reelection but he would have to worry about vulnerable Democrats in Congress, whom he’d need to achieve any of his second-term goals. And no, needless to say, “humanitarian and health reasons” won’t be enough to justify the release. That wouldn’t have flown even before Britain gave the Lockerbie bomber back to Libya, but after Megrahi lingered for years after doctors had given him six months to live, that all but ensured no western government will ever try that excuse again.

Besides, what could Morsi offer Obama that would make it worth his while to take a political hit this big? Reaffirming the peace treaty with Israel wouldn’t be enough. For one thing, the Muslim Brotherhood’s promise isn’t worth jack; for another thing, making a concession to an “ally”/adversary simply so that they’ll maintain the status quo is essentially the definition of appeasement. To do something like this, I think, O would need Morsi’s cooperation in brokering some sort of peace deal between Hamas and Israel. But Morsi won’t do that, of course, because then he’ll be demagogued into political ruin by Egyptian Salafists who hate Israel and won’t tolerate any accommodation with them. Which is to say, there’s basically nothing Morsi can do for Obama to warrant a concession this big, which makes me skeptical that any deal would ever be done. Or am I missing something?

Update: While we’re on the subject of Obama and our maybe “ally”/maybe not, any official White House response to this?

Washington has a broad range of interests in Egypt as it shifts from authoritarian to representative rule, ranging from security cooperation and regional peace to political pluralism and religious tolerance. The United States should be willing to extend economic and military aid to Egypt commensurate with the latter’s needs and its commitment to partner in advance of common objectives. But in working out the details of this new arrangement, our president should not give his personal imprimatur to leaders who espouse repulsive, abhorrent views that undermine a vital U.S. national security interest.

To that end, Obama should explicitly condition any meeting with Morsi on the latter’s clear and public renunciation of 9/11 revisionism. This position would present Morsi with a stark choice: He can either repudiate the hate-filled conspiracies that he has helped to sow and reap the benefits of Obama’s embrace, or he can expose himself as an irresponsible ideologue with whom few members of the international community will want to deal. Failure to lay down a marker with Morsi before he comes to New York means Morsi may never have to make that choice.

Yes, the leader of our “ally” is in fact a dirty, dirty Truther. If O’s dumb enough to hold a press availability with him when he visits in a few weeks, someone had better ask Morsi about it.

Listen, I’m no big fan of Beck, but he has a pretty good record. In 1999, he predicted that there would be bodies on the streets of Manhattan and falling buildings as the result of a massive terrorist attack. He predicted the housing and financial crashes. If not, he was being detained under the law. You don’t actually have to be arrested and read your Miranda rights for constitutional protections to attach.

If you are walking down the street, stopped by the police, put in the back of the patrol car, and denied the right to leave at any time (no matter how short a period of time), then you are in police custody even though you haven’t been handcuffed and read your rights.

It was an interview, he went voluntarily.

This is not some random ordinary citizens with police suddenly knocking on his door for no reason. He committed bank fraud two years ago. He was on parole and had to meet certain conditions including not going online without permission which he almost certainly violated.

If it was anybody else, Feds would get a warrant, break down his door and throw him in front of the court. But they didn’t. Instead they asked him to come in for an interview, then helped him disappear. Now nobody knows where he is which means he’s safer than before when he was sitting in his home, with the entire planet aware of his location.

If I were this guy, I’d ask the cops to do the exact same thing for me too.

Going with the police voluntarily means they called you and you took yourself downtown. The police showing up at your house at 1:30am asking you to come with them for a chat about your parole violation and oh, yeah, some stupid video you made is not voluntary. Aren’t you glad you’re not his neighbor. The empty chair will try to justify releasing the blind terrorist before his term is done this year or in 2015. He can always grant a presidential pardon when he has more flexibility.

Actually, if you walk into a police station (even as a result of arranging an appointment) and are placed in an interview room with a closed door or with a law enforcement officer sitting between you and the door, then that can legally be considered detainment.

It’s illegal to resist detainment, therefore the definition of detainment needs to remain broad to prevent law enforcement from deliberately tricking someone into thinking that they are being detained.

I agree. That was my point and is what the caselaw holds.

The Blind Sheikh is the Spiritual Leader of Al-Gama’a al-Islamiyya (GAI), which has ties to al Qaeda, which has cooperated with GAI for training and operations. GAI is a spin-off group of the Muslim Brotherhood and as a faction sought the violent overthrow of the Egyptian government and claimed credit for the 1995 attempted assassination of Hosni Mubarak in Ethiopia.

Sheikh Rahman was able to negotiate between factions of the GAI while in prison via his US lawyer Lynne Stewart who helpfully passed documents to GAI to help get a truce between splinter groups within GAI. He finally decided that it wasn’t worth the effort and called it off in 2000.

Structurally GAI is a dispersed cell operation that had dispersed in the mid 1990′s into Pakistan, Afghanistan, Sudan and a few other places, and co-operated with al Qaeda and other terrorist organizations. In theory GAI renounced violent means in 2002, but your guess is as good as mine in the reality of that.

In 1998 GAI signed on to OBL’s fatwa against the US and utilized a front group, The Al-Haramain Islamic Foundation (AHF), to fund expansion of GAI into Bosnia. When found out they changed the name to Vazir which is a ‘cultural organization’ with the same members and backers. So if you want the Clinton end of it, GAI had not only gone after the WTC, but was actively going against the US in Bosnia, as well prior to the fatwa.

It is unknown what links GAI has or had to the growing heroin trade through the former Yugoslavia fosterd by al Qaeda, Red Mafia organizations and other groups, but due to the amount of drugs and money flowing through it is difficult to say that GAI had no interest or activity there as they were interested in active in the other realms of activity going on.

As the Spiritual Leader of GAI, the Blind Sheikh would have had a major say in inter-factional activities as well as overall direction for the organization, especially when he has a document mule in the form of Lynne Stewart to get information back to GAI. As Andrew McCarthy has pointed out that mafioso and terrorists can easily carry on leadership duties while in Club Fed and that even gives them a certain amount of insulation to their group’s activities. The extreme interest of the MB to get Rahman out points to the Blind Sheikh’s continuing influence from jail and that his interests have always been in opposition to the US across multiple Administrations.

I do expect that the appeasement-oriented Obama Administration will let the Blind Sheikh go. I doubt it will be before the election, but right around Christmas (as Clinton did for Hillary’s brother and for Marc Rich at the behest of Holder) would be par for the course. Mind you, I think the guy should be in Gitmo, and Gitmo run to the GC, which would classify these non-legal combatants in war against the US as Spies and Saboteurs. Or as Pirates or highway robbers as Lincoln had the military do, back in the day, to get rid of these more cheerful misdirections of ‘terrorist’ and ‘armed activist’. No matter the classification, the result is the same and clear-cut. The Left can’t stand for civilization and, thusly, will appease barbarians who fight to no civilized norm. I expect the Blind Sheikh will walk. I would prefer that he walk to Egypt, not go on a jet or boat if he really wants to get there. Drop him off at the edge of territorial waters in the dead of night… free to go home as fast as he can get there.

Assuming Obama is reelected, I think we need to predict the consequences of all initiatives from a new paradigm. Our economic system will quickly collapse so the Democrat Party’s foreign policy credibility will be of little immediate concern.
