FBI: No racial bias in Trayvon Martin shooting

Discovery documents released yesterday shows that the special prosecutor in the Trayvon Martin shooting case has a difficult task in front of her.  The presumed motive for the shooting, which defendant George Zimmerman claims was necessary to save his life, was racism.  The FBI investigation ruled out that motive, NBC’s Miami affiliate reports — but that doesn’t mean Zimmerman is out of the woods yet:

The FBI found no racial bias behind George Zimmerman’s shooting of Miami Gardens teen Trayvon Martin, according to dozens of documents related to the case released Thursday.

The second round of discovery documents released by prosecutors include reports from the FBI, Florida Department of Law Enforcement and State Attorney’s Office as well as photos of the crime scene, aerial photos, police calls and surveillance video related to the shooting.

Zimmerman, 28, is charged with second-degree murder for the killing of Martin, 17, in a Sanford gated community in February. He claims he shot Martin in self-defense.

The documents from the State Attorney’s Office include memorandums of interviews between investigators and witnesses, family members and officers who responded to the scene and worked on the case.

This may doom a second-degree murder case, in which there has to be some malice present prior to the killing.  It doesn’t negate the possibility of a manslaughter charge, though, which doesn’t necessarily require a showing of malice.  If the government has evidence that the use of lethal force was not a reasonable choice, Zimmerman could still be found guilty of manslaughter, as lethal force in self-defense can only be used when a reasonable person would conclude that it was the only way to save himself from death or grave bodily harm.

However, changing the charge from second-degree murder to manslaughter might be tough under the circumstances for the special prosecutor in this case.  Technically, the FBI was working on a civil-rights case for the DoJ and not for the state’s special prosecutor, but the defense will certainly produce the FBI’s conclusion that racial bias played no part in the shooting during a second-degree murder trial.  Having led with the second-degree charge,  the special prosecutor’s credibility will be seriously undermined by the FBI report, and an attempt to shift the charge downward will undermine it even further.  Unless the state has overwhelming evidence that the FBI missed, their case is in serious trouble.

It is quite reasonable to believe that Trayvon Martin, having been found with Arizona Iced Tea watermelon cocktail and skittles in his posession, was assembling the ingredients for a batch of “lean.” If he was high on lean, or scared of getting caught using the stuff (which is illegal), he most certainly could have been hostile enough that Zimmerman reasonably feared for his life.

And ladies and gentlemen, might I remind each and every one of you, Zimmerman doesn’t have to prove his innocence. The state has to prove its case. I think Zimmerman walks, which is its own particular sort of tragedy. The guy will live the rest of his life in fear, which to my mind means he will NOT be a free man.

The charges against Zimmerman need to be dropped. The man was guilty of nothing but self-defense. Martin, on the other hand, was a criminal with the potential for a life sentence in prison.

That way we can have the Sharpton-Jackson race riots during the summer and get them over with now.

Never fear, the persecutor will get the jury to convict on some “lesser included charge” or other just to be able to say she got a conviction. I know: in “stalking” Martin, Zimmerman crossed a street away from a corner, so they can nail him for First Degree Jaywalking.

The accused are supposed to be tried by juries of their peers, but I have a feeling it will end up being a jury of the “victim’s” peers this time around. I sure hope Zimmerman has a good lawyer, because I see a lot of legal intimidation going on, even of his wife.

Legally the case is in trouble, but this does nothing to protect Zimmerman from unethical moves from the prosecutor to pressure Zimmerman to come to a plea agreement to just “make it all stop.” The revocation of his bail was particularly malicious. I think we are going to see a continuing string of unethical and possibly illegal actions by this prosecutor as the case drags on.

If Zimmerman is able to force the prosecutor to drop the charges or is found innocent, though, he’s going to have a solid base to sue for malicious prosecution.

They have to find him guilty of something. If he is acquitted, there will be race riots. Remember when they acquitted those cops in the Simi Valley trial? The state has learned from that mistake. But when she came out to that initial press conference, giggling and smiling and referring to Martin’s “sweet sweet parents” and talking about how she and the other DAs initially prayed with them — vomit. It was a dark and stormy night…. Literally, this is how this whole case began. If Martin had gotten his snackie-poo and walked directly home, there would not have been a problem. Instead, Martin took a leisurely route home in weather that was NOT good for a leisurely stroll. Given this with Martin’s previous bust with burglary tools and stolen property, it is not unreasonable to think that he night have been “casing” the townhomes when Zimmerman spotted him.

In fact, if Martin had any connection to the burglaries that were occurring in the townhomes, Martin might have been afraid Zimmerman would be able to identify him in a lineup, and on all the cop shows, head trauma causes witnesses to be unable to identify their assailants. That’s motive for the assaults.

This is and has always been a POLITICAL arrest sanctioned by Governor Rick Scott of Florida who gave the green light to the slightly nutty and power hungry prosecutor Corey.

To go through the number of violations of Florida law Corey committed would take all day. As a retired detective who has lived and worked in Florida all my life, I can only say that you are witnesses the first political arrest I’ve seen here. Scott blinked at threat of race baiters who claimed blacks would riot. He chose to have Corey violate the Rule of Law, the rights of Zimmerman and the process to force an arrest to keep the blacks at bay.

There is no other explanation. I’ve read the PC statement, my ex-partner read the PC statement and both of us said, “What did he do wrong?” It was a horrible compilation of media reports, none of which was supported by the evidence in the possession of Corey at the time of the arrest. She disbanded a grand jury, another violation of procedure, because she knew they would not indict Zimmerman based on the facts.

Her desire to keep him in jail is a direct result of the wishes of the family of Martin, who still won’t admit they raised a little thug who just happened to try and beat down the wrong guy.

This is a case of entitlements. Everybody but Zimmerman felt entitled to act a certain way. Martin felt entitled to beat another man down for an perceived insult. The MSM felt entitled to falsify the facts for ratings. The family felt entitled to complain regardless of the fact their kid was a thug. The race baiters felt entitled to foment unrest for profit. Scott felt entitled appoint Corey to make an arrest and she felt entitled to break the law to do so.

The only guy who didn’t act like a entitled fool was Zimmerman, who was just trying to do the right thing and survive.

One thing that is missing in this whole discussion is that it does not matter if Zimmerman had racial bias, he was defending himself from unprovoked attack. In fact, he had plenty of reason to have a bias against blacks walking at night. As the (black) writer of the Johnathan Capehart of the Washington Post said on the color of crime in The Big Apple:

In short, 95.1 percent of all murder victims and 95.9 percent of all shooting victims in New York City are black or Hispanic. And 90.2 percent of those arrested for murder and 96.7 percent of those arrested for shooting someone are black and Hispanic. I don’t even know where to begin to describe the horror I still feel looking at those numbers. But the word “hunted” comes to mind.

Let’s suppose he had said, “I see this black guy walking down the street and we have had a number of break-is’s by blacks.” Would that have lessened any the entire range of physical evidence in his favor? Let’s suppose he was a White Supremacist, would that lessened his defensive argument? No. The facts show that he was smashed to the ground with a sucker punch and St. Trayvon was on top of him slamming his head into the concrete. He could have been wearing a KKK outfit and his legal rights are the same, or would be if we lived in a Country where the Attorney General was not a black Supremest:

He said only historically oppressed minorities were to benefit. He could not avail himself of the triple penalties and rapid government/justice system response given a protected minority.”

But when this all broke she was praised on all the Leftist blogs. Democrat Underground even put quotation marks around the word “Republican” when they described her, and many of the DUmmies there gave her effusive hosannas.

Much less than a week, probably the last 24 hours. THC itself stays in the body and detectable a short time, no more than 8 hours. The breakdown products of THC stay considerably longer. No word on what exactly he was tested for.

Oh, I dunno. I looked it up months ago: She’s a republican. However, that doesn’t mean she didn’t vote for Obama.

She’s been getting a lot of adverse publicity form the black community. Scott hoped to avoid riots (he was wrong) an appointed DA Flopsweat who hoped this would improve her cred with the blacks.

It was a dark and stormy night…. Literally, this is how this whole case began. If Martin had gotten his snackie-poo and walked directly home, there would not have been a problem. Instead, Martin took a leisurely route home in weather that was NOT good for a leisurely stroll. Given this with Martin’s previous bust with burglary tools and stolen property, it is not unreasonable to think that he night have been “casing” the townhomes when Zimmerman spotted him.

In fact, if Martin had any connection to the burglaries that were occurring in the townhomes, Martin might have been afraid Zimmerman would be able to identify him in a lineup, and on all the cop shows, head trauma causes witnesses to be unable to identify their assailants. That’s motive for the assaults.

It’s ironic that the MSM was using the fact that Martin had AZ Iced Tea and Skittles on him to try and paint him as a darling innocent, when in fact Martin had just returned from the 7-11 where he bought those items, apparently for the purpose of making the drug concoction “lean” which he talked about in his Twitter posts, and also where he had tried to buy a “blunt” (and based on the store video, may have obtained one by using another teen to make the purchase for him) so he could smoke marijuana.

Looks like Barry Obama was right all along: if he had a son, he would look (and act) like Trayvon.

The person who needs to be brought up on charges is Angela Corey. She is an utter disgrace.

She is committing willful prosecutorial malfeasance. She knows she does not have a case, her only chance of winning is getting a 100% black jury and getting them to lynch Zimmerman.

She should have to serve the exact same sentence George Zimmerman would have received if he were found guilty.

Yeah, I’ve complained about it too. Hot Air has been pretty gutless in covering this case. The only way to STOP the misuse of the criminal justice system for POLITICAL purposes is to constantly shine a spotlight on it. So far only Alan Dershowtiz of all people, a huge LEFTY has had the guts to speak truth to power on this travesty, to the point that Angela Corey tried to threaten HIM with action.

This prosecution is about nothing more than throwing George Zimmerman to a black lynch mob for the crime of DEFENDING HIMSELF against a criminal who was trying to kill him.

Which means according to lib rules – Zimmerman is black. Same as how Obumble is black – even though he’s actually half white. Therefore how could race be an issue?
