This is why I can’t see an outcome — overturn or uphold or anything in between — that works well for this administration.

Uphold and Obama’s got to face Obamacare’s unpopularity in the electorate riding into November. If smart, Mitt Romney will capitalize on it…being extremely careful to say, “Yeah, the Court said it was Constitutional, but you folks don’t like it and I’M the one to change that.”

Overturn parts of it, or the whole thing entirely, and we’ll see the Obama administration in full-on Andy Jackson mode. “Justice Roberts has made his decision, now let him enforce it.”

They already did it with the Arizona ruling. They already did it with the campaign finance law.

They’ll do it again. If it walks like a duck and quacks like a duck…it ain’t a platypus.

Personally, I agree with Nosferatu although both fellows are blood suckers: just a different kind.

If the whole bill gets overturned, then the executive authority to issue those kinds of mandates evaporates with it. That also impacts the HHS contraception mandate, in which the Supreme Court might do Obama a favor with a complete reversal, which would end the fight with Catholic bishops over religious liberty.

Even if the whole ACA bill is overturned the contraception mandate stays. It is based on federal court rulings rather than legislation and those rulings have been upheld in subsequent rulings. It is outside of SCOTUS scope for tomorrow’s decision.

I’m disappointed. :p

Speaking of Mark, he’s unusually angry today. I bet he’s been tipped off on tomorrow’s ruling, and it ain’t good.

With that in mind, will a President aiming for re-election in just four months use the oft-abused and unpopular EO process to reimpose parts of an already-unpopular bill that had just been shot down by the Supreme Court as an overreach on federal power? Perhaps, but they would be risking a huge amount of backlash — and for what? To force an unpopular bill down the throats of American voters, this time without the political cover of Congress? I’m not sure that even this administration is that tone-deaf.

Executive Order does NOT trump Supreme Court Ruling! He can’t revive a bill struck down by the Supreme Court as being UN-Constitutional through Executive Order!

Yes, the EO does trump all USSC rulings. Yes he can revive any struck-down law he wants by issuing EO’s. Just ask Obama, the constitutional law professor.
