Will Obama revive an overturned ObamaCare through EOs?

Let’s take a moment off from baseless speculation over tomorrow’s decision on ObamaCare for less-baseless speculation as to what comes afterward.  What exactly are Barack Obama’s contingency plans if the Supreme Court overturns ObamaCare, in whole or in part?  On Monday, Marc Ambinder tweeted out this interesting update before it became apparent that the court would wait for Thursday to release its decision.  According to Ambinder, the White House had a raft of executive orders at the ready:

Over at The Corner, Avik Roy casts a skeptical eye:

It’s not clear to me exactly how much of Obamacare can be reinstated via executive order. It’s certainly conceivable that the president could issue costly mandates that affect private insurers. But the president couldn’t expand Medicaid on his own, or ration Medicare without congressional approval.

In fact, it depends on just how much of ObamaCare gets overturned, if anything at all does.  If the whole bill gets overturned, then the executive authority to issue those kinds of mandates evaporates with it.  That also impacts the HHS contraception mandate, in which the Supreme Court might do Obama a favor with a complete reversal, which would end the fight with Catholic bishops over religious liberty.  The EOs would become moot, since insurance companies cannot issue policies across state lines at all.

A partial overturning of just the mandate and/or other subsidiary parts of the ACA might leave enough jurisdiction for the White House to issue EOs that shore up the remnants.  However, while that legal opening might arguably exist, it would probably be political suicide to take advantage of it.  ObamaCare remains very unpopular with the public, a status confirmed once again in the latest WaPo/ABC poll:

Fifty-six percent of Americans rate the nation’s current health care system unfavorably in a new Washington Post-ABC News poll, while 52 percent regard the “federal law making changes in the health care system” in a negative light.

The numbers are even more stark when they are broken down into those who feel strongly favorably versus strongly unfavorably about each system. In each case, the number of people who feel strongly opposed is more than twice those who feel strongly in support — a testament to the fact that all of the energy on health care is on the side opposing both the old/new system.

And perhaps most interestingly, Americans who are not happy with their current health care also give Obama’s health care law negative ratings, by a 2-to-1 margin.

With that in mind, will a President aiming for re-election in just four months use the oft-abused and unpopular EO process to reimpose parts of an already-unpopular bill that had just been shot down by the Supreme Court as an overreach on federal power?  Perhaps, but they would be risking a huge amount of backlash — and for what?  To force an unpopular bill down the throats of American voters, this time without the political cover of Congress?  I’m not sure that even this administration is that tone-deaf.

I’m not sure that even this administration is that tone-deaf.

They really haven’t shown yet they have a clue, only that through control of the media and an awful lot of stupid people they have had a lot of leeway.

They are emboldened, led by a man who has had everything given to him and hasn’t had to actually earn anything. He isn’t used to the word “no” and he will act appropriately – like a petulant child.

If you view O’s actions through the unmistakably clear lens that his every intention is to destroy the U.S. anything is possible. He is impervious, unconstrained, and lacks even a scintilla of respect for the rule of law, our Constitution, separation of powers, and any/all other pesky little confines the rest of us operate under.

He’ll sign EO’s by auto pen en route to five fundraisers in the Hamptons. He’ll double down on maligning the evil Supremes in a press conference in which no questions will be taken, while shooting the bird at all of us on national tv.

He’ll round out his week with a couple rounds of golf on a mini vacay this weekend.

Obama has already used EOs and regulations to function as a dictator, circumventing and directly breaking statutes in order to implement the agenda even a Democratic Congress wouldn’t pass. When the President says he will not enforce laws on the books despite having taken an oath that “the laws be faithfully executed,” there is no difference at all between him and Kim Joon Il.

You can have the rule of law, or the rule by fiat and decree. You cannot have both.

We decide in November. Be there.

Seeing the after effects of Arizona and the recent abuse of Executive Orders by Mr. Obama, I would expect the most despicable abuse is yet to come.

Mr. Obama has already written off the hard core voters opposed to Obamacare. He will simply try to craft an implementation that ignores any potential effects of the SCOTUS ruling and sounds relatively sonorous to voters that are on the fence.

This election will be a fight to the end and he will try to divide us against each other to win it.

As much as I hate to say it, SCOTUS is only going to strike down the mandate. Obama will go into overdrive in implementing the rest of provisions even though Dem leaders have already admitted that ACA doesn’t work without the mandate.

He will do what he wants and dare the Supremes to enforce their decision. It is deference to the rule of Law that allows the Supremes to make rulings that people voluntarily submit too. Absence that deference all bets are off.

After FOUR YEARS of Congressional Republicans campaigning for affordable healthcare, where is the amalgamated Republican Bill designed to cut costs of policies available for ALL American citizens regardless of region or size of business or self employment? In fact, what Texas Republicans have found is that TORT Reform did NOT lower the cost of health care in Texas. So much for that anchoring premise to “cure” inflated policy pricing across the board. Were there no insurance running the medical industry, prices would be affordable for health care. I heard Michele Bachmann telling Laura Ingraham this morning that the lowest income Americans can afford $50./month per person for her health care plan. Not adult students; and certainly not unemployed adults laid off.

Republicans like Boehner, McConnell, Hatch, McCain and Graham will most certainly NEVER vote Obama’s impeachment. That would make them feel uncomfortable, heaven forbid they uphold their oath to the US Constitution.

It isn’t simply that Congress forfeits the Constitution, regardless of D/R party affiliation, “sharing common values” with Pelosi in politics to fleece the flock.

The Republican Leadership want destabilized excessive abuse of Executive Powers for themselves, illustrated too painfully via Bush/Paulson piracy of the global economy for the global banking industry insiders “free money” twice over from US tax payers robbed by their own Presidents and Secretary of the Treasury granted autonomy via Bush’s executive order leaving office. Then there’s the ever popular /NOT/ Patriot Act with DHS that GOP primary potus contenders promised to make “stronger” bigger and better, obliterating the US Constitution and Bill of Rights. In fact, Romney refused to take a constitutional stand on anything, deferring to his Ivy League global corporate vested interest lawyers to decide what if anything the Constitution “means” to anyone, given that our bipartisan government policy has already relegated integrity to the dust bin, irrelevant at best. Romney’s silence regarding Fast and Furious AND the Obama/Holder Federal cover-up is legally interpreted as assent. Those braying that Romney is too “smart” to say what he thinks practice the art of deception with themselves and with others.

Of course, the Republican Leadership are MORE than welcome to prove me wrong. But don’t speak for them and fool yourself further, that the Republican Party LEADERSHIP are effecting Constitutional Governance today, removing corruption from their own authoritarian policies and habitual practice. Listen to yourselves venting, “DON’T hold Romney’s feet to the fire. Not now. Maybe later” — when it will have no effect from the Oval Office once elected and further insulated from mere mortals. How well did it work with either Bush, especially GWB “holding his feet to the fire” on his own campaign platform planks once elected? He ran for smaller government and fiscal responsibility. Getting Bush’s endorsement means more of that kinder, gentler, deceitful authoritarianism.

5-4 mandate and a few other noxious provisions are tossed, but the whole law is not invalidated.

Obama did not use an EO to revive some part of the Arizona law suit struck down by the S.C. Obama acknowledged the S.C. decision and did the only (PETTY) thing he could do, which was to revoke all agreements to help Az enforce border protection by directing ZERO help to Az unless the case in question meets certain ludicrous conditions. One of those conditions is that Homeland Security will only take action to help Az against Illegals who have committed FELONY Crimes. this stems from Obama’s (ILLEGAL/Oath-breaking) order to the DOJ/AG NOT to detain, arrest, charge, convict, incarcerate, &/or deport any Illegal for any crime less than a felony. Such an order grants Illegals with ‘RIGHTS’ that law-abiding, legal citizens of the U.S. don’t even have!

Did the Rep’s allow BHO to abrogate Congressionally ratified treaties with Poland & Czechland (re; missle defense) wiih nary a peep?

Did the Rep’s allow BHO to abrogate established Bankruptcy Law stealing from preferred share-holders to re-distribute to his crony union allies?

Yup!

Did they stand idly by while BHO usurped legislative prerogative from congress and re-write immigration law so as to import favorable illegal voters from Mexico? Also, is his DOJ actively doing all in it’s power to sabotage voter ID laws so said favorable illegal voters can possible tip the election?

Yup!

Did they not stand meekly by as he too the country to war/kinetic military action without congressional approval?

Yup!

I could go on but, do I really need to? Given the above track record of being utterly devoid of being held to account for actions that certainly meet the definition of “High Crimes and Misdemeanors”, why in hell wouldn’t he now proceed to implement the ACA by EO?

Would the Rep’s suddenly and and mysteriously evolve into vertebrates and start impeachment proceedings?

Nope!

Just wait another 4mo’s and watch what how he’s going to subvert Election Law. The resultant 4 more years will allow him to complete his “transformation of our country”. The utter destruction of our Republic.

And absolutely none of our elected representatives will do a damn thing about it.

Let’s work on the assumption that the SC does indeed strike down the entire law. Does this save Obama’s robust posterior in any manner? No. All Romney and the PAC’s have to do is remind people just how close we came to the government completely trampling on people’s and institutions’ rights with the bc mandate. They could also point out how close we came to a massive financial disaster and would they want to put the architect of that potential disaster back in office for possibly another go at it? The belief that Obama benefits from a complete overturn assumes that the media control the entire message. They don’t, otherwise political ads, especially by the dems, would be unnecessary and the opposing voices would have a hell of a time getting anything on the air. Just because the SC overturns that abomination doesn’t mean Obama gets a free ride, provided that Romney and the PAC’s are willing to continue hitting Obama upside his head with ads about what almost came to be. My advice to Romney and the PAC’s should the SC overturn this: lock and load, fire at will.

There is nothing this lawless administration could do that would surprise me. Rather than take responsibility for passing a bad law, this administration will be blaming everyone BUT themselves. Then, of course, comes November and that’s what elections are for. The American people will be the final arbiter of this legislation and then Obama can blame them for its failure.

That also impacts the HHS contraception mandate, in which the Supreme Court might do Obama a favor with a complete reversal, which would end the fight with Catholic bishops over religious liberty.

Even if the whole ACA bill is overturned the contraception mandate stays. It is based on federal court rulings rather than legislation and those rulings have been upheld in subsequent rulings. It is outside of SCOTUS scope for tomorrow’s decision.

Personally, I agree with Nosferatu although both fellows are blood suckers: just a different kind.

I’m not sure that even this administration is that tone-deaf.

This is why I can’t see an outcome — overturn or uphold or anything in between — that works well for this administration.

Uphold and Obama’s got to face Obamacare’s unpopularity in the electorate riding into November. If smart, Mitt Romney will capitalize on it…being extremely careful to say, “Yeah, the Court said it was Constitutional, but you folks don’t like it and I’M the one to change that.”

Overturn parts of it, or the whole thing entirely, and we’ll see the Obama administration in full-on Andy Jackson mode. “Justice Roberts has made his decision, now let him enforce it.”

They already did it with the Arizona ruling. They already did it with the campaign finance law.

They’ll do it again. If it walks like a duck and quacks like a duck…it ain’t a platypus.
