Romney: If ObamaCare is struck down, Obama’s first term was a waste

An effective talking point, but I wish he’d waited a bit. It’s silly to roll this out before we know what the actual decision is; why not sit tight instead of offering the other side a soundbite with which they might be able to do something? The quote:

“As you know, the Supreme Court is gonna be dealing with whether or not Obamacare’s constitutional,” said Romney, previewing the court’s decision that is expected to be announced on Thursday.

“If it’s not, if Obamacare is not deemed constitutional, then the first three and a half years of this president’s term will have been wasted on something that has not helped the American people,” said Romney, offering his most scathing review to date of Obama’s tenure should the plan be struck down.

“If it’s not,” Romney went on, “If it is deemed to stand, then I’ll tell you one thing. Then we’ll have to have a president, and I’m that one, that’s gonna get rid of Obamacare.”

If the law is torpedoed, O will have spent valuable time on an unconstitutional project when he could have used it to work on, oh, say, the economy. I like that spin; as BuzzFeed notes, you’re bound to hear lots more of it from Mitt in the weeks ahead if Roberts and Kennedy come through on Thursday. He’s taking Obama’s two biggest liabilities, the anemic economy and the chronic unpopularity of his big legislative “achievement,” and using the Court’s ruling on the latter as an indictment about the former. Well done. My only quibble is that, the first time I watched this, it sounded like he was suggesting that if O-Care is upheld then O did help the American people. Of course he doesn’t mean to; he’s telling you flat out that he’ll repeal the statute if the Court doesn’t do it for him, but in that case, Obama wasted his term no matter what, right? Either we end up with the status quo ante if the law is struck down or we end up with a gigantic boondoggle and a still-stagnant economy if the law is upheld. Curious to see if the DNC will pull that bit about “waste” from this clip if the statute survives on Thursday and stick it in an ad crowing about the Court’s ruling and the “benefits” of the new health-care law.

Anyway. Anyone read or heard about any SCOTUS tea leaves today? We haven’t done nearly enough obsessive over-analysis of Court minutiae as possible “tells” on the biggest decision in decades.

Anyway. Anyone read or heard about any SCOTUS tea leaves today? We haven’t done nearly enough obsessive over-analysis of Court minutiae as possible “tells” on the biggest decision in decades.

Two positive tea leaves for me:

1. InTrade basically unchanged (in the 75-80% range probability to overturn mandate, close to record high).

2. Re-read transcripts from oral arguments. Kennedy was more opposed to mandate than I first remembered.

3. Rush seemed very confident today and yesterday (he is a close personal friend of Justice Thomas). Reversely, Obama seems to be resigned to the idea that the mandate will be overturned (Kagan probably leaked it).

Less insanely leftist leaders would have pushed us more slowly toward global socialism, such that the people didn’t notice so much. But instead Obama was such a sharp shock that maybe for a generation we have tilted the electorate 5 to 10 percentage points toward conservatives.
Still, with the seemingly inexorable march of unfriendly demographics, conservatives, and thus America as we know it, probably will bite the dust in the long run, unless… ?

John Kass in the Chicago Tribune makes an interesting observation. He thinks that either way this thing goes, Obama could end up the winner. If SCOTUS approves Obamacare, Obama can use it as the chief vehicle in his bid for re-election. If SCOTUS rejects Obamacare, Obama can point the finger at them and say to the rest of the country “LOOK WHAT THOSE EVIL JUSTICES TOOK AWAY FROM YOU! RE-ELECT ME SO I CAN STOP THEM FROM TAKING EVEN MORE FROM YOU!”

I will have to admit, Kass does make a valid point here.

Romney may be best served if the Court knocks down the mandate but not the whole law. There are millions of Dem seniors who will vote for Romney if they still must face death panels, Medicare cuts, etc. Don’t let Obama off the hook and allow these seniors to return to Dem roots.

Without the mandate, the entire law collapses in 2013-14 in any case.

and btw…i’ve come to the unhappy position that given the inertia of SCOTUS and its history, i think the odds of overturning the mandate are less than 50 percent.

If it is struck down, Mitt should have an ad out making this same point within an hour. Hammer him hard for wasting all of our time on an unconstitutional law when he should have been focused on the economy.

He should also have a press conference scheduled for within an hour of the decision and hammer this point also. They should absolutely not be caught flat-footed with this much time to prepare their reaction.

..dunno; from the context of the speech, seemed like it was a bullet point to add emphasis in describing how ineffectual Obama really was.

And — even as Holder has said — Thursday might be a little “too busy”. Romney’s observations would get buried in the avalanche of rhetoric that will surely ensue AND a remark made on Friday might seem like “me too” piling on.

If Obamacare is struck down as unconstitutional, Obama’s first two years could very well be considered a complete waste. Mitt is right to state that clearly today so that the meme can grow wings and fly.

On the other hand, if Obamacare is left intact, conservatives will naturally be enraged, and Mitt is perfectly correct to reassure Republicans and independents that he will unambiguously fight for the bill’s repeal. That’s another useful meme to get going in people’s minds because it will give his candidacy for the next few months purpose and focus.

The reason that he’s developing these memes now rather than on Thursday is that on Thursday all he11 is going to break loose with liberals, Tea Partiers and pundits screaming up a storm. Now, while it’s quiet, is the time to plant the ideas before liberals begin to spin in their own favor.

Unfortunately, what is most likely to occur from SCOTUS is that the mandate will be struck down, but the rest of the bill will either be thrown back to the lower courts (which will mean more painful, damaging delay) or passed to Congress.

It’s a common delusion here on HotAir that the majority of the public wants Obamacare overturned. A majority want the mandate overturned. If the Court strikes out the mandate, they will be doing liberals a huge favor, taking out the only part that’s unpopular and leaving behind what the public, at least by a majority, supports. And leaving that broken behemoth with our dysfunctional Congress to “fix” is about comparable to trusting your dog with building the new summer home.

Allah, as someone else upthread pointed out, your headline is misleading. Romney made no reference to Obama’s “first” term. Even the ABC News story to which you link has the headline: “Romney says if Obamacare is struck down, Obama’s term was wasted.”

The actual Romney quote:

If Obamacare is not deemed constitutional, then the first three and a half years of this president’s term will have been wasted on something that has not helped the American people.”

That is quite a bit different than Romney having referred to a “first” term.

Darn I wish we had Rick Santorum. Santorum knows how to articulate the conservative viewpoint. Romney bumbles and stumbles and makes inane points. He hits the target on the twentieth try rather that the first.
So, Mr. Romney, are you saying if Obamacare is upheld, Obama’s first term will be a success?

*Obamacare represents a vehicle through which the federal government
will continue to expand control over the American people
*Obamacare does have a death panel; it’s called IPAB (google it)
*Obamacare means bureaucrats are making your health decisions instead
of you and your doctor

Who cares if Obamacare is overturned? Obama will just issue an executive order installing universal, government-run healthcare. The de-balled Repubicans will do nothing.
