While the Supreme Court’s mixed decision on Monday on Arizona’s immigration enforcement law gave a big political boost to officials there who supported it, the ruling does not seem likely to unleash a new wave of legislation by other states to crack down on illegal immigration…

The court also allowed, and even invited, lawsuits against Arizona’s law that are based squarely on civil rights claims that it would lead to racial profiling against Latinos and other immigrants — issues that did not arise directly in the current case. Many civil rights groups, predicting that the police provision of the law would rapidly lead to discriminatory actions by officers once it takes effect, said on Monday that they were ready for that fight.

“If state governments enact new immigration bills, we say bring it on, we will see them in court,” said Anthony D. Romero, the executive director of the American Civil Liberties Union. His organization has participated with other rights groups in a separate lawsuit against Arizona over the law, known as S.B. 1070, and against immigration enforcement laws in other states.

With officers across Arizona forced to walk a tightrope of legal complexity, cash-strapped municipalities also worry they could soon be defending a flurry of lawsuits by the federal government, civil rights activists and irate motorists — distracting police from their main goal of fighting crime.

“We absolutely expect lawsuits on both sides of this issue,” said Tucson Police Chief Roberto Villasenor. “This will result in our officers being tied up in court rather than working on the streets to reduce crime.”

The provision requires police to make a reasonable attempt to check the immigration status of people they stop, even for an offense such as jay walking, if they suspect that they are an illegal immigrant.

But for Estrada, in Santa Cruz County where more than 80 percent of the population is Latino and where many speak Spanish at home, requiring deputies to try to determine the status of those they arrest and suspect are undocumented presents challenges.

“If you are going to guide yourself by the color and the language, you’re going to be racially profiling, so you are going to have to avoid that,” he said…

The Department of Homeland Security’s refusal to cooperate with Arizona’s court-tested crackdown on illegal immigration has field agents fuming, FoxNews.com has learned…

The agent who talked to FoxNews.com said his colleagues are as outraged as he is and that federal policy makes it impossible to catch illegal immigrants who are criminals, unless they are caught in the act.

“The biggest problem with their catch-and-release method is that ICE does not have an effective process for identifying detainees,” he said. Most detainees do not carry identification on them and they voluntarily provide their name.

“This leads to a larger problem. … We already know that there are difficulties with confirming identities of detainees, so how can ICE be sure that they are not putting a criminal back on the street?”

At what point did we decide that it was just fine that the President, or any other public official for that matter, could just enforce those laws he liked and ignore the ones he didn’t?
If that’s the kind of deal we have now, then why are we still lying to ourselves by saying we live in a free country? Freedom depends on a reliable assumption of law equally applied. Without that assumption, we are no longer free, but merely loose in our homes at the discretion of the despot in power at the moment.
Remember, this is a government that has already rounded up and imprisoned whole races of people and executed its citizens overseas without even the hint of due process. None of them thought it could happen to them either!
That’s the real issue here. Not immigration, legal or otherwise.

After Monday’s ruling, I’m going with the mantra “Blessed are those who expect nothing for they shall not be disappointed.” If I weren’t living through all of this crap right now, I would never believe it. When I watched Reagan board Air Force One to head home to California, I would never have dreamed that in just 22 years, the country as I knew it, would be on the verge of becoming a socialist third world cesspool. The Left never addresses what supports our nation’s integrity, it only supports and reports about support for that or they who attack our nation’s integrity.

This is the Romney campaign tag line they have been waiting to have someone at the local level to say.

There is going to be some heinous crime committed by someone released by ICE as a result of the DoJ abrogation of its agreements with Arizona. It will be so bad that NO ONE currently willing to play games over illegal immigration will be willing to make a noise afterwards.

The dopey Lanny Davis defended little Bammie’s Executive Order, or nullification of one of the laws of the USA by noting that is was almost identical to Marco Rubio’s ‘DREAM’-like act draft.

Imagine if President George W. Bush had picked up a bill drafted by a democratic Congressman but not passed by Congress, and rammed it through by Executive Order. Maybe Charlie Rangel’s military conscription bill for example?

You mean like the twice deported illegal alien that was just sentenced to 55 years in prison for dragging a Houston cop to death on the freeway after he hit him? Poor misunderstood illegal was drunk and high on coke. Probably abused as a child, they always throw that one in. I doubt if it will ever get bad enough for both sides to stop playing games. They value their cheap labor and votes more than the destruction of lives.

Rush is right on this. I’ve been very disappointed in Romney this week. He has to take a stand on things. This evasiveness just
reinforces the flip flopper image that Romney has. Call out Obama on this sh!t. Stand up for the rule of law. You just can’t keep saying “economy” over and over again and expect the other stuff not to matter. This is the first week I’ve felt like I was looking at a replay of the McCain team incompetence.

This is a slippery slope, and I’m afraid we’ve already reached the point where we can’t get any traction to stop the slide, and we’re sliding like on a slick wet mossy slope all the way down. And I’m afraid that that down is out, in the sense that what America is now will be out, because as we slip further the push will ultimately go beyond just giving citizenship to those who’ve managed to make their way physically into our country, but as the slide continues, to giving freer access for those in Mexico to migrate, really, en masse, with preordained immediate citizenship. Yes, that will occur, because the strong Mexican voting forces in this country. No doubt it will occur. And then we have a voting low income majority (in combo with white libs) that won’t heed the constitution in moving to redistribute property and $ to themselves, and to vote in socialism (govt takeover of business). It will be in their interest to do that, despite the fact that, overall, it doesn’t make economic sense. They’ll say: who cares? And why not the final mile. Make the 31 Mexican states the 51st through 82nd U.S. states. I kid not. NOT sarcastic.

Because the truth is that the slaughter of Mexicans was an original part of the plan.
Remember, the idea was to create a horrific news story and then blame it on American guns so that they could declare an emergency and nullify the Second Amendment. Dead and wounded and maimed Mexicans were a feature, not a bug! The wheels came off the plan when one of our own got killed inside our own borders.
This bunch will butcher people of other colors or in other countries by the bus-load without the slightest hesitation, but they can’t be seen to be responsible for one dead American on American soil.
Liberalism, or Progressivism if you like, is racism….Straight up, pure and simple!

I am (also) not at all surprised at that news (that link above)…BUT that meme that’s referred to in that article that is pointed out there as being false but oft-repeated by Democrats Hillary Clinton, etc., that meme (“90% of the guns in Mexico are from the U.S.”) has also been one of Dem. Senator Dianne Feinstein’s loud outcries and so it seems to me to be weird that Feinstein has now positioned herself in that “Obama security leak” complaint, pointing at Obama with outrage. I think there’s some sort of coup among the Clinton/Feinstein Left…

…and it makes me question just to what degree (if any) they are actually concerned about the nation’s security and crimes against it as much as they are playing poker with their grubsteaks their interest alone.

P.S.: Feinstein has long been one of the loudest “blame America and her guns” fanatics among the Left. She was broadcasting her belief that “90% of the guns in Mexico are from the U.S.” story for a while in the past for purposes of seeking increased limitations to our 2nd Amendment.

I just don’t believe any of the Democrats today. Not that these crimes (Fast and Furious, crime in Mexico, etc.) are not credible (I think they are) but that the motives by the Democrats seem entirely questionable…because they always turn “it” back on the U.S. for purposes of restricting if not casting aside our Constitution.

It appears that the Obama administration is not only getting in the face of the American people with their immigration policies, but they are also running a little private campaign of their own when it comes to the border patrol. Instead of the border patrol doing their job in an aggressive case in public, they are now being taught to run away and hide and only as a last resort are they to open fire. Wait! No! They can’t do that. They are supposed to become “aggressive” and “throw things.

i’ve read most of the opinion written by Kennedy. It was very dispassionate overview of the Fed role and the supremacy of Fed law over State law in this area. The Fed’s have long ‘occupied’ this area of the law…and, yes there is discretion that the Fed’s have…and no, we really can’t have the States suddenly start having their own laws

now, on Hannity lanny davis kept referring to the caution that Kennedy warned of. I did’t listen to all of it, but the context was racial profiling.

Actually, Kennedy’s opinion isn’t all that happy that the Fed’s filed suit against AZ without the law being in effect.

The nature and timing of this case counsel caution in evaluating the validity of §2(B). The Federal Government
has brought suit against a sovereign State to challenge theprovision even before the law has gone into effect. There is a basic uncertainty about what the law means and how it will be enforced. At this stage, without the benefit of a definitive interpretation from the state courts, it would be inappropriate to assume §2(B) will be construed in a waythat creates a conflict with federal law.

leftists like lanny davis/aclu/barry/Janet will eagerly seek out instances of the implementation that violate some Fed statue. Actually, Kennedy, talked a lot about the holding period of the detainee while calling INS for a status check.

This is the kind of thing that makes you want to pull your hair out. We are in the middle of an investigation where this administration used an operation, which was called Fast and Furious but should have been called Dumb and Dangerous, that put thousands of weapons into the hands of some of Mexico’s most dangerous drug cartels. Some of these weapons were used to kill American and Mexican citizens, including border patrol agent Brian Terry. They want their people to be weak and cut off at the knees while the real criminals face no handicaps. This is a demonstration of absolute stupidity on the part of the Obama administration who provide such non-sensical training.

It’s not bad enough that the federal government, under this administration want our guns, but now they don’t seem to want border patrol to use theirs either. What kind of fantasy world do these lunatics, who are running the asylum, live in?

I wrote Romney and told him that he needs to make a forthright and meaningful statement regarding a plan for immigration enforcement. He needs to take a stand for the citizens and legal immigrants of this nation and put the interests of Americans over those of illegal aliens and foreign nations. He needs to lead.

I told him that if he traipses along in Obama’s lawless footsteps, as much as it pains me to say it, I will not vote for him. I noted that it doesn’t make a nickles worth of difference to me who grants preferential treatment or exception to the law to illegal aliens or any subset of illegal aliens,if ANYONE grants preferential treatment or exception to the law to anyone in this nation illegally. It matters to me that the rule of law demands equality before and under the law for all CITIZENS AND LEGAL IMMIGRANTS and that illegal aliens have no place in our nation, claims upon it, or on any of us.

I told him that Americans had been UNCOMMONLY DECENT to the MILLIONS who are here illegally, providing over $113 Billion per year in social services for that group. I said that we have been INCREDIBLY PATIENT, enduring a constant stream of illegal aliens imposing themselves on our communities since the FIRST AMNESTY in 1986. I told him that those who enter our nation illegally, make demands on our laws and citizens, drain our communities resources for their own benefit have been HEARTLESS in their exploitation of our good will and tolerance and their continued predation on our nation.

I told him that HALF of Hispanic voters aren’t supporters of open borders and amnesty. The half who are will NEVER vote for a Republican no matter what he says to them. Those American voters of Hispanic decent who are more interested in what’s best for the nation, the economy and jobs and decent schools for their children, will not be put off voting for him simply because he takes a stand to secure our borders and put ALL Americans best interest ahead of the interests of illegal aliens. Many will vote for him BECAUSE he chooses to put America’s interests first.

Illegal immigration IS more than simply a matter of the rule of law. Its also a major economic issue. It must be addressed by the next president. IF Romney cannot persuade me that he will uphold the rule of law and put this nations interests ahead of those opportunists who choose to be in this nation illegally, If he cannot… or will not…. distinguish himself from the lawless Obama, I cannot vote for him.
