DHS suspends immigration agreements with Arizona in wake of Court ruling

Via Ace, that headline makes it sound like O pulled the plug because the Court found most of the law unconstitutional. No sense in complying with a statute that’s no longer legally in effect, right? But no: The section he’s limiting cooperation on is 2(b), authorizing Arizona cops to check the status of people whom they reasonably suspect are here illegally. That’s the one part that the Court upheld. What he’s doing, in other words, is using the ruling as political cover to reduce enforcement, no doubt as a complement to his DREAM gambit to win over Latino voters. If the Court won’t nullify the entire law, The One will.

The Obama administration said Monday it is suspending existing agreements with Arizona police over enforcement of federal immigration laws, and said it has issued a directive telling federal authorities to decline many of the calls reporting illegal immigrants that the Homeland Security Department may get from Arizona police.

Administration officials, speaking on condition they not be named, told reporters they expect to see an increase in the number of calls they get from Arizona police — but that won’t change President Obama’s decision to limit whom the government actually tries to detain and deport…

Federal officials said they’ll still perform the checks as required by law but will respond only when someone has a felony conviction on his or her record. Absent that, ICE will tell the local police to release the person

On Monday the administration officials also said they are ending the seven 287(g) task force agreements with Arizona law enforcement officials, which proactively had granted some local police the powers to enforce immigration laws.

This is, de facto, amnesty for illegals in Arizona unless they’re serious criminals, and in that sense not unlike O’s new DREAM rule. The big objection to his DREAM policy is that he’s violating his oath to faithfully execute the laws in order to effectively change federal policy. That’s also true here, with the added wrinkle that state cops, by checking people’s status, are actually doing most of the heavy lifting of enforcement for him.

Via Mediaite, here’s Jan Brewer gamely trying to spin the Court’s decision even though it stands for the proposition that if the feds don’t want to do anything about the border, your state government’s more or less stuck with their (in)decision. After you watch that, go look at the chart over at U.S. News citing DHS’s own numbers. Has illegal immigration in Arizona fallen because of the new law, with illegals avoiding the state for more hospitable places like Texas? Or has it fallen for the same reason that illegal immigration generally has fallen, i.e. because after four years of Hopenchange “stimulus,” Mexico’s economy looks better than ours does these days?

Why is that, exactly? Racial profiling can be an extremely useful law enforcement tool that has nothing to do with racism or discrimination.

It’s simple. The majority of those illegally in this country come from Mexico. The majority of Mexico’s population is Hispanic. Therefore, the majority of people who are here illegally are Hispanic. Based on that, why would you spend your time focusing on white, black, Asian, etc. people when you know the likelihood of their being illegal aliens is extremely small?

Given that virtually every member of the “illegal alien” category falls into one specific race, building a profile which uses that race as one component seems entirely reasonable to me.

Time to find creative ways to make it uncomfortable for ILLEGAL aliens to be in Arizona.

- Boycott any business that appears to hire ILLEGAL aliens

- Apply peer pressure to any person you know who has hired ILLEGAL workers as maids, gardeners, nannies etc.

- Can Arizona cut funding for bilingual programs?

- Can Arizona add requirements to prove U.S. Citizenship or legal status to all applications for Arizona state universities/colleges?

- Can Arizona prioritize and increase its enforcement of all drug and gang crimes to dry up the ILLEGAL drug trade?

- Can Arizona increase its enforcement of prostitution crimes to dry up the ILLEGAL prostitution trade?

- Can Arizona require proof of citizenship or legal status for all state business licenses and then increase enforcement against businesses that operate without a license?

You are right of course about profiling. There’s nothing wrong with it if it is statistically accurate. Language alone must be acceptable, -if someone appears to not be able to speak English they must be a suspect.

The citizenship naturalization process requires familiarity with English. No English means you may be an illegal, or on some kind of federal government visa which you must have on your person.

I already quit eating at Mexican food restaurants back when they were doing all their big marches. Don’t know anything else. Had a new roof put on our house two years ago and half of Mexico was out in my front yard. (3 full crews) Going to have another one put on in a few weeks and will be the same. It’s either that or no roof.

“As though we needed any more evidence, President Obama has demonstrated anew his utter disregard for the safety and security of the Arizona people. Within the last two hours, I have been notified the Obama administration has revoked the 287(g) agreement under the authority of which Arizona law enforcement officers have partnered with the federal government in the enforcement of immigration law.

“Of course, it is no coincidence that this announcement comes immediately on the heels of the U.S. Supreme Court’s ruling upholding the constitutionality of the heart of Arizona’s anti-illegal immigration law: SB 1070. The Romney campaign has been running a pretty tight ship over the last few weeks, but they stumbled today on immigration. Asked by reporters to describe Romney’s views on the Supreme Court’s decision in Arizona v. United States, a campaign spokesman went ’round and ’round in circles, saying essentially nothing at all. A portion of the cringe-worthy transcript:

QUESTION: What is his position on the actual law in Arizona?

GORKA: “Again, each state has the right within the Constitution to craft their own immigration laws since the federal government has failed.”

QUESTION: But does he think about the law in Arizona? You’re just talking about the states right to have a law but you’re not giving any position on the actual law.

GORKA: “Ultimately this debate comes back down to the federal government and the president failing to address this. If the president followed through on his campaign promise to address illegal immigration in the first year, this debate wouldn¹t be necessary.”

QUESTION: Is it fair to say that he has no opinion on the Arizona law?

GORKA: “Look, again, I¹ll say it again and again and again for you. The governor understands that states have their own right to craft policies to secure their own borders and to address illegal immigration.”

QUESTION: You’re not answering – what does he think about the policy in Arizona? Is it fair to say he has no opinion? You’re refusing to give us an answer.

I think you may be right! However, I would think they would dent with grapefruit size hail. We are right in the middle of tornado alley, and now it seems we are right in the path of frequent bad hailstorms.

I do wonder if Obama isn’t taking these little pot shots at the open nerve endings of conservatives on the hope that one or two will go on TV and say something stupid or will start acting out the way people did at rallies for McCain in 08. That stuff really turned independents off. If so, its brilliant politics potentially.

IOW, Dear Leader is essentially opening the border. There are a few obstacles to getting in but if you can maneuver your way around them, and it is not that difficult, then Obama, Holder, and Napolitano welcome you with open arms as long as you do not commit a felony. You may even be able to vote in some places.

So, SCOTUS upholds part of the law and DHS undermines it because A) they don’t like it and B) they don’t like it because it’s an opportunity to try and pander more illegal votes.

If SCOTUS strikes down the mandate on Thursday, what are the chances of an Executive Order that effectively ignores the ruling and continues forward with Obamacare as written? I mean, if you’re just going to decide which laws you feel like enforcing based on their potential for votes, why not just ignore a ruling for the same purpose? Who would stop them?

Wait until the Obamacare decision – if that thing goes down in flames we might see the first Presidential all out temper tantrum.

I’m thinking he’ll either issue an EO to cut Medicare drastically or raise the debt ceiling without approval from Congress. He’ll do something that makes the immigration order look like small potatoes.
