DHS suspends immigration agreements with Arizona in wake of Court ruling

posted at 6:01 pm on June 25, 2012 by Allahpundit

Via Ace, that headline makes it sound like O pulled the plug because the Court found most of the law unconstitutional. No sense in complying with a statute that’s no longer legally in effect, right? But no: The section he’s limiting cooperation on is 2(b), authorizing Arizona cops to check the status of people whom they reasonably suspect are here illegally. That’s the one part that the Court upheld. What he’s doing, in other words, is using the ruling as political cover to reduce enforcement, no doubt as a complement to his DREAM gambit to win over Latino voters. If the Court won’t nullify the entire law, The One will.

The Obama administration said Monday it is suspending existing agreements with Arizona police over enforcement of federal immigration laws, and said it has issued a directive telling federal authorities to decline many of the calls reporting illegal immigrants that the Homeland Security Department may get from Arizona police.

Administration officials, speaking on condition they not be named, told reporters they expect to see an increase in the number of calls they get from Arizona police — but that won’t change President Obama’s decision to limit whom the government actually tries to detain and deport…

Federal officials said they’ll still perform the checks as required by law but will respond only when someone has a felony conviction on his or her record. Absent that, ICE will tell the local police to release the person

On Monday the administration officials also said they are ending the seven 287(g) task force agreements with Arizona law enforcement officials, which proactively had granted some local police the powers to enforce immigration laws.

This is, de facto, amnesty for illegals in Arizona unless they’re serious criminals, and in that sense not unlike O’s new DREAM rule. The big objection to his DREAM policy is that he’s violating his oath to faithfully execute the laws in order to effectively change federal policy. That’s also true here, with the added wrinkle that state cops, by checking people’s status, are actually doing most of the heavy lifting of enforcement for him.

Via Mediaite, here’s Jan Brewer gamely trying to spin the Court’s decision even though it stands for the proposition that if the feds don’t want to do anything about the border, your state government’s more or less stuck with their (in)decision. After you watch that, go look at the chart over at U.S. News citing DHS’s own numbers. Has illegal immigration in Arizona fallen because of the new law, with illegals avoiding the state for more hospitable places like Texas? Or has it fallen for the same reason that illegal immigration generally has fallen, i.e. because after four years of Hopenchange “stimulus,” Mexico’s economy looks better than ours does these days?

“Prosecutorial Discretion”
- Ignoring laws that you don’t like.

“Oath of Office”
- “…to uphold and defend the laws…”

No meaning at all.

Wow, that was fast.

stukinIL4now on June 25, 2012 at 10:51 PM

Apparently they already had a plan in place to do this if any part of the AZ law was upheld.

Makes me wonder what they will announce Thursday afternoon if/when things do not go their way with Obamacare on Thursday morning.

King Obama has already set a precedent for ignoring laws he does not like and announcing it publicly. With the AZ law he has set a precedent for taking putative measures when a SCOTUS ruling does not go his way. I wonder what immediate executive action His Majesty will take if/when all or part(s) of Obamacare are struck down.

Well, you can’t even debate liberals on Twitter. I was suspended Sunday and didn’t break a single rule but some lib blocked me, several people complained and I was reinstated today to only be suspended again having a civil debate with a few liberals. What’s the point!!!

I’ve lived in Arizona for 30 years and watched this border situation steadily deteriorate. If the Feds don’t want to do their job, I say it’s time for “new ideas”. I’m willing to pay and extra hundred or two in my yearly state taxes for this. Let’s open the borders up to everyone, no questions asked, with the stipulation that they get on a Greyhound Bus with a one-way ticket to DC.

Perfect solution.

If I had Gates’ billions I’d pay to house them for a few months as close as possible to the WH, the Congressional building, and the Justice Department. Overrun DC with illegals and see what happens.

I was thinking something along the same thing. A bus trips by the hundreds to DC or NYC would have to be cheaper for Arizona than what they are faced with now. Time to outsmart the Alinskites running the WH.

Arizona (and other border states excl. Kalifornia) could use our private financial help to create their own transnational borders. I believe Kinky Friedman (former Gov. candidate for Texas?) suggest a plan using payoffs to Mexican Generals to stop illegal immigration from the southern side, making them responsible for sections of the U.S.-Mexico border in return for cash. This dovetails nicely with the corruption on that side of the border.

That, and our border guards all wearing Eric Holder masks (who apparently has no problems with the murder of Mexican citizens), would reduce our border problems.

Many studies point out that the development of a young mind is stifled when exposed to drugs. Clearly, Obama is suffering from such a fate.

Someone may have already said this, but this is a very dangerous game Barack is playing — politically dangerous. These Arizona police agencies are going to keep meticulous records about who they arrest, and who the feds order them to release. And when one of those folks commits a heinous crime — and it will happen — they’re going to have all the paperwork they need to show that Barack allowed that to happen. I see a really ugly October surprise in his future.

Rational Thought on June 26, 2012 at 8:14 AM

Well then, expect to see a lot more apprehended illegal aliens charged with felonies in Arizona. Can Arizona find a felony to charge them with if that’s the difference between deporting them and setting them loose?

Obama doesn’t think these things through.

jms on June 26, 2012 at 8:22 AM

Don’t think that can’t happen. Under Arizona law, ANY assault of a police officer can be charged as aggravated assault, a felony. An assault can be as simple as touching a police officer while you are being questioned, or even “putting him or her in fear of bodily harm.”

If so charged, do you fight the case in court and risk 5-15 years in prison, or do you plead guilty in exchange for a suspended sentence and deportation? Now you’ll never become a U.S. citizen, BTW.

Obama just made his Dreamers’ situation a lot more perilous.

I seem to remember a case where Federal officials in Washington didn’t want to hear about some Muslim immigrants in Arizona taking lessons at flight schools and only being interested in flying – not taking off or landing. It might be racist to look into what they were doing.

It turned out that they were illegally in the country. Of course, we didn’t learn about one of them — Hani Hanjour — until after he crashed American Airlines Flight 77 into the Pentagon killing 189 people. On the bright side, he killed less people than Obama & Holder’s Fast & Furious programme.

Resist We Much on June 26, 2012 at 10:35 AM

What I think a winning argument on this is; Due to lax Federal Law enforcement of immigration laws, all people who look like potential illeagle immigrants are under suspicion. If I was a leagle immigrant from Mexico, I would be pissed and demand that something be done so I would be steroetyped as a lawless immigrant.

Spudboy on June 26, 2012 at 11:39 AM

Obama is obviously going for the illegal immigrant vote. Selective non-enforcement of laws, is a lawless act. Why would anyone vote that that Bozo.

Dasher on June 26, 2012 at 12:25 PM

Obama has gone all District 13 (see Hunger Games) on Arizona – the only proper response by other states is to challenge Obama the same way Jan Brewer did.

This is just wonderful. I grew up thinking that this country had laws and the President took an oath to protect its citizens and to enforce the laws passed by our Congress. The President is also to uphold any decisions made by our Supreme Court.

Well, yesterday he just gave us all the finger. He is committing dereliction of duty and has forgone his oath, time and time again. When will the members of Congress wake up and impeach him?

landowner on June 26, 2012 at 2:44 PM

If, by election day, there is at least one news story of an illegal immigrant who, having been arrested and then released in Arizona, goes on to commit a heinous crime, the GOP and the Romney campaign would be wise to immediately hang that incident around Obama’s neck. Romney might also emphasize that as many as a dozen Americans are killed every day in automobile accidents involving illegal immigrant drivers.
